20 1. This is a civil action for patent infringement, injunctive relief, and damages
21 arising under the patent laws of the United States, 35 U.S.C. §§ 1, et seq., including § 271.

23 2. FNA Group is an Illinois corporation with its principal place of business located

2 pursuant to due process and the Washington Long-Arm Statute.
6 18. Venue is proper in this District pursuant to 28 U.S.C. § 1391 and 28 U.S.C.
7 § 1400(b) for at least the reasons noted above.
8 FACTUAL BACKGROUND
9 19. FNA Group is a manufacturing company that supplies electric and gas pressure
10 washers, pumps, hoses, and replacement parts to private consumers and industrial consumers
12 20. FNA Group sells to homeowners, contractors, and industrial customers through
13 retailers and directly via the internet under its own brands and private-label brands.
14 21. Specifically with regard to this lawsuit, FNA Group offers many types of pumps
15 for use on both consumer and commercial pressure watchers.

5 26. On information and belief, Karcher imported into the United States, in late 2017
6 and early 2018, cargo containers with pumps manufactured by LT.
7 27. In early 2018, FNA Group contacted Karcher to raise FNA Group’s concerns
8 regarding Karcher’s relationship with LT and potential violations of FNA Group’s intellectual
9 property.
10 28. FNA Group and Karcher continued discussions related to Karcher’s infringing
11 activities during the spring of 2018.
12 29. In April 2018, Karcher provided to FNA Group a sample of the pumps Karcher
13 sourced from LT.
14 30. In May 2018, FNA Group attended the National Hardware Show where FNA
15 Group noticed that at least two of Karcher’s displayed pressure washers included the pumps that
17 31. At the National Hardware Show, representatives of FNA Group spoke directly
18 with the representatives of Karcher regarding FNA Group’s concerns.
19 32. Shortly after the show, Karcher contacted FNA Group’s Chief Executive Officer
20 directly and confirmed that Karcher would sever relations with LT.
21 33. In response, FNA Group sought information about the number of infringing
22 pumps and the markets that Karcher intended to sell those pumps in. To date, Karcher never

3 35. FNA Group incorporates and restates paragraphs 1 through 34 as though fully set
4 forth herein.
5 36. FNA Group is informed and believes, and thereon alleges, that Karcher has
6 infringed the ’762 patent in violation of 35 U.S.C. § 271(a) by, among other things, importing
7 and offering to sell within the United States, without license or authority, products—including
9 37. Based on the information presently available to it, FNA Group alleges that the
10 accused products include, but are not necessarily limited to, the pumps Karcher imported from
11 LT.
12 38. For example, Karcher’s pumps infringe the ’762 patent inasmuch as they have an
13 overall visual appearance that, to an ordinary observer conversant in the prior art, is substantially
14 the same overall visual appearance of the design claimed in the ’762 patent. (See Fig. 1.)

15 39. FNA Group anticipates that discovery will further confirm the full scope of
16 infringing products that are made, used, offered for sale, or sold, within the United States, or
18 40. FNA Group makes the preliminary identification of the accused products without
19 the benefit of discovery in this action, and expressly reserves the right to augment, supplement,
20 and revise its identifications based on additional information obtained through discovery or
21 otherwise.
22 41. Karcher has had knowledge of the ’762 patent since at least March 2018.
23 42. Karcher has engaged in willful, deliberate, and objectively reckless infringement
24 of the ’762 patent.

3 44. FNA Group has suffered and would continue to suffer irreparable injury if
4 Karcher continued to infringe FNA Group’s ’762 patent. FNA Group has no adequate remedy at
5 law, until this Court enters an injunction prohibiting further infringement and, specifically,
6 enjoining further importation, manufacture, use, offer for sale and/or sale of products within the
8 45. Karcher’s infringement has injured FNA Group and FNA Group is entitled to
9 recover damages adequate to compensate it for such infringement, but in no event less than a
10 reasonable royalty, as permitted under 35 U.S.C. § 284, as well as Karcher’s profits pursuant to
