PREAMBLE

Whereas:
Dr. Ram Manohar Lohiya National Law University, Lucknow was established by Dr. Ram
Manohar Lohiya Rashtriya Vidhi Sansthan Uttar Pradesh Adhiniyam 2005 (No. 28 of 2005)
in 2006 in the interests of better legal education and higher standards of legal research and
professional training;

In furtherance of the objective enshrined under section 3 of the RMLNLU Act, the Vice-
Chancellor constituted the Committee to organize Seminar, Workshop, Extra Murals and Special
Lectures.

In pursuance of the said objective, the committee seeks to facilitate and organize Seminar,
Conference, Panel discussion, Special lectures, Workshop, Extra Murals etc. for the purpose of;

PROVIDING the maximum opportunities for every member of RMLNLU family to achieve
excellence in academic activities.

RECOGNISING the need to develop the varies talents in student’s fraternity

UNDERSATANDING the need to formalize the organization and conduct of academic activities
beyond the class room

WE, the members of the committee to organize seminar, workshop, extra murals, special lecture,
in the thirteenth year since the inception of this university, do hereby adopt, enact and give to
ourselves this constitution.

PART I: GENERAL PROVISIONS
Article 1: Title, Scope and Commencement

1. This Constitution may be called the Constitution of Committee to organize Seminar,


Workshop, Extra Murals and Special Lectures.
2. It shall be applicable to all the students currently enrolled in B.A.LL.B. (Hons.) and LL.M
programme, and any other full-time courses that may be instituted by the University from
time to time.
3. This Constitution shall come into force as and when notified by the Vice Chancellor.

Article 2: Definitions

1. “University” shall have the same meaning as assigned to Sansthan as defined under
Section 2(viii) of the Dr. Ram Manohar Lohiya Rashtriya Vidhi Sansthan Uttar Pradesh
Adhiniyam, 2005.
2. “Annexure” means a document attached to this document which shall be considered as a
part of these Rules and Regulations pursuant to the section under which it is provided for.
3. “Appropriate Authority” means Vice Chancellor or any person acting on his/her
capacity.
4. “Core Body” means body constituted under article 5 of this Constitution.
5. “General Body” means body constituted under article 6 of this constitution.

PART II: STRUCTURE AND COMPOSITION OF THE COMMITTEE

Article 3: Composition of the Committe

1. The committee shall consist of Chairperson, Faculty member, Core Body and General
Body.

Article 4: Chairperson and Faculty Member

1. Chairperson and Faculty member shall be appointed by the appropriate authority of the
University within one week of the commencement of classes in odd semester.

Article 5: Composition of Core Body

1. The Core Body shall consist of following member –
a. Convener (to be nominated from fifth year);
b. Co- Convener (to be nominated from third/third year);
c. Treasurer (to be nominated from third/fourth year);
d. Secretary (to be nominated from third/fourth year);
OR
a. Convener (to be nominated from fourth year);
b. Co- Convener (to be nominated from fourth/third year);
c. Treasurer (to be nominated from fourth/third year);
d. Secretary (to be nominated from the fourth/third year);
OR
Any Other Model.
2. Nomination process under article 3(1) shall be shall be governed by Annexure A.

Article 6: Composition of General Body

1. General Body shall consist of Core Body and minimum 5 students inducted from each
respective batch of B.A.LL.B. Program.
2. Induction shall be held on the basis of interview or interview and any other procedure as
may be decided by Core Body before induction.
3. Induction of First, Second and Third Year of B.A.LL.B. Program shall be conducted by
Core Body.
4. Induction of Fourth and Fifth Year of B.A.LL.B. Program shall be conducted by
Chairperson and Faculty Advisor.
5. Candidate selected through induction under article 6(3) shall be deemed as provisional
selection.
6. The provisional selection of candidates shall become permanent after their performance
assessment at the end of March.

Article 7: Tenure of the Committee

1. The tenure of the Committee shall be for one academic year, post which, it shall be
freshly constituted.

PART III: DUTIES AND OBLIGATIONS OF THE CORE BODY

Article 8: Duties and Obligations of Convener

1. The Convener shall preside over, and may call for meetings of the Core Body and General
Body, whenever it requires.
2. The Convener shall have the obligation to ensure the functioning of the Committee in a
fair, democratic, transparent and efficient manner
3. The Convener, after consultation with Core Body and General Body, shall propose
intention to organize Seminar, Special Lectures, Conferenence, Workshop and any other
events before the Chairperson.
4. The Convener shall put before the Chairperson estimates of budget prepared, expenditure
and saving details prepared under article 10(2) and any other information he/ she may
deems fit.
5. Convener shall apprise Chairperson of all decisions undertaken by the General Body and
Core Body under the resolution passed under article 17.
6. The Convener shall perform any such duties as may be advised by the Chairperson.
7. The Convener shall have the authority to resolve the disputes arising in Committee in
consultation with the Core body or General Body or Both.
8. Convener shall have a final say in case of tie, whenever a matter if decided by voting.
9. Convener may seek assistance of any member of the committee in order to discharge
his/her duties.

Article 9: Duties and Obligations of the Co-Convener

1. The Co-Convener may preside over the meeting in case of the absence of Convener or
under the following circumstances:
a) The Convener has resigned; or
b) The Convener has graduated from the University; or
c) The Convener has communicated an inability or unwillingness to discharge the
duties of the office of the Convener.
2. The Co-Convener shall discharge duties that have been so delegated by the Convener.
3. The Co-Convener shall perform such duties as may be determined by the Committee
4. The Co-Convener shall, in consultation with Core Body and General Body, shall prepare a

tentative list of events for an academic session.
5. Co- Convener shall prepare a quarterly report and further an annual report at the end of the
academic year. The report shall include; inter alia:
a. Brief of the events organized along with date, speakers names etc.
b. Details of budget allocated, expenditure incurred and any savings of the each event.
c. Any other information as he/she deems fit.
6. Co- Convener may seek assistance of any member of the committee in order to discharge
his/her duties.

Article 10: Duties and Obligations of Treasurer

1. Treasurer shall prepare a budget estimate, in consultation with the core body, and present
it before the Convener for further action.
2. The Treasurer shall prepare details of budget allocated, expenditure incurred and savings
of each event organized by the Committee within a reasonable time.
3. The Treasurer shall present the details prepared under article 6(1) & 6(2) to the General
Body on whatsapp group or through any other medium.
4. The treasures shall prepare a report of details under article 6(2) on quarterly and annual
basis and present it to the Co –Convener for the purpose of including it under quarterly
report and annual report.
5. In the absence of the Convener, Co-Convener, Treasurer shall act as the Convener.
6. Treasurer may seek assistance of any member of the committee in order to discharge his
duties.

Article 11: Duties and Obligations of the Secretary

1. The Secretary shall have the duty to record and preserve the minutes of the meetings of the
SWA and ensure that all such minutes are disclosed.
2. Secretary shall have a duty to keep the record of letter addressed to any authority of the
University by the Committee
3. Secretary shall keep the list of required letters and application in a specific folder of
Seminar Committee email id for any future use.
4. The Secretary shall be responsible for reporting to convener.

5. The Secretary shall act as the Convener in the absence of the Convener, Co-Convener and
the Treasurer
6. Convener may seek assistance of any member of the committee in order to discharge his
duties.

PART IV: PROCEDURE OF MEETINGS

Article 12: Convening of Meeting

1. Meetings may be convened by the Convener, Co-Convener, and Secretary or if not less
than five members feel a need to convene a meeting for discussion of any particular issue.
2. The member convening the meeting shall announce the date and time of meetings on
WhatsApp group or any other appropriate medium.

Article 13: Agenda and Minutes of Meeting

1. Convener, in consultation with the Core Body, shall state the agenda of the beginning of
such meeting.
2. The Secretary shall maintain or oversee the maintenance of the record of the minutes of
each meeting.

Article 14: Attendance in Meeting

1. A delayed presence of more than 15 minutes shall lead to forfeiture of attendance for that
meeting.
2. In the event that a member is unable to attend a meeting, he/she shall intimate such reason
on whatsapp group of General Body at least an hour before the commencement of such
meeting.

Article 16: Resolution

1. Any member of core body or minimum 8 member of General body may move a resolution
in writing, before convener or Chairperson, with a copy to each member of Core Body, on
any particular issues except the matters governed by Part V and Part VI of this
constitution.

2. Content of the resolution moved shall be brought into the notice of the General Body
member 48 hrs prior to the scheduled date of voting on the resolution.
3. The resolution shall be forwarded to Chairperson for further action if it is passed by simple
majority of the General Body member who have participated in the process vote in favor
of the amendment, with at least two-thirds of the general body member participating in the
process.
4. The voting for such an amendment may be conducted by a show of hands or a secret ballot
as the Convener may deem fit.

PART V: DISCIPLINARY ACTION


Article 17: Disciplinary Action against the Member

1. Membership of any member of General Body may be suspended, for a certain period
of time and/or terminated for one academic session, or he/she may be issued an warning as per
the procedure laid down in Annexure B, if
a) If he/she is found engaging in activities violating the provisions of this
Constitution.
b) If he/she does not appear for two consecutive meetings without prior notice or
valid reasons, in case of an emergency.
c) If he/she does not appear for three consecutive meetings with or without prior
notice in compliance of article
d) If he/she is found to be negligent towards his duties as envisaged under this
Constitution.
e) If he/she fails to complete the work or found negligent towards duties assigned
or direction given to him/her.
f) If he/she fails to comply or found negligent towards duties assigned or direction
to him/her.
2. Disciplinary actions against any member of Core Body, under article 17(1) shall be
subject to the final approval of the Chairperson.
3. Disciplinary actions against any other member expect member of Core Body, under
article17(1), shall be subject to the final approval of the Core Body.

Article 18: Effect of Suspension, Termination and Resignation of Membership

1. A suspended/terminated member will no longer be a part of the Committee for the said
time period in his/her suspension/termination notice and must stop exercising all
official powers and functions thereof.

Article 19: Resignation from Membership

1. A member may resign by sending a resignation letter to the Chairperson; provided that
the acceptance of such resignation would be subject to approval by the Chairperson.

PART VI: AMENDMENT, SAVINGS AND REPEAL

Article 20: Amendments

1. Notwithstanding anything in the constitutions, any provisions of this Constitution may be


amended in the following manner:
a. Any member of Core body or minimum 5 member of General Body may
recommend the amendment to the convener in writing.
b. Recommended amendment shall be brought into the notice of the committee
members 48 hrs prior to the scheduled date of voting on the amendment
c. The amendment must be passed by at least two-thirds of the members of General
Body present and voting.
d. The voting for such an amendment may be conducted by a show of hands or a
secret ballot as the Convener may deem fit.
e. The amendment so passed shall take effect as on the date notified by the
committee.

Article 21: Savings and Repeal

1. All existing policies of the committee or the conventions governing the conduct of the
affairs of Committee shall continue to be in force, to the extent that they are not inconsistent
with the provisions of this Constitution.

2. Any previous documents governing the functioning of the Committee are hereby repealed.

Article 22: Removal of Difficulties

1. Chairperson, on recommendation of Core Body, for the purpose of removing any


difficulties, particularly in relation the functioning of the, by order direct that this
Constitution shall, have effect subject to such adaptations, whether by way of modification,
addition or omission, as he may deem to be necessary or expedient.
2. Such order must specify whether the modification, addition or omission, as the case may
be, is time bound (if so for what period) or generally applicable.
3. No such order under clause (1) shall be made after 45 days has elapsed from date of the
commencement of the constitution.

PART VII: MISCELLANEOUS


Article 23: Advisory Member

1. Any member of General Body who leaves committee voluntarily in his/her forth year or
Fifth year of his study program may act as an advisory member.
2. Advisory member shall not participate in any meetings of the Committee though he may
advise the Convener through email or any other appropriate medium along with a copy to
other Core member.

Article 24: Rule Making Power

PART VIII: ANNEXURES

Annexure A: Rules Governing Nomination Procedure Under Article 5

1. Member of Core Body, under article 5, shall be nominated by a panel consisting of
Chairperson and Faculty Advisor after a fair, transparent and democratic procedure
of the interview of interested candidate
2. Chairperson shall invite application, from eligible candidate under article 4, for the
constitution of Core Body
3. Candidate applying for the Core membership shall state the post for which they are
applying.
4. Chairperson shall schedule after a consolation with respective faculty advisor.
5. The Chairperson, after a final decision on date for the interview, shall inform the same
to the interested candidate and faculty advisor.
6. Panel shall nominate the respective member of core Committee after the performance
in interview and decision of the panel shall be final and binding.
7. Panel may consider the following criteria as a parameter, but not limited to this extent,
for nominating the Core Body from the candidate who appeared for the interview
a. His/her previous record work experience and in the Committee
b. His/her visionary and novel idea to bring committee at a greater height and
excellence
c. His/her ability to
d. Any other criteria as panel deems fit.

Annexure B: Rules Governing Disciplinary Action under Article 17

1. Rules for the member of General Body except member of Core Body;
a. Convener may issue a Show cause Notice against member upon violation of any rule
under article 17 or non-compliance of any duty, direction given to such member.
b. Minimum 48 hours shall be provided to person receiving Show cause Notice to
respond for responding to the notice.
c. Upon recipient of written reply Convener, in consultation with Core Body, shall
decide as to whether there has taken place a violation of Article 17 or non-compliance
of direction or breach of duty. After consideration of response to the show cause
Notice, Convener shall pass an appropriate order regarding disciplinary action as per
article 17.

d. The decision of Convener shall be final and binding.

2. Rules for the Member of Core Body


a. Convener may bring into the notice to Chairperson, in written, of violation of any rule
under article 17 on part of member or non-compliance of any duty, direction given to
such member.
b. In case of violation any rule under article 17 on part of convener or non-compliance
of any duty, direction given to the convener, any member of Core Body may bring it,
in written, into the notice of Chairperson.
c. Upon recipient such information, Chairperson may issue a Show cause Notice against
concerned member.
d. Minimum 48 hours shall be provided to person receiving Show cause Notice for
responding to the notice.
e. Upon recipient of written reply to the showcause notice Chairperson, in consultation
with Convener, or Chairperson, in consultation with Core Body if matter is concerned
with the Convener, shall decide as to whether there has taken place a violation of
Article 17 or non-compliance of direction or breach of duty. After consideration of
response to the show cause Notice, Chairperson shall pass an appropriate order
regarding disciplinary action as per article 17.
The decision of Chairperson shall be final and binding.
