17 Plaintiff FNA Group, Inc. (“FNA Group”), by and through its attorneys, for its Complaint

18 against defendant Karcher North America, Inc. (“Karcher”) alleges as follows:

19 NATURE OF THE ACTION

20 1. This is a civil action for patent infringement, injunctive relief, and damages

21 arising under the patent laws of the United States, 35 U.S.C. §§ 1, et seq., including § 271.

22 PARTIES

23 2. FNA Group is an Illinois corporation with its principal place of business located

24 at 7152 99th Street, Pleasant Prairie, Wisconsin.

25 3. Upon information and belief, Karcher is a Delaware corporation with its principal

26 place of business located at 4555 Airport Way, Denver, Colorado.

1 4. Upon information and belief, Karcher has operated and currently operates a
2 facility at 4275 NW Pacific Rim Blvd., Camas, Washington.

4 5. On or about February 18, 2014, United States Patent No. D699,762 S (“the’762
5 patent”) entitled “Pump” was duly and legally issued by the United States Patent and Trademark

6 Office.

7 6. A true and accurate copy of the ’762 patent is attached hereto as Exhibit A.
8 7. The ’762 patent is valid and subsisting and claims a non-functional ornamental
9 design for a pump.

10 8. FNA Group is the owner by assignment of all right, title, and interest in and to the
11 ’762 patent.

12 JURISDICTION AND VENUE


13 9. This Court has exclusive subject matter jurisdiction over this case for patent
14 infringement under 28 U.S.C. §§ 1331 (federal question) and 1338 (any Act of Congress relating

15 to patents or trademarks).

16 10. Karcher is subject to personal jurisdiction in this District.


17 11. On information and belief, Karcher has conducted and does conduct substantial
18 business within the State of Washington including in this forum, directly and/or indirectly

19 through its intermediaries including distributors, retailers, and others.

20 12. Karcher’s substantial business includes, but is not limited to, regularly doing or
21 soliciting business, engaging in other persistent courses of conduct, or deriving substantial

22 revenue from goods and services provided to individuals in Washington and in this District.

23 13. Additionally, upon information and belief, Karcher has operated and currently
24 operates a facility in Camas, Washington, which is within this District.

25 14. Karcher also provides its full range of products and services to residents in this
26 District.

1 15. Thus, Karcher is subject to this Court’s specific and general personal jurisdiction
2 pursuant to due process and the Washington Long-Arm Statute.

3 16. Karcher is actively registered to do business in Washington.


4 17. Karcher has had and, on information and belief, still has a regular and established
5 place of business in this District and has committed acts of infringement in this district.

6 18. Venue is proper in this District pursuant to 28 U.S.C. § 1391 and 28 U.S.C.
7 § 1400(b) for at least the reasons noted above.

8 FACTUAL BACKGROUND
9 19. FNA Group is a manufacturing company that supplies electric and gas pressure
10 washers, pumps, hoses, and replacement parts to private consumers and industrial consumers

11 around the world.

12 20. FNA Group sells to homeowners, contractors, and industrial customers through
13 retailers and directly via the internet under its own brands and private-label brands.

14 21. Specifically with regard to this lawsuit, FNA Group offers many types of pumps
15 for use on both consumer and commercial pressure watchers.

16 22. FNA Group differentiates itself by creating a positive price-to-value power


17 equipment offer. FNA Group does this through product enhancement features, customization of

18 physical designs, and understanding not only what FNA Group’s partners and customers want,

19 but what they will want in the future.

20 23. Because of this, FNA Group believes that it succeeds when it maintains an
21 innovative stance in the industry. This innovative stance in the industry necessarily requires FNA

22 Group to protect its intellectual property.

23 24. On information and belief, Karcher is a company that, among other things, sells
24 and distributes both electric and gas pressure washers.

1 Karcher’s Infringing Conduct


2 25. On information and belief, Karcher has sourced pressure washer pumps from
3 Jiangsu Longteng-Pengda Electric Mechanical Co., Ltd. (“LT”), which infringe on FNA Group’s

4 ’762 patent.

5 26. On information and belief, Karcher imported into the United States, in late 2017
6 and early 2018, cargo containers with pumps manufactured by LT.

7 27. In early 2018, FNA Group contacted Karcher to raise FNA Group’s concerns
8 regarding Karcher’s relationship with LT and potential violations of FNA Group’s intellectual

9 property.

10 28. FNA Group and Karcher continued discussions related to Karcher’s infringing
11 activities during the spring of 2018.

12 29. In April 2018, Karcher provided to FNA Group a sample of the pumps Karcher
13 sourced from LT.

14 30. In May 2018, FNA Group attended the National Hardware Show where FNA
15 Group noticed that at least two of Karcher’s displayed pressure washers included the pumps that

16 infringed FNA Group’s ’762 patent.

17 31. At the National Hardware Show, representatives of FNA Group spoke directly
18 with the representatives of Karcher regarding FNA Group’s concerns.

19 32. Shortly after the show, Karcher contacted FNA Group’s Chief Executive Officer
20 directly and confirmed that Karcher would sever relations with LT.

21 33. In response, FNA Group sought information about the number of infringing
22 pumps and the markets that Karcher intended to sell those pumps in. To date, Karcher never

23 responded with the requested information.

24 34. Around this same time, FNA Group filed a lawsuit against LT for among other
25 things breach of contract and misappropriation of FNA’s trade secrets.

3 35. FNA Group incorporates and restates paragraphs 1 through 34 as though fully set
4 forth herein.

5 36. FNA Group is informed and believes, and thereon alleges, that Karcher has
6 infringed the ’762 patent in violation of 35 U.S.C. § 271(a) by, among other things, importing

7 and offering to sell within the United States, without license or authority, products—including

8 pumps—that infringe the ornamental design claimed in the ’762 patent.

9 37. Based on the information presently available to it, FNA Group alleges that the
10 accused products include, but are not necessarily limited to, the pumps Karcher imported from

11 LT.

12 38. For example, Karcher’s pumps infringe the ’762 patent inasmuch as they have an
13 overall visual appearance that, to an ordinary observer conversant in the prior art, is substantially

14 the same overall visual appearance of the design claimed in the ’762 patent. (See Fig. 1.)

15 39. FNA Group anticipates that discovery will further confirm the full scope of
16 infringing products that are made, used, offered for sale, or sold, within the United States, or

17 imported into the United States, by or on behalf of Karcher.

18 40. FNA Group makes the preliminary identification of the accused products without
19 the benefit of discovery in this action, and expressly reserves the right to augment, supplement,

20 and revise its identifications based on additional information obtained through discovery or

21 otherwise.

22 41. Karcher has had knowledge of the ’762 patent since at least March 2018.
23 42. Karcher has engaged in willful, deliberate, and objectively reckless infringement
24 of the ’762 patent.

25 43. Such willful, deliberate, and objectively reckless infringement justifies an


26 increase of three times the damages to be assessed pursuant to 35 U.S.C. § 284 and further

1 qualifies this action as an exceptional case supporting an award of reasonable attorneys’ fees

2 pursuant to 35 U.S.C. § 285.

3 44. FNA Group has suffered and would continue to suffer irreparable injury if
4 Karcher continued to infringe FNA Group’s ’762 patent. FNA Group has no adequate remedy at

5 law, until this Court enters an injunction prohibiting further infringement and, specifically,

6 enjoining further importation, manufacture, use, offer for sale and/or sale of products within the

7 scope of the design claimed in the ’762 patent.

8 45. Karcher’s infringement has injured FNA Group and FNA Group is entitled to
9 recover damages adequate to compensate it for such infringement, but in no event less than a

10 reasonable royalty, as permitted under 35 U.S.C. § 284, as well as Karcher’s profits pursuant to

11 35 U.S.C. § 289.

12 PRAYER FOR RELIEF


13 WHEREFORE, FNA Group prays for a judgment against Karcher as follows:
14 a) An entry of judgment that Karcher has infringed the ’762 patent;
15 b) An entry of judgment that Karcher’s infringement of the ’762 patent was willful;
16 c) An order enjoining, preliminarily and permanently, Karcher, its officers, agents,
17 servants, employees, attorneys, and all other persons in active concert or participation with

18 Karcher from further infringing the ’762 patent;

19 d) A post-judgment equitable accounting of damages for the period of infringement


20 of the ’762 patent following the period of damages established by FNA Group at trial;

21 e) If a permanent injunction is not granted for Karcher’s infringement of the ’762


22 patent, a judicial determination of the conditions of future infringement such as a royalty bearing

23 compulsory license or other such relief as the Court deems appropriate;

24 f) A trebling of any damages award pursuant to 35 U.S.C. § 284;


25 g) A finding that this case is exceptional pursuant to 35 U.S.C. § 285;
