KNOW ALL MEN BY THESE PRESENTS:

This Service Agreement, made and entered into in Bonifacio Global City on
September 24, 2019 by and between:

Paolo Ramon Sison Tambunting, of legal age and with postal and residential address
at Capri Condominium, Bldng. 15, Units 3C/3D, Km, 21, West Service Road Cupang,
Alabang, Muntinlupa City and hereinafter referred to as ARCHTECT.

Mr. Ezra Sumbillo, of legal age and with address at ______________________________________

ARTICLE I: SCOPE OF WORK

1.) SITE ANALYSIS

a.) The ARCHITECT shall visit the site prior to conceptualizing the design for
this project to understand parameters and constraints the site has to offer.

2.) CONCEPTUAL PHASE (1-2 weeks approx.)

a.) The ARCHITECT shall create a 3D computerized model which reflects the
existing site with ideas that shall help deliver his idea and direction in a
clearer manner to the CLIENT.

b.) The ARCHITECT shall sketch a rough floor plan to show the flow of the
space and the CLIENT shall approve of these drawings.

b.) The ARCHITECT and the CLIENT shall then meet to discuss the designs via
3d model and shall either render markups to the design direction or approve
of the design. Once the CLIENT approves of the design and direction, the
project then concludes with the Conceptual phase effectively and moves on
to the next phase immediately.

3.) SCHEMATIC PHASE (1-2 weeks approx.)

a.) The ARCHITECT shall prepare simple line plans, sections, and elevations
of the site with the design content.

b.) The ARCHITECT will organize drawings and board them in a simple but
understandable manner for the CLIENT’s viewing and approval in PDF form
or in printed form.

c.) The CLIENT may render his comments and the ARCHITECT shall reflect
changes made to the plan. Once both parties agree with direction, the project
then concludes with the Schematic phase effectively and moves on to the
next phase immediately.

4.) DESIGN DEVELOPMENT PHASE (4-5 weeks approx.)

a.) The ARCHITECT formulates all architectural documentation in


preparation for the submittal of plans to the administration of the building,
and for the building permit that shall be issued by the office of the Building
Official. Architectural documentation includes:

1.) Floorplans – furniture, reflected ceiling plan, power and auxiliary,


lighting layout, wall partition, plumbing, and mechanical.

2. Elevations – all walls that require special treatment and finishes.

3.) Sections – any area wherein special construction is needed and


where a study of human scale ratio in relation to the space is needed.

4.) Details – joinery (cabinetry, counters, and the like) drawings to aid
the contractor on how the ARCHTIECT see fit to build. Special walls
fall under this category as well as construction connections.

5.) Door and Window schedule – This drawing shows the detailed
information regarding all types of doors and windows for the
reference of the contractor and window supplier for fitting out.

6.) Material schedule – this is a document which provides


specifications about materials used and their locations within the
project.

b.) Once all these plans are agreed upon by the ARCHITECT and the CLIENT,
that effectively concludes the design development phase.

c.) The plans shall then be submitted to the administration for approval. If
the administration renders and comments on the design, the ARCHTIECT
shall make necessary changes and have the CLIENT approve the plans before
submitting to the building administration once more.

c.) Once the building administration approves of the plans, the plans may
then be submitted to the office of the building official for the application of
the building permit. The project then waits for the approval from the building
official and once approval is given, the project then commences with the
construction phase.

5.) CONSTRUCTION PHASE

a.) The ARCHITECT shall recommend reputable and qualified suppliers and
contractors. Once the client and the building administration approve the
drawings, the client may then select and commission the
contractor/suppliers from the list proposed by the ARCHITECT. The client
may also select any party of their choice.

b.) This is the part of the project where the designated contractor carries out
the design and plans made by the ARCHITECT. The ARCHITECT shall ensure
that the construction adheres to his standards and plans that he drew up;
hence, the ARCHITECT shall visit the site at least once a week to check on
progress and update the CLIENT if there is any problem with construction
and for general updates.

c.) The ARCHITECT is not the official project manager for construction
(unless specified otherwise which renders a new and separate service
agreement) and therefore is not liable for any damage or loss to the property
of the client nor is the ARCHITECT liable for any delays in construction and
other delays arising out of failure to deliver within the deadlines set forth in
the contracts with suppliers and contractors. However, the ARCHITECT shall
coordinate with said parties to ensure that workmanship and quality are
executed in accordance to their commitments and contracts with the client.
The ARCHTECTS shall meet and coordinate with said suppliers and
contractors on a weekly basis to ensure that all deliveries and installations
are complete and those deadlines are met. The designated project manager
shall be provided separately and supervised by the commissioned contractor.

c.) The construction phase shall begin once all drawings and parties are
approved. If for any reason construction needs to be put on hold by the client
and or the commissioned contractor, the construction phase may be paused

for a maximum period of ninety (90) days. After which, the client is obligated
to pay a re-mobilization fee of 15% of the total design fee. Otherwise, the
contract is deemed terminated, unless previously agreed upon in writing.
Payments previously made by the client are non-refundable.

ARTICLE II: ARCHITECTURAL DRAWINGS AND DOCUMENTATION

a.) The client shall be given 1 revision free charge for each drawing, per
phase. Any additional revisions and requirements shall be subject to an
additional charge of 1,500.00 php for each drawing.

b.) Laws and Regulations – “Drawings and Specifications duly signed,


stamped, or sealed, as instruments of service, are the intellectual properties
and documents of the architect, whether the object for which they are made
is executed or not. It shall be unlawful for any person, without the consent of
the architect or author of said documents to duplicate or to make copies of
said documents for use in the repetition of and for other projects or buildings,
whether executed partly or in whole.” {R.A. 9266 The Architecture Act of
2004; Article III, Section 20, (4)}

c.) a set of architectural documents and drawings of the blueprints shall be


turned over to the CLIENT, while another set shall be kept with the
ARCHITECT. All other drawing sets shall be submitted to the contractor,
building administration, and office of the building official

ARTICLE III: ARCHITECT’S RESPONSIBILITIES

a.) The ARCHITECT shall set weekly meetings with the CLIENT to show
progress and design updates on the project. If both parties cannot agree on a
set date for the week, the ARCHITECT may send these updates via email to
the CLIENT at the end of each week.

b.) The CLIENT is entitled to a time limit of 2 hours per meeting. If the client
wishes to extend each meeting beyond 2 hours, an additional 1000.00 php
per hour shall be charged to the client. If the client wishes to meet more than
once a week, the client shall be charged an additional 3,000.00 php per
meeting (3 hours maximum). This schedule spans the timeline of this
contract.

c.) The ARCHITECT shall provide a logbook containing a record of days and
hours of all meetings with the CLIENT. The CLIENT shall sign at the end of
every meeting. This shall also serve as a record of the minutes of each
meeting. The DC shall email the client a copy of this weekly report. The client
must acknowledge receipt of weekly minutes via email.

d.) The ARCHITECT shall carry out the submittal and application of the plans
issued to the building administration and the office of the building official.

e.) The ARCHITECT shall supervise construction at least 1 a week to ensure


that the quality of construction is met with the standards set forth.

f.) If there are any faults during the construction, the ARCHITECT shall
document such faults and send them to the CLIENT for his reference.

g.) The ARCHITECT shall provide a statement of projected construction cost


and submit to the CLIENT for his approval.

ARTICLE IV: CLIENT’S RESPONSIBILITIES

a.) Cost of printing and blueprinting – The client shall be responsible for all
costs of printing and blueprinting of the architectural drawings. The
ARCHITECT shall bill the client accordingly for all required and requested
hard copies set forth. Printing of all drawings are outsourced as these
drawings require special printing equipment. The ARCHITECT shall provide
the official receipt for all copies made.

b.) The CLIENT and the ARCHITECT shall agree on a design program, which
shall set forth the ARCHITECT’S design objectives, constraints, and criteria
including a budget for the entire project. This must be ideally completed
within the first 4 meetings to ensure proper flow & time management.

c.) If the CLIENT observes or otherwise becomes aware of any fault or defect
in the project or non-conformance with the construction, prompt notice
thereof shall be given by the client to the ARCHITECT in writing so that the
ARCHITECT may assist in coordinating with suppliers and or contractors in
order to rectify any errors.

d.) The CLIENT shall arrange and pay for such fees required for obtaining
approval from the government and building administration authorities
having jurisdiction over the project and for owner supplied items.

e.) If the CLIENT or building administration requires additional drawings,


computations, signature or endorsement of engineering consultant/s for

mechanical, electrical, plumbing and or structural aspects of the project, the


client shall directly employ or commission such allied professional/s in
coordination with the ARCHITECT.

f.) If the CLIENT wishes the ARCHITECT to perform additional services, the
client shall notify the ARCHITECT in order that a separate service agreement
for additional services may be agreed upon.

ARTICLE V: ADDITIONAL AGREEMENTS

a.) This contract may be terminated by either party by giving the other party a
month’s notice of termination in writing. All work performed by the ARCHITECT
shall be considered as accepted and all payments to the ARCHTECT shall be
considered paid after the submission of all architectural drawings and for every
phase already completed.

ARTICLE VI: PROFESSIONAL FEE – The ARCHITECT shall remind the CLIENT on
when to turnover payment for such services before the two parties meet. The
CLIENT may pay via check, cash, or bank deposit with an account provided by the
ARCHTIECT. The payment scheme is as follows:

1.) 40% - 60,000php - upon signing of this contract

2.) 15% - 22,500php – completion of conceptual phase

3.) 10% - 15,000php – completion of schematic phase

4.) 15% - 22,500php – completion of design development phase

5.) 15% - 22,500php – commencement of construction phase

6.) 5% - 7,500php – final turnover
