OF EDMER FAMA
(Pursuant to SC A.M. No. 12-8-8-SC)

The Judicial Affidavit of Edmer Fama is executed to serve his direct testimony in
the instant case.

I, EDMER FAMA, of legal age, single, Filipino, and residing at No. 5, Second Street,
Brgy. San Agustin, Ungka, Iloilo City, state under oath as follows:
after having been duly sworn to in accordance with law in answer to the questions
asked of me by Atty. Ralf Owen Dela Cruz in his office at Room 302, La Sallette
Building Valeria Street, Iloilo City, on June 17, 2019 at 10:00 A.M. fully conscious
that I do so under oath and that I may face criminal liability for false testimony or
perjury hereby depose and state:

PRELIMINARY STATEMENT

The person examining me is Atty. Owen Dela Cruz, of legal age, with office address
at Cruz and Monsale Law Firm, Room 302, La Sallette Building, Valeria Street, Iloilo
City. The examination is being held at the same address. I am answering his questions
full conscious that I do so under oath and may face criminal liability for false
testimony or perjury.
PURPOSE: This affidavit/testimony of Edmer Fama is being offered as evidence to
substantiate the claim of Laurence John Sortigosa, the plaintiff in this accion
reindivicatoria that there were demand letters sent to the defendants and such are
refused by the defendants

Q: Can you tell me your personal circumstances?

A: I am Edmer Fama, of legal age, single, Filipino and residing at No. 5, Second
Street, Brgy. San Agustin, Ungka, Iloilo City. That I am the postman who delivered
the demand letters.

Q: Why are you executing foregoing sworn statement?

A: I am executing this sworn statement to be adopted as my direct examination in this
case to prove that there were demand letters sent and such were refused by the
Spouses whom I delivered it to.

Q: How did you know defendants SPS. RENZO BEAVER BALBERONA AND
PATRICE MARIE NAVA?
A: I am familiar with them as I always get to see and sometimes deliver mail to them
in the past as this is my usual route for my mail delivery and I have been working in
the post office for a long time already.

Q: How did you come across the Spouses again?

A: I had job orders on May 2, 2019 to deliver the mails on Pavia and Jaro Iloilo City
to Mr and Mrs Renzo and Pat Balberona, which I did on May 3 on Jaro and May 6 on
Pavia.

Q: What happened when you delivered the letters?

A: They refused to accept and acknowledged the letters sent by the sender.

Q: Do you know what kind of letters are those?

A: They were demand letters.

Q: How did you know that they were demand letters?

A: I knew that they were demand letters because when Mr. Sortigosa went to the post
office, he had an instruction to give it directly to the spouses because according to
him, the letters were demand letters which the spouses repeatedly and intentionally
refused to acknowledge and accept months prior.

Q: What did you do after such refusal?

A: I took the letters and sent it back to the sender with a return card as part of the
company practice.
