EXECUTIVE ORDER NO. 2019-20

CREATING THE TASK FORCE TO CLEAR ROADS OF ILLEGAL STRUCTURES
AND CONSTRUCTIONS IN THE MUNICIPALITY OF NAGUILIAN, LA UNION

WHEREAS, there is a directive of President Rodrigo R. Duterte during his fourth

State of the Nation Address (SONA) in an apparent bid to ease traffic congestion entire
the country;

WHEREAS, President Duterte has declared that all public roads should not be
used for any other purposes and has specifically targeted public properties being
utilized for financial gains by private groups;

WHEREAS, the Department of Interior and Local Government through

Memorandum Circular No. 2019-121 dated 29 July 2019 on the Presidential Directive
during the 4th State of the Nation Address of the President to Clear Roads of
Illegal Structures and Constructions, all local officials are enjoined to exercise their
powers essential to reclaim public roads which are being used for private ends and in
the process, rid them of illegal structures and constructions;

WHEREAS, Section 102, Chapter I of PD 1096, otherwise known as the

National Building Code under the Declaration of Policy, it is the duty of the State to
safeguard life, health, property, and public welfare, consistent with the principles of
sound environmental management and control; and to provide for all buildings and
structures, a framework of minimum standards and requirements to regulate and control
their location, site, design, quality of materials, construction, use, occupancy, and
maintenance;

WHEREAS, Section 16, Chapter II of RA 7160, also known as the Local

Government Code of 1991 under the General Welfare clause, local government units
are directed to ensure and support, among other things, the preservation and
enrichment of culture, promote health and safety, enhance the right of the people to a
balanced ecology, encourage and support the development of appropriate and self-
reliant scientific and technological capabilities, improve public morals, enhance
economic prosperity and social justice, promote full employment among their residents,
maintain peace and order, and preserve the comfort and convenience of their
inhabitants;

WHEREAS, Municipal Ordinance No. 31 Series of 2014, otherwise known as the

2014 Traffic Code of the Municipality of Naguilian, La Union and Amending for the
Purpose all Ordinances Inconsistent Thereto necessitates the need to update the
existing traffic ordinance of the municipality to conform with the demands of present
times and an updated traffic ordinance will surely pave way for a more convenient flow
of all means of land transport taking into account the various development plans and
programs of the municipality;

WHEREAS, Municipal Ordinance No. 76 Series of 2016, also known as the

Ordinance Requiring Owners of Motorized Vehicles to Provide their own Parking
Space within their Premises and Providing Penalties for Violation Thereof
stipulates a need to require owners of motorized vehicles to provide their own parking
spaces within their premises to promote public convenience, order and traffic safety;

WHEREAS, Municipal Ordinance No. 93 Series of 2016, also known as the

Ordinance Amending Ordinance No. 70 Series of 2015, prohibits obstructions along
the roads within the municipality of Naguilian, La Union;

WHEREAS, Municipal Ordinance No. 110 Series of 2016, otherwise known as

the Ordinance Designating Yellow Lanes for Slow-Moving Vehicles Plying the
Naguilian-Bagulin Road within the Territorial Jurisdiction of the Municipality of
Naguilian, La Union, Providing Penalties to Violators Thereof and for Other
Purposes recognizes the need to ensure safe and convenient passage of all forms of
transportation along the newly concreted and widened stretch of the Naguilian-Bagulin
Road and to control vehicular flow by providing designated lanes for slow-moving
vehicles along the said road;

NOW THEREFORE, I, NIERI T. FLORES, Municipal Mayor of the municipality of

Naguilian, La Union by virtue of the powers vested upon me by law do hereby order the
creation of the Task Force to Clear Roads of Illegal Structures and Constructions.

SECTION 1. The Task Force to Clear Roads of Illegal Structures and

Constructions shall be composed of the following:

SECTION 2. Functions and Duties of the Task Force to Clear Roads of Illegal
Structures and Constructions.

1. Formulate policy recommendations and plans of the LGU on transport and

traffic management.
2. Establish the policies and directions for the implementation of the task force
at the local level.
3. In charge of information dissemination of this order through various media
platforms
4. Spearhead the clearing of obstructions and illegal infrastructure in the
municipality of Naguilian, La Union.
5. Implement the following Municipal Ordinances:
a. Municipal Ordinance No. 31 Series of 2014, otherwise known as the 2014
Traffic Code of the Municipality of Naguilian, La Union and Amending for
the Purpose all Ordinances Inconsistent Thereto
b. Municipal Ordinance No. 76 Series of 2016, also known as the Ordinance
Requiring Owners of Motorized Vehicles to Provide their own Parking
Space within their Premises and Providing Penalties for Violation Thereof
c. Municipal Ordinance No. 93 Series of 2016, also known as the Ordinance
Amending Ordinance No. 70 Series of 2015
d. Municipal Ordinance No. 110 Series of 2016, otherwise known as the

6. Monitor the compliance of all barangays through their Barangay Captains.

7. Submit weekly update report to DILG Provincial Office for subsequent

submission to DILG Regional, Central Offices and to the Office of the
President.

SECTION 3. EFFECTIVITY. This Order shall take effect immediately.
