ABATEMENT ORDER
OF THE
CITY OF MONTGOMERY
BOARD OF ADJUSTMENT
ISSUED AT THE SPECIAL HEARING OF TUESDAY, OCTOBER 15, 2019
CONCERNING: 1890 SNOWDOUN CHAMBERS ROAD, MONTGOMERY, AL
WHEREAS the City of Montgomery adopted Ordinance No. 38-63, Zoning Ordinance,
‘on September 17, 1963, which provides for the abatement of nuisances creating hazards or
nuisances; and
WHEREAS the City of Montgomery Board of Adjustment opened case No. BD:2019-063
uupon receipt of a petition signed by surrounding property owners regarding alleged violations of
the City of Montgomery Zoning Ordinance on the property located at 1890 Snowdoun Chambers
Road in Montgomery, Alabama
Owner(s)/Lessee(s): Edgar Valerio Avalos, James Brown
WHEREAS the City of Montgomery verified the existence of said violation and attempted
unsuccessfully to cause the owner and/or lessee to abate the violation; and
WHEREAS the Board of Adjustment did hold a public hearing on said violation at the
hour of 10:00 a.m. on Tuesday, October 15, 2019, in the City Council Auditorium, 103 N. Perry
Street, Montgomery, AL 36104; and
WHEREAS it satisfactorily appears from the notices on file that proper notice of said
hearing was given in all respects as required by law; and
WHEREAS an agenda was submitted identifying public nuisance conditions and request
that an Abatement Order be issued to abate further or future conduct or use of the property located
at 1890 Snowdoun Chambers Road, that results in unreasonable noise, nuisance, and/or hazard to
the health, comfort, and convenience to surrounding property; and
WHEREAS the petitioner, owner/lessee of the subject property, and other representatives
of surrounding property owners did appear at said hearing to present testimony; and
WHEREAS the Board of Adjustment did hear and consider all said reports,
recommendations, and testimony as herein above set forth;
NOW THEREFORE BE IT RESOLVED that the Board of Adjustment declares the
property located at 1890 Snowdoun Chambers Road is in violation of City of Montgomery Zoning
Ordinance, a public nuisance, and orders the owner(s) and/or lessee(s) of the property to cease and
desist nonconforming use and/or conduct immediately and authorize appropriate officials to
enforce the abatement order.
