MANIFESTATION

DEFENDANTS, through the undersigned counsel, unto this

Honorable Court, most respectfully avers; That,

1. During the hearing on the Motion for the Issuance of A Writ of

Execution on June 26, 2019, defendants, through the undersigned counsel,
manifested that they are no longer opposing to the execution of the Decision,
dated December 6, 2011, rendered by this Honorable Court;

2. Further, defendants manifested that they are willing and inclined to pay
the plaintiffs the amount of damages awarded by this Honorable Court;

3. Hence, on July 10, 2019, EROMEL LELIS appeared before the

Honorable Clerk of Court of the Regional Trial Court – Branch 35 and
presented a SPECIAL POWER OF ATTORNEY wherein Atty. Orlando M.
Salatandre, Jr. of SALATANDRE AND ASSOCIATES LAW OFFICE
authorized him to claim and receive the sum of Two Hundred Thousand
(P200,000.00) Pesos only from spouses, Jose Wong and Anita Sande Wong, as
payment for the Damages awarded to the Plaintiffs in Civil Case No. OZC-96-
70, proof of which is attached herewith as ANNEX “A” and “A-1”;

4. On the same date, and in view of the foregoing, defendants, through

their counsel, and before the Honorable Clerk of Court of Regional Trial Court
– Branch 35, handed the cash amounting to TWO HUNDRED
THOUSAND PESOS (Php 200,00.00) to EROMEL LELIS as full and
final settlement of the damages arising out of and/or in relation to the above
captioned case; to wit:

3.a. MORAL DAMAGES : Php 100,000.00

3.b. EXEMPLARY DAMAGES : 50,000.00
3.c. ATTORNEY’S FEE : 50,000.00
3.d. TOTAL : PHP 200,000.00

5. Proof of which is attached herewith as Annex “B;”

WHEREFORE, foregoing premises considered, it is most respectfully

prayed to this Honorable Court that this manifestation regarding the payment
of the TWO HUNDRED THOUSAND PESOS (Php 200,000.00) cash as
full and final settlement of the damages by the Defendants to the Plaintiffs
herein be duly noted and that this MANIFESTATION as well as the
attachments hereto be entered in the records of the case.
