CHAPTER 3: ANNULMENT OF MARRIAGE (ARTICLE 45-GROUNDS FOR ANNULMENT)

LAWS OF MARITAL STATUS INCLUDES DONATIONS BY REASONS OF MARRIAGE, LEGAL SEPARATION,


ADOPTION, CHILD SUPPORT, PROPERTY DIVISION AND MAINTENANCE, SPOUSAL SUPPORT

PENDENTE LITE: “WHILE LITIGATION IS PENDING” (LEGAL ACTION). FOR EXAMPLE, PENDENTE LITE IS
USED TO DESCRIBE COURT ORDERS THAT ARE PUT INTO EFFECT WHILE LITIGATION IS STILL PENDING, IN
ORDER TO FACILITATE FAIR ADMINISTRATION OF JUSTICE.

COMMONLY ISSUED IN ANNULMENT TO PROVIDE TEMPORARY SUPPORT TO THE SPOUSE WHO MAKES

 Basic personal exemption- for married indiviual (18,000)


 A married individual or a head of family shall be allowed an additional exemption of 5,000 with
dependents
 Married individuals- greater amount of exemption

2. Sick Leave – shall be used in case of your or your dependent’s illness


3. Maternity – it shall be granted to female employees in instance of pregnancy
4. Paternity – every married male employee when his legitimate spouse has delivered a child or
suffered miscarriage

a. Isn’t it that same sex couples until now are still not able to take their relationship to a legally
recogniseed degree?
b. Isn’t it that it is the responibility of the state to give equal rights to every filipinos including
same-sex couples?
c. Isnt it that, this bill shall be passed for these same sex couples to obtain the benefits given when
they are recognized legally?
d. Isn’t it that marriage as defined in the family code is only confined to the man and a woman?
e. Isn’t it that the same sex couples are denied by their constitutional rights of life and liberty and
the equal protection of the law?
f. Isn’t it that it is a just to pass this bill in order to recognize the rights of these couples?
