A RESOLUTION DIRECTING ALI~DISTRIBUTION UTILITIES


TO REMIT THEIR RESPECTIVE PROPORTIONATE SHARES TO THE
DISTRIBUTION MANAGEMENT COMMITTEE'S 2016 BUDGET

WHEREAS, Section 43 (b) of Republic Act No. 9136 mandated the Energy
Regulatory Commission (ERC) to promulgate and enforce the Philippine Grid
Code (PGC) and Philippine Distribution Code (PDC);

WHEREAS, the PDC contains the rules, requirements, procedures and


standards to ensure the safe, reliable, secure and efficient operation,
maintenance and development of the electricity distribution systems in the
Philippines;

WHEREAS, Section 2.2.1, Chapter 2 of the PDC provides for the


establishment of the Distribution Management Committee (DMC) that shall
perform the following functions: (a) monitor the implementation of the PDC ; (b)
monitor, evaluate and make recommendations on distribution operations; (c)
review and recommend standards, procedures and requirements for distribution
system connection, operation, maintenance and development; (d) coordinate
Distribution Code dispute resolution and make appropriate recommendations to
the ERC; (e) initiate the Distribution Code enforcement process and make
recommendations to the ERC; (f) initiate and coordinate revisions of the
Distribution Code and make recommendations to the ERC; and (g) prepare
regular and special reports for submission to the ERC, or as required by
appropriate government agencies, or when requested by a Distribution System
User',

WHEREAS, pursuant to Section 2.2-4.1, Chapter 2 of the PDC, the DMC's


operating costs, including the maintenance of a permanent support staff, shall be
shared among all Distribution Utilities (DUs) as direct proportions of their
Annual Energy Sales;

WHEREAS, on 24 May 2016, the ERC approved the initial budget of the
DMC for the year 2016, as follows:

WHEREAS, on 21 June 2016, the ERC approved the 2016 supplemental


budget of the DMC amounting to PhP2 million for the General Plant and
Equipment. The said amount is for additional space to accommodate a
considerable number of participants in the conduct of meetings, public
consultations, workshops and other similar activities. Hence, the total approved
budget of DMC for the year 2016 is as follows:

WHEREAS, the ERC approved total budget of the DMC for the year 2016,
considering the unutilized portion of the 2015 DMC budget, is as follows:

WHEREAS, the proportionate share of each DU to the 2016 DMC budget


is computed based on its 2014 Annual Energy Sales;

NOW, THEREFORE, the ERC, after due deliberation, RESOLVED as it


hereby RESOLVES, to APPROVE and ADOPT, as it hereby APPROVES and
ADOPTS, the 2016 budget of the DMC;

THE ERC FURTHER RESOLVED to direct each DU to: (a) remit its
proportionate share, as stated in the attached "ANNEX A", which is made an
integral part of this Resolution, in the approved DMC budget for 2016 to the
DMC not later than 30 July 2016; and (b) submit to the E C, its proof of
compliance, within fifteen (15) days from such comPlian/j

This Resolution shall take effect immediately after its publication III a
newspaper of general circulation in the country.
