Instructions: This assignment consists of two (2) pages. Distribute the estate according
to the rules on legitime and disinheritance taking into consideration the pertinent
provisions of the Civil Code. Cite the legal basis for your answers. An answer which is
not accompanied by the corresponding computation and explanation shall not be given
any credit. Place the answers in your quiz notebook. Submit your assignment on Friday
25 October 2019 on or before 5:30 pm at the Dean’s Office c/o Riza.

I.
(25%)

The testator’s estate is Php 23Million with debts amounting to Php 3Million.
The testator is survived by the following relatives: (1) his spouse Claudine and their five
legitimate children Raymond, Raymart, Rayven, Rayban, and Raydine; (2) two
illegitimate children Julia and Gretchen.

During his lifetime, the testator also made the following dispositions in his validly
executed last will and testament, thus:

1. I hereby disinherit Rayban for attempting to kill me with poison last March
17, 2001.
2. I give Sonia and her four children a legacy of Php 1Million.
3. I give Julia Php 1Million provided she does not get married to Gerald;
otherwise her share will go to Bea. [Julia subsequently married Gerald
against the testator’s wishes]
4. I give the rest of the estate to Raymond, Raymart, Rayven, Raydine and
Gretchen.

Distribute the estate.

II.

The testator’s estate is Php 15Million with debts amounting to Php 3.5Million.
The testator is survived by: Spouse Raquel and three legitimate children Maria, Marian
and Mary Ann; two illegitimate children Daniel and Daniela.

The testator left a will with the following provisions:

1. I leave a devise of a land worth Php 1.5Million to Carlo.
2. I institute my wife Raquel and our children Maria, Marian and Mary Ann to my
entire estate.

Distribute the estate.

III.

The testator’s estate is Php 15Million with debts amounting to Php 3Million.
The testator is survived by: (1) Chloe and three legitimate children Aurora, Ariel and
Elsa; (2) illegitimate children Olaf, Sebastian, Ursula and Boo.

The testator left a will where he stated the following:

1. I disinherit my wife Chloe for cheating on me with another man. [The claims of
the testator were not true because Chloe actually did not cheat on the testator.]
2. I disinherit Aurora.

Distribute the estate.

 IV.

The testator’s estate is Php 10Million with debts amounting to Php 3Million.
The testator is survived by: spouse Frank, legitimate child Bernard and illegitimate child
Arnold.

In 2015, the testator executed a donation inter-vivos over a parcel of land worth
Php3Million in favor of Arnold.
In 2016, the testator executed a will naming Frank, Bernard and Arnold as the universal
heirs to her estate.

Distribute the estate.

I.

The decedent died in 2009 with an estate worth Php 17,000,000.00 with debts
amounting to Php 3,000,000.00. He has no compulsory heirs.

During his lifetime the decedent made the following transfers of real property:
1. In 1987, a donation inter vivos of a real property worth Php 2,000,000.00 to
Michael;
2. In 1992, a donation inter vivos of a real property worth Php 1,000,000.00 to
Roy;
3. In 2000, a donation inter vivos of a real property worth Php 2,000,000.00 to
McKenzie.

The decedent also left a will providing for the following testamentary dispositions:
1. I institute my half brothers Mark, Lloyd and Paul together with my half sisters
Sharon, Cassandra, Bryce and Angelique to ½ of my entire estate;
2. I institute Heidi to ¼ of my estate, with Julliane and Janelle as her substitutes;
 3. I institute Magda to the remainder of the estate if she agrees to become my
brother Mark’s mistress.

Heidi repudiated her inheritance while Julliane predeceased the decedent.

Distribute the estate.

II.

The decedent died in 2000 with an estate worth Php 6,000,000.00 leaving debts
amounting to Php 1,500,000.00. He is survived by (1) spouse Sandra; and (2) legitimate
children Kevin, Bob and Stuart.

The decedent left a will providing for the following provisions:

1. I give a legacy of an IWC watch worth Php 350,000.00 to Sara;
2. I give a legacy of Php 150,000.00 cash to Becca; and
3. I institute my spouse, Bob and Stuart as my universal heirs to my entire estate.

Distribute the estate.

III.
(10%)

The decedent died on 2015 with an estate worth Php 8,000,000.00, leaving debts
amounting to Php 4,000,000.00. He left a valid holographic will which he subsequently
revoked through another holographic will. He is survived by the following relatives: (1)
wife Esme; (2) full blooded brothers Emett and Taylor; (3) half sister Alice. Distribute
the estate.
