OBJECTIVE

There are two basic objectives of this Guidance Note:-

a) to clearly indicate to Members their responsibilities under current environmental legislation


concerning the disposal of asbestos wastes.

And b) to provide guidance to Members on the practical requirements for the proper dassifi cation,
packaging, labelling and carriage of asbestos wastes in compliance with current legislation.

2. INTRODUCTION

2.1 The carriage and disposal of asbestos wastes is governed by:-

a) The Special Waste Regulations 1996. These regulations are prescriptive and apply to
all forms of asbestos waste- both combined and fibrous.

b) The Carriage of Dangerous Goods by Road and Rail (Classification, Packaging and
Labelling) and Use of Transportable Pressure Receptacle Regulations 1996 (CDGC
PL2).
These Regulations detail the specific requirements for the classification, packaging and
labelling of dangerous goods (including wastes) in packages, which are to be transported
by road or rail.

c) The Carriage of Dangerous Goods by Road by Road Regulations 1996 (CDG), detail the
specific requirements for the carriage and labelling of dangerous goods (including wastes)
which are to be transported in tanks, tank containers and bulk containers.

d) The Dangerous Goods Safety Adviser Regulationsl 999 - require that any employer who
loads, transports or unloads dangerous goods must appoint a Dangerous Goods Safety
Adviser(s). See section 6.

e) The Carriage of Dangerous Goods by Road by Road (Driver Training) Regulations 1996
- require that when asbestos wastes are classified as Dangerous Goods then drivers who
transport them on the public highway must have undergone approved certified training
under the European Agreement Concerning the International Carriage of Dangerous
Goods (ADR).

3. REQUIREMENT PRIOR TO CARRIAGE AND DISPOSAL - THE SPECIAL WASTE


CONSIGNMENT NOTE

3.1 The Special Waste Regulations 1996 introduce the concept of the Consignor of the waste. This
is in effect the producer of the waste who requires it to be either disposed of or transferred to
another person. Members who are working on third party premises removing asbestos wastes
or have their own wastes to dispose of are in effect the Consignor of the waste and must accept
responsibility.

3.2 The Consignorof the waste must ensure that the waste is transferred to a person who is authorised
to accept this waste. This authorisation refers to either:-

a) a registered waste carrier

b) a holder of a waste management licence specifically including asbestos wastes.

Further details as to who is classified as an authorised person are given in the Special Waste
Regulations 1996.

3.3 All forms of asbestos waste are classified as Special Waste. Before the removal of asbestos
waste members who are Consignors must ensure that sections A & B of the special waste
consignment note (see section 3.4 below) are completed correctly, and that the pre-notification
copy (the white top copy) is sent to the Environment Agency at least 72 hours (but not more
than one calendar month) before the waste is to be removed.

3.4 The Special Waste Consignment Note is a five copy self-carbonating pad and is available from
the Environment Agency or the waste carrier. These five copies of each Consignment Note must
be coloured and may be printed with brief instructions to help Members ensure that each copy
is forwarded to the correct recipient.

Top Copy - White - This is the pre-notification copy and parts A & B must be completed by the
producer before it is sent to the Environment Agency which regulates the area to which the
waste is to be transferred or disposed of.

2nd Copy - Yellow - This is the copy for the recipient of the waste to send to the Environment
Agency after the waste has been transferred.

3rd Copy - Pink - Copy to be held by the recipient of the waste.

4th Copy - Orange - Copy to be kept by the carrier of the waste.

5th Copy - Green - Copy to be kept by the Consignor.

The above stated colours may vary and Members are advised to check that appropriate copies
are completed and retained by the appropriate parties involved with the transfer of the waste.

Notes for Completing a Special Waste Consignment Note.

3.4.1 Each note carries a unique number, which is assigned by the Environment Agency, and there
is a charge (currently for each note. If the asbestos waste is not transferred within one
calendar month a new pre-notification will be required and will incur a further charge (currently
Annex I is an example of a correctly completed Special Waste Consignment Note for
pre-notifying the Environment Agency.

Section A

1) The name of the waste producer and the address from where the waste is to be
removed. Postcodes must be included.

2) The address plus postcode to which the waste is to be transferred.

3) Will this transfer be a single load or part of a succession or part of a carriers


round. See section 7 re succession notes and carriers rounds.

4) The expected date of removal of the waste from the address given in part Al
above (and if part of a series of consignments the expected date of the removal
of the final consignment). This must be no more than 364 days after the date of
the first consignment.

5) This must be signed by either the Consignor or a representative of the
Consignor whose details are given in Part Al.

Section B

1) The description of the waste. Members are recommended to use the following
descriptions:-

Secu rely Bonded Asbestos - Covering bonded dust free asbestos wastes (for
example asbestos cement and asbestos floor tiles).

or Fibrous Asbestos - Covering fibrous asbestos and/or broken dusty bonded


asbestos wastes (for example asbestos insulation, sprayed coatings and asbestos
insulating board).

Loads of mixed asbestos - Securely Bonded and Fibrous, must be described as


Fibrous Asbestos.

The description Asbestos unspecified is confusing and does not provide an adequate
description. Recipients of waste described in such manner are advised to assume that it
is fibrous asbestos.

2) Classification Code:

170601 (for insulation materials)

170605 (for asbestos based construction materials)

3) The physical form of the waste - liquid, powder, sludge, solid, mixed.

4) The physical colour of the waste.

5) The total quantity of the waste (or a reasonable assessment thereof) to be removed
(tonnes) and the type of packaging to be used i.e. packages or packages used
inside a bulk container used.

6) Chemical components of the waste - fibrous or securely bonded asbestos


and concentrations expressed as a percentage.

7) A description of the main hazards - For asbestos use the code H7 Carcinogenic.

8) The process giving rise to the production of the waste i.e. asbestos stripping!
removal.

4. REQUIREMENTS PRIOR TO CARRIAGE AND DISPOSAL - PACKAGING AND LABELLING

4.1 Classification

All dangerousgoods, which may include asbestos wastes, must be classified before consignment.
Information concerning this is to be found in the HSC publication Approved Methods for the
Classification and Packaging of dangerous goods for Carriage by Road or Rail, which cross

references with the Health and Safety Commission (HSC) publication the Approved Carriage
List (ACL) - Information approved for the classification, packaging and labelling of dangerous
goods for carriage by road and rail.

4.1.1 Asbestos has two entries in the Approved Carriage List. The first is under Blue Asbestos
(Crocidolite) or Brown Asbestos (Amosite or Mysorite); the second is under White
Asbestos (Chrysotile, Actinolite, Anthophillite and Tremolite). These entries are the
Proper Shipping Name (PSN) of Asbestos which is used to comply with the
labelling requirements of CDGCPL2. Members are strongly advised to avoid
identifying asbestos wastes by colour alone.

4.1.2 Other information for classification, packaging and labelling is to be found in the ACL
against these entries.

- the United Nations Number (UNNO) for Amosite (PSN - Blue and Brown Asbestos) is
2212 and for Chrysotile (PSN - White Asbestos) is 2590.

- the Class Number (CLS) for all types of Asbestos Waste is 9.

- the Packing Group for Amosite (PSN - Blue and Brown Asbestos) is II and for Chrysotila
(PSN - White Asbestos) is Ill.

4.2 Packaging including containers

4.2.1 There are three UN Packaging Groups which are I, II, and Ill. Generally the lower the
packaging group is, the more dangerous the goods are i.e. Packing Group I is for the
packaging of more dangerous goods and Packing Group Ill is for less dangerous goods etc.

4.2.2 The Approved Carriage List (ACL), as stated in 4.1.2 above, identifies Amosite (PSN -
Brown and Blue Asbestos) to Packing Group II and Chrysotile (PSN - White Asbestos) to
Packing Group Ill.

4.2.3 UN Packages are single receptacles or packages (which include plastic sacks) that are
specified in detail and subject to design tests to prove their suitability to carry dangerous
goods. Once the package has been successfully tested an approved testing house
awards a certificate and this will specify the UN Mark.

Only packages bearing a UN Mark (on the package not on the label) can be used
for the packaging of dangerous goods. A circle within which are the letters 'u' and
'n' denotes the UN Mark Close to the UN Mark will be a list of codes that identify
the classification of dangerous goods that can be carried within that package.
Further details of the UN Mark and coding details are given in Annex 2.

4.2.4 Column 8 of the Approved Carriage List indicates whether or not dangerous goods can
be carried in 'bulk'. The entries for both Amosite (PSN - Blue or Brown Asbestos)
and Chrysotile (PSN - White Asbestos) indicates that these cannot be carried in
bulk. Both these types of asbestos must be packaged in UN approved packaging
before transportation by road. The exemption to this is that the waste asbestos is
classified as per paragraph 4.2.5 below.
Asbestos placed inside UN approved packaging can be transported inside a bulk waste
container (skip).

4.2.5 When the asbestos to be consigned is fixed or immersed in a natural or artificial binder
material (such as cement, plastic, asphalt, resins or mineral ore) in such a way that no
escape of hazardous quantities of respirable asbestos can occur during carriage then the
consignment is considered to be non-dangerous for carriage and therefore the
CDG Road and the CDGCPL2 Regulations do not apply and only the sections of
3 and 5.1 of this Guidance Note must be complied with. If there is any chance of
fibres escaping due to the binding material being damaged, broken, cut etc.
members are advised to classify the material as being dangerous for transport by
road with the full reguirements of CDG Road and CDGCPL2 being applicable.
Where CDG and CDGCPL2 do not apply recommendations for packing and
labelling for asbestos wastes are as given in Schedule 2 of The Control of
Asbestos at Work Regulations (CAWR). In these circumstances Members
must comply with the requirements of Schedule 2 of the CAWR.

4.2.6 When members use UN approved packaging for the transport of Asbestos wastes they
are strongly advised to obtain a copy of the certification details of that packaging
from the suppliers/manufacturers. Theses certification details must be made available to
the HSE upon request.

4.2.7 If the weight of asbestos inside each UN approved package is less than 10kg then
the CDG Regulations do not apply, however the CDGCPL2 Regulations are
still applicable. These require the asbestos to be carried in correctly labelled UN
approved packages as detailed in sections 4.2 and 4.3 of this Guidance
Note. Also in this circumstance apart from those aforementioned Sections and
also paragraph 5.1 all other subseguent parts of Sections 4 & 5 of this Guidance
Note do not apply. If any doubt exists then members are advised to consult a
Dangerous Goods Safety Advisor - See also section 6.

4.3 Labelling (unless otherwise stated) refers to packages.

4.3.1 The danger sign for packages used for the transport of waste asbestos is as shown
below.

4.3.2 As a minimum the label used for UN approved packages containing asbestos waste
which are classified as dangerous goods must contain the following:-

a) the danger sign complete with the class No. 9 in the bottom corner of the diamond.

b) The Proper Shipping Name (PSN) - ONLY ONE. In cases where the asbestos is
considered to be waste, then the PSN must be preceded by the word "Waste".

c) The UN number preceded by the letters UN. ONLY ONE NUMBER IS ALLOWED.

In addition as stated previously the package must also bear the UN Mark as detailed in Section
4.2.3. above.

Members are advised that these are the minimum markings that must appear on the package.
There is no legal restriction on additional information being provided on the package i.e. the
name and address of the Consignor, Contains Asbestos warning label etc.

Unlike previous requirements there is no specification for the textual elements. However they
must be of a suitable size and clearly and indelibly printed. The hazard label and the textual
markings must be placed so that they can be read easily when the package is in normal use
An example of the typical labels for the two types of asbestos wastes is given in Annex 3.

WARNING - Some UN approved packages are available that are pre-printed with two UN
Numbers i.e. Waste Blue Asbestos and Waste White Asbestos. Depending upon the type
of waste asbestos, Members must, before consignment, obliterate one of the UN
Numbers and its corresponding Proper Shipping Name. If Members are in
doubt, transport as Waste Blue Asbestos and obliterate UN2590 and the Proper
Shipping Name - Waste White Asbestos.

4.4 The Consignors Declaration.

Members who employ a registered waste carrier to transfer waste from a site to a licensed
disposal facility are as mentioned earlier acting in the capacity of the Consignor. If Members
use their own vehicles to transport waste they are also defined as the Operater under the
Carriage of Dangerous by Road Regulations 1996. The Consignor of any dangerous goods
(including asbestos wastes subject to the assessment described in section 4.2.5 above) must
provide to the Operator prior to carriage the following information:-

a) The Proper Shipping Name of the dangerous goods i.e. Blue or Brown Asbestos or
Amosite, and White Asbestos for Chrysotile.

b) The Classification Number preceded by the word 'Class'. For asbestos wastes this will
be 'Class 9'

c) The UN Number preceded by the letters 'UN'. For asbestos this will be UN 2212 or UN
2590.

d) The mass or volume of each individual package and the number of packages consigned.

e) The name and address of the Consignor.

f) The name and address of the Consignee (if known).

g) A signed authenticated statement by or on behalf of the Consignor in compliance with


the CDGCPL2, that:-

- The dangerous goods as presented may be carried and any packaging or


intermediate containers in which they are contained are in a fit condition for
carriage.

h) It is unlikely that the Consignors Declaration will be required for a Carriers Round or a
succession of Carriers Rounds - See section 7.2

The information provided in the consignor's declaration may be incorporated into the design
of the special waste consignment note.

An example of a Consignors Declaration is given in Annex 4.

5. Collection Transport and Disposal.

5.1 Special Waste Consignment Note.

When the asbestos wastes are to be removed from site the Consignor will hold the remaining
four copies of the self-duplicating Special Waste Consignment Note. When the carrier's vehicle
has been loaded the Driver will complete Part C of the Consignment Note and the Consignor
(as detailed in Part A) will also complete Part D.

The bottom top (green) copy must then be detached from the remaining three copies and kept
by the Consignor for at least 3 years. The remaining three copies must be given to the Driver
to take to the transfer I disposal facility.

After unloading the waste asbestos the Consignee (the holder of the waste management
Licence for the site accepting the waste) will complete part E of the Consignment Note . The
Consignee will be responsible for :-

a) Forwarding the yellow copy of the completed Consignment Note to the Environment
Agency.

and b) giving the orange copy of the completed Consignment Note to the Carrier i.e the driver.

and c) keeping the pink copy of the completed Consignment Note at the transfer/disposal site
for the remaining working life of the facility.

5.2 Transport

5.2.1 Vehicle Marking

Vehicles transporting more than 200kg of Amosite (blue brown asbestos) or more than 500kg
of Chrysotile (White) in packages must display during carriage:-

a) An orange coloured panel conforming to that shown below at the front and rear of the
vehicle.

and b) If the packages of waste asbestos are transported inside a reusable bulk waste container
(skip) the danger sign (as shown below) must be displayed on all fj sides of the bulk

The Health and Safety Executive has recently made it known that they do not consider a waste
skip to be a bulk container' as defined by CDG and consequently does not have to be labelled
as per the guidance given in this section. It is the view of ARCA that this exemption be ignored
and that any bulk waste container carrying asbestos wastes be labelled in accordance with the
recommendations given in this section.

5.2.2 Emergency equipment.

When a vehicle is carrying waste asbestos, a 2kg Dry Powder fire extinguisher (or equivalent)
must be provided in the vehicles cab, and if the vehicle has a maximum permissible waste in
excess of 3.5 tonnes a 6 kg dry powder fire extinguisher(or equivalent) must be provided on the
vehicle.

5.2.3 Documentation to be carried out during transport.

The Operator of any vehicle carrying dangerous goods must ensure that the following docu-
mented information is provided to the driver before the commencement of the journey and is
readily available during the actual transport of the asbestos wastes:-

a) All the information provided by the Consignor i.e. the Consignors Declaration as
detailed in section 3.4.2 above.

b) The total volume or mass of the packaged Asbestos to be carried.

C) The Emergency Action Code, for all types of asbestos is 2X.

d) Emergency Information as detailed in Annex 5.

6. Dangerous Goods Safety Advisers

Regulations requiring all employers, who as part of their main business activities, regularly load
and/or transport and/or unload dangerous goods (this will include asbestos and asbestos
wastes), must appoint one or more Dangerous Goods Safety Adviser(s) (DGSA). The appoint-
ed DGSA(s) must hold a valid training certificate (valid for 5 years) issued by the Scottish
Qualifications Authority. The functions of the DGSA are generally to carry out the duties of a
DGSA and advise the employer on the health, safety, and environmental matters related to the
transport of dangerous goods. The main duties of a DGSA are described in schedule 2 of the
DGSA Regulations.

If a Member is in doubt regarding the necessity to appoint a DGSA then they should consult with
a DGSA, who after an initial assessment of the Member's business operation will either recom-
mend the need to appoint a DGSA or that they are exempt from these Regulations. In the lat-
ter case a copy of the DGSA's initial assessment must be available to the HSE and be reviewed
as necessary on an annual basis.

Succession Notes and Carriers Rounds.

Succession Notes.

these are generally a number or a series of consignments from a stated Consignor to a stated
Consignee.

Points to Note.

a) The pre-notification of the first load (at least 72 hours) as per section 3.4. However, in
addition the number of consignments (or the total weight/volume of the waste) must be
stated on the first consignment note.

b) A Consignment Note will be required for each consignment but the pre-notification
period of 72 hours is not required for each of the subsequent consignments. The
number of the first pre-notification consignment note must appear on all subsequent
consignment notes.

c) Afee (currently will be charged for the first and each subsequent consignment

d) The series of consignments must be completed with a stated period maximum of 364
days from the first consignment

hen completed consignment notes form part of a series, the original pre-notification must be
referred to in the box.

Carriers Rounds and and A Succession of Carriers Rounds.

This allows for the Carrier to remove the same types of waste from specified consignors and
the premises (including domestic premises) within a 24-hour period to the same consignee. The
locations from which the waste arises must be within the area controlled by a single office of the
Environment Agency.

Points to note.

a) The round as opposed to the consignment becomes the focus of attention.

b) The fee (currently will apply to each round. One Consignment Note is valid for
one day, subsequent rounds will again require pre-notification and incur the fee.

c) The pre-notification period of at least 3 days still applies. The top copy of the
Consignment Note (white) must also have attathed to it a schedule of properties/locations
to be visited.

d) The schedule (referred to in c) above must also be kept for each pick up point and
include what is collected at each location.

e) A signature must be obtained from the consignor (or in the case of domestic premises
the owner) at each pick up point and a copy of the Consignment Note and the
schedule must be left with each consignor.

f) In the case of a leased or rented Local Council owned property then a schedule must be
signed by a representative of the Landlord or Local Council. If this proves difficult
Members are advised to contact the Local Office of the Environment Agency for advice.

g) For England and Wales - the Environment Agency has a Central Enquiry Point, Tel No.
0845 9333111. All calls to this number will be put through to the local Environment
Agency Office.

For Scotland, members are advised to contact their local office of Scottish Environment
Agency (SEPA).

TRANSPORT EMERGENCY CARD (Road)

NATURE OF DANGER
• The effect of dust inhalation may be delayed
• May cause irreversible effects to health (asbestosis)

PERSONAL PROTECTION
• Suitable respiratory protective device
• Googles giving complete protection to eyes
• Eyewash bottle with clean water
• Disposable overalls with elasicated cuffs and ankles, giving complete
protection to dead, face and neck
• Plastic or rubber gloves. Boots

GENERAL ACTIONS BY THE DRIVER


• Stop the Engine
• No naked lights. No smoking
• Keep public away from danger area
• Notify police and fire brigade as soon as possible

ADDITIONAL AND/OR SPECIAL ACTIONS BY THE DRIVER


• Any action only if without personal risk
• If practicable, use shovel, broom, small collecting container
• Avoid direct contact with substance
• Stop leaks, if without risks
• Sweep up spilled substance, but avoid making dust
• If substance has entered a water course or sewer or been spilt
on soil or vegetation advise police

FIRE (information for the driver in case of fire)


• Do not attempt to deal with any fire involving the load

FIRST AID
• Remove contaminated clothing immediately and wash affected skin with soap and water
• If substance has got into eyes, immediately wash out with plenty of water. Continue treatment
until medical assistance is provided
• Even if there are no symptoms, send to a doctor and show him this card

SUPPLEMENTARY INFORMATION FOR EMERGENCY SERVICES


• Remove absorbed substance to safe place
• Dampen solid with water
