SECRETARY HILARIO: Ladies and gentlemen, the 84 TH Regular Session of the Honorable
Sangguniang Panlungsod with the Honorable Jimmy L. Carbonell as Presiding Officer is
about to commence. Everybody is requested to please rise.

HON. TEMP. PRES. OFFICER CARBONELL: The 84 TH Regular Session of the 15th Sangguniang
Panlungsod is now called to order. May I request the City Choir for the Doxology and then
followed by the Honorable Peter Q. Maristela for the opening prayer.

(Note: At 9:55 in the morning, the 84TH Regular Session of the 15th Sangguniang
Panlungsod was called to order by the Honorable Jimmy L. Carbonell, Presiding Officer.
After the prayer which was led by the Honorable Peter Q. Maristela the singing of the
Philippine National Anthem followed which was led by the Puerto Princesa City Choir. The
recitation of the Pledge of Allegiance to the Filipino Flag was led by the Honorable Nesario
G. Awat in lieu of the Honorable Rolando T. Amurao while the recitation of the Philippine
Councilor’s League Creed was led by the Honorable Henry A. Gadiano. The singing of the
Puerto Princesa March and a Cuyono song followed, which were led by the Puerto Princesa
City Choir.)

HON. TEMP. PRES. OFFICER CARBONELL: Matamang salamat sa ateng City Choir sandang
dorong ca ligong canta, cancion na Cuyonon. I would like to greet the members of this
August Body, good morning. Sa ating mga miyembro ng media, magandang umaga po sa
inyong lahat. Ganon din po sa ating mga bisita pa, iba pang mga panauhin na narito sa
gallery. Sa ating mga staff, secretariat, headed by the Honorable Attorney PJ Hilario, good
morning. Our secretary please, for the roll call of the members.

that we have nine (9) members, we have a quorum, and we can now proceed with our session
for today. And, at this juncture, may I request the Honorable Modesto V. Rodriguez II, our
Majority Floor Leader.

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Thank you, Mr. Presiding Officer, good
morning. Mr. Presiding Officer, we are now under the Reading and Consideration. And I
move for the approval of the Journal of Proceedings of the 82nd Regular Session held last
February 26, 2018.

HON. TEMP. PRES. OFFICER CARBONELL: Before the motion, may I acknowledge the
Honorable Oliveros.

HON. OLIVEROS: Thank you very much, Mr. Presiding, good morning. Thank you very much, Mr.
Floor Leader. Mr. Presiding, I would just like to express my gratitude and thank to the
secretariat through the leadership of our Secretary Attorney Philip Jerome Hilario for our seal.
You will notice that they have changed.

HON. OLIVEROS: Yes, Mr. Presiding, and for so long time already Mr. Presiding, and I’d like to
applaud that.

HON. TEMP. PRES. OFFICER CARBONELL: Thank you very much, our Secretary, Attorney PJ
Hilario, thank you very much. So, there is now a motion for the approval of the Journal of
Proceedings of the 82nd Regular Session held on February 26, 2018, for approval. Any

HON. MAJORITY FLOOR LEADER RODRIGUEZ: And for the Journal of Proceedings of the 83 rd
Regular Session held last March 5, 2018, I move that this be reviewed by the members of the
Council.

the 83rd Regular Session held on March 5 be referred to the Honorable Members of this

proceed to the Privilege Hour, our colleague, Acting Vice Mayor, Nancy M. Socrates would
like to be recognized and she is going to make an announcement.

HON. SOCRATES: Thank you, Mr. Presiding Officer, and Mr. Floor Leader, good morning
everyone. I just wish to extend my invitation for tomorrow’s mass blood donation. Ito po ay
isang blood - letting activity na gaganapin po sa Robinson’s Place Palawan. It starts at eleven
(11:00) in the morning and all the way until six (6:00) pm or seven (7:00) pm. So, sana po ay
mag-donate po tayong lahat ng dugo. And special attention po sa ating media friends, sana po
ay matulungan nyo kaming ipagkalat po ito, at alam po nating lahat ang kakulangan po sa
dugo sa ating Lungsod. So, hinihikayat ko po kayong lahat na magbigay po ng inyong dugo
bukas. Maraming salamat po. Robinson’s Place Palawan, ten (10:00) am to six (6:00) pm,
mass blood donation. Thank you very much.

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Thank you Mr. Presiding Officer. For the
Privilege Hour, our colleague, Honorable Matthew K. Mendoza is going to deliver a
privilege speech. This pertains to the support of the City Government’s thrust to fast track
building ICT Infrastructure, including expansion of fiber network across many parts of the
Province of Palawan and the City Government of Puerto Princesa. Mr. Presiding Officer, I
move that we recognize the gentleman from Barangay San Pedro, Honorable Matthew K.
Mendoza.

HON. TEMP. PRES. OFFICER CARBONELL: The Honorable Matthew K Mendoza is now
recognized for his privilege speech.

HON. MENDOZA: Good morning. Maraming salamat, Mr. Floor Leader, sa atin pong mga
kasamang Konsehal, good morning. I go straight to the point. Last week po, nakatanggap po
ako ng tawag from our First District Congressman Chicoy Alvarez regarding po sa proposal
or tulong, support na hinihingi ng Globe Telecom. Early this morning we were at the Mayor’s
Office and partially po na-discuss po natin yong hinihiling nila sa atin. This pertains to …
yong improvement nila ng kanilang mga telecommunications, yong mga plans nila for
telecommunications in Puerto Princesa. Sa lahat po ng na-discuss, may isang bagay po na
doon po nakuha ang aking attention. Iyong pagpapatayo po nila ng mga bagong mga cell sites
na matagal na po nating niri-request sa mga telecoms na lagyan yong ating western barangays
o yong west coast. At isa po sa mga plano nila, i-include po yon, kasama po sa
pagpapatayuan nila ang Barangay Napsan, Bagong Bayan, Simpocan at syempre po matagal
na matagal na po nating niri-request ang ating growing tourist destination dito yong
Nagtabon. So, Mr. Chair, inimbita po natin sila para mag-present ng kaunti. I believe, they

agreed to present it within fifteen (15) minutes, para po hindi po maano yong time natin.
Babaguhin ko lang po yong sinabi ni Floor Leader, na privilege minute lang po, hindi
Privilege Hour. So, Mr. Chair, Mr. Secretary can we invite the …if it’s okay with our
colleagues that we invite… Ito po ay malaking tulong para sa ating mga kabarangay lalong-
lalo na po sa west coast area at sa lahat ng mga taga Puerto Princesa. So, Mr. Secretary, can
we invite our guest inside?

MR. CORDIA: Magandang umaga po sa inyong lahat, Honorable Councilor and Mr. Presiding
Officer. Ako po si Rob Cordia from Globe Telecom. Kami po ang … ang grupo po namin
ang in-charge sa site acquisition at kami po ang nag-a-acquire po ng mga sites for… yong
mga nabanggit po ni Councilor Matt na mga bagong tore or cell sites. At kami rin po yong in-
charge na mag-acquire ng mga lupa o mga posteng dinadaanan po ng mga fiber or ng mga
copper na internet to the home po. At kami po ay nagpapasalamat na binigyan nyo po kmi ng
tsansa na makapag-share po ng aming mga plano. Dahil po sa mga planong ito po ay tulong
din po ninyo ang kailangan po namin para ma-implement po namin ito. Gaya uli rin po ang
nabanggit ni Councilor Matt, matagal na pong niri-request ng Puerto Princesa na ma-i-
improve po ng mga telecoms ang signal or pati po ang LTE or internet data ng mga cellphone
natin. Kaya kami rin nandito o isa po sa pinakaimportanteng bagay na idi-discuss namin po is
ang improvement po or ang pagpapatayo namin ng mga bagong tore. Payagan nyo po kami
na i-share po sa inyo ang listahan ng eighteen (18) na bagong cell sites, ulit po eighteen (18)
na bagong cell sites na itatayo po namin sa loob ng Puerto Princesa. Nasa screen po ngayon
ang listahan. Ang unang fifteen (15) kasama po dito ang Barangay Bagong Bayan, Barangay
Simpocan, Nagtabon Beach, at dito rin po sa may City Hall, maglalagay po tayo sa area po ng
City Hall. Sa WESCOM, Barangay San Miguel, Barangay Bancao-Bancao, Barangay Bagong
Sikat, Barangay San Manuel, Barangay Napsan, PSU Sta. Monica, WPU, Barangay Sicsican,
Barangay San Jose, Barangay San Pedro, Barangay San Rafael at Barangay San Jose.
Makikita nyo po doon sa column ng status, ang sitwasyon ng bawat isang cell site at
karamihan po dito ay naghahanap pa po kami ng mga areas kung saan po namin ilalagay o ng
lugar kung saan po mismo ilalagay ang cell site. Ito naman po yong tatlo pa po ang tatayuan
namin which is ang Puerto Princesa Airport at ang PIRN po, dalawa pong site ang ilalagay po
namin diyan. Kami po ay nagpunta rito ngayong araw na ito, para ho humingi ng suporta sa
Council po with regards to… sa aming pag-iimplement at pag- acquire po nitong mga sites
na ito po. I’m sure po that you are all aware of that, all these sites po when we acquire a site
or before we do an implementation of a site, ay dumadaan po kami sa Council po for a
resolution. So, we have discussed this with the Mayor earlier. Last week din po kausap din
po namin si Congressman Alvarez, nong nakaraang Tuesday po. Nong nakaraang Thursday
po ay kausap din po namin si Governor Alvarez, at kanila pong ini-endorso po ito pong mga
sites na ito para ma-improve po ang telecommunications dito sa Palawan especially in Puerto
Princesa. One of the request po or the help that we will need from the Council is for you to
help us fast track or the permitting. Before that po, before I go to the permitting cycle na
mayroon po tayo, medyo malabo lang po doon sa ating projector po, pero yong nasa kaliwa
po natin, ay ang current signal coverage ng Puerto Princesa at yong nasa sa kanan po hindi
malinaw ang pagka-project. Yan po ang makikita nyo ang improvement after nitong eighteen
(18) cell sites na nabanggit ko po kanina. So, makikita nyo po doon sa may west coast area
may mga extra, one (1), two (2), three (3), four (4) sites po yan na naka-rely po diyan para
ma-cover po yan. Nabanggit ko po kanina yong permitting process na ginagawa po namin.
So, bilang Globe Telecom po, pag kami po ay nag a-acquire ng site, pag nag-apply po kami
from barangay level to LGU, marami po kaming dinadaanan na permitting. At isa po ito na
gusto naming ilapit sa inyo, kasi isa po ang Council sa pinaka nagbibigay ng stamp sa lahat ng
permits namin which is ang resolution po na inyong binibigay. So, kagaya po ng nabanggit
ko, with the support and endorsement of the governor, councilor and also the mayor, we
would like to seek your help po for us to be able to come up with a one- time resolution
covering these eighteen (18) sites. So, yon po kung inyo pong ibibigay yong inyong suporta
sa pagtayo po nitong mga cell sites na ito. Bukod po doon, mayroon din po kaming mga

ibang permitting stages na pinagdadaanan na katulad ng FLAG, ng NCIP, para po sa mga
areas na covered po nila, DENR po sa national at ang PAMB po. And isa pa rin po sa
dinadaanan namin is yong PCSD. So, kami po ay lumalapit sa inyong tanggapan upang
makahingi po ng suporta at ng tulong para mapabilis po natin ang pagtayo nito. Kasi po the
usual process po na pinagdadaanan namin ay umaabot po kami ng walong (8) buwan
hanggang isang (1) taon para po maka-acquire ng mga sites na ito at para po makumpleto ang
lahat na permits na ito. And with our experience po, talaga pong napapatagal po yong pagdala
po namin ng magandang experience lalong-lalo na po sa mga cellphone subscribers po natin.
Ang next steps po sa amin pong pino-propose with your help is, kagaya ho ng nabanggit ko,
number one po is, for us to be able to secure… to secure approval to allow a one-time release
of permits or a resolution for all the eighteen (18) sites here in Puerto Princesa. Pangalawa
po, ma-allow din po kami to proceed with an immediate build of the sites with undertaking.
So, kasabay po ng pagproseso natin ng pagkuha ng lahat ng permit na ito at sa tulong ninyo
pong pabilisin ito, niri-request din po namin na magkaroon po kami ng undertaking with the
Council na kasabay na po in parallel na po natin bubuuin yong mga sites para mapabilis po
tayo. At ang pangatlo po is, kagaya po nong mga napakita ko po kanina na mahigit sampu
(10) po doon po sa dyesiotso (18) ay naghahanap pa lang po kami ng mga lugar para doon sa
mga sites na ito, ay baka po mai-refer nyo po kami sa mga friendly lessors or sa mga may-ari
ng mga areas po doon sa mga barangay na nabanggit para po makausap po namin sila, at
makaano po kami makapagtayo po kami ng sites doon sa barangay na yon po. Bale yon lang
po yong tulong na kakailanganin po namin galing sa Council. So, baka po mayroon po
kayong mga katanungan.

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Mr. Chairman.

HON. TEMP. PRES. OFFICER CARBONELL: The Honorable Majority Floor Leader.
HON. MAJORITY FLOOR LEADER RODRIGUEZ: Marami pong salamat, Ginoong
Tagapangulo. Doon po sa mga kinakailangan pong resolution na hinihingi po ng ating
panauhin, palagay ko naman po ay madali namang maibibigay yon. Sapagkat kung
matatandaan po natin Ginoong Tagapangulo, unang termino ko pa lamang po dito, naabutan
ko po si Konsehal Jimmy Carbonell at si Konsehal Henry Gadiano nong panahon pa lang nila
ay paulit-ulit na na nagsasagawa ng mga resolution na humihiling sa Globe na magkaroon ng
cell site sa mga areas na yon, lalong-lalo na po sa Napsan, Simpocan at Bagong Bayan. At
ngayon nga po, ito po’y katuparan na ng matagal ng pinapanaginip ng ating mga kababayan,
sapagkat alam po ninyo sa sitwasyon po ngayon ang komunikasyon po na aming ginagamit
doon sa mga barangay na yon ay yong old school na radio. Just imagine po, kapagka
mayroong emergency tatawag po rito, radio lang po ang ginagamit. Ganon din po pag yong
mga kababayan namin doon ay mayroong kailangan sa amin, kailangan pang i-radio dahil
wala nga pong cellphone. At alam din po natin na marami ng planong development ang
isasagawa sa mga areas na yan. Ngayon doon po sa hinihiling po nila na one-time release of
permit or resolution sa lahat ng sites, siguro po ay magandang pag-usapan po natin yan with
the Legal Officer. Sapagkat ang isa po sa mga requirements para po kami makapagbigay po
ng resolution ay yon pong barangay resolution. Ay kung makikita po natin doon po sa inyong
presentation ay yon pong mga cell sites ay isasagawa ninyo sa mga ibat-ibang mga barangays.
Kung mangyari po sana na magawa po ninyo na sa ngayon pa lang ay makakuha na kayo ng
mga resolution sa ibat-ibang barangay sa ngayon at matanggap naming lahat yon, ay palagay
ko po siguro ay pwede nating magawa yong isang resolution lang para sa lahat ng barangay,
ayon po.

MR. CORDIA: Salamat po, sa inyong advice. Actually, isa po sa mga tulong din po na hihingin
namin is kung kakayanin po ninyo kaming ma-endorso sa mga barangay na naibanggit din po
namin kanina.

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Palagay ko po, siguro pwede rin na sa
pamamagitan po ng City Council ay makapag-reach out din po tayo sa mga barangay
sapagkat kilala rin po natin yon.
MR. CORDIA: Opo.
HON. MAJORITY FLOOR LEADER RODRIGUEZ: Na sana’y mabigyan kayo ng paborableng
endorsement sa proyekto na yon, sapagkat kayo rin po, sila rin po yong ating mga kababayan
ang makikinabang sa proyekto na yan. Salamat po.
HON. TEMP. PRES. OFFICER CARBONELL: Okay. Thank you very much.
MR. CORDIA: Nabanggit din po namin kaninang umaga kay Mayor, ang posibilidad na tingnan po
ang mga pagmamay-ari ng City, baka po may mga lupain po doon kagaya ng eskwelahan,
health center, barangay hall, na maaaring mag-co-locate po ng tore si Globe po. Baka po dito,
mas mapabilis po natin ang proseso, para ma-solve po natin ng mas magandang coverage at
signal ang mga barangay na ating nabanggit.
HON. TEMP. PRES. OFFICER CARBONELL: Thank you very much, the Honorable Majority Floor
Leader. And now may I recognize the Honorable Feliberto rather Victor S. Oliveros.
HON. OLIVEROS: Thank you very much, Mr. Presiding. The way it sounded like junior that was my
best friend, my Dad. Maraming salamat po, una po, sa lahat Ginoong Tagapangulo, nag-
express din po tayo ng pasasalamat, sapagkat tunay po na noong mga panahon n’yo pa at mga
matagalan na panahon na tayong nagre-request sa…, actually po sa iba’t ibang kumpanya, at
dalawa lang naman po sa ngayon yong kumpanya ‘ano po, yong Globe at saka yong Smart, na
makapagpatayo ng cell site at mabigyan nga po ng sebisyo yong mga… yong Napsan, lalo’t
higit ito pong Nagtabon natin, dahil ayon po sa survey ng ating mga nagtatayo ng
establisyemento doon at sa kanilang mga pag-aaral, Napsan daw po…ah, yong, Nagtabon daw
po ay magiging best destination, dahil maganda yong lugar kailangan nga lang po na ang
Pamahalaang Panlungsod natin ay magkaroon ng mga inputs doon, katulad halimbawa ng
mga kakulangan. Ano po ba yon? Yong security, dapat meron tayo at saka yong mga
facilities. At ito nga pong communication yong napaka importante nga raw ito, dahil yong
mga turista alam nyo po ngayon pagpicture, post kaagad, plus of course yong emergency.
Lahat naman po ay inimbitahan natin sabagay dalawa lang naman po yong inimbitahan natin,
at yong huli nga po ay yong resolution nitong abang lingkod na ito, na magtayo ng cell site
doon yong dalawang nasabing kumpanya, kung sino man sa kanila na magko-cover po doon
sa Nagtabon at tsaka Talaudyong. May tanong lang po ako, yong cell site po ba gaano kalaki
po yong radius na nako-cover nya?
MR. CORDIA: Ang isang cell site po roughly, mga nasa less than two (2) to three (3) kilometers po
ang nako-cover po n’yan, pero, depende po sa numero ng mga tao na nakaconnect sa isang
cell site. Dito po sa atin sa Pilipinas, ang average nasa two thousand (2,000) mahigit po ang
naka connect sa isang cell site, which is actually po, yon po ay hindi dapat. Kasi po, napupuno
po yong cell site na yon, kaya po ang nai-experience natin ay kabagalan… (Interrupted)
HON. OLIVEROS: Traffic.
MR. CORDIA: Opo, traffic.
HON. TEMP. PRES. OFFICER CARBONELL: Yes.
MR. CORDIA: Traffic po sa… lalo na po sa paggamit ng internet. So, yon po.
HON. OLIVEROS: Anyway, kung three (3) kilometers.
HON. TEMP. PRES. OFFICER CARBONELL: Radius.
HON. OLIVEROS: Opo. Eh, maganda po ‘no. Ito po ba hindi po issue kung yong isang lugar ay
mababa? Halimbawa Nagtabon, kasi baka doon sa taas natin ilagay. Hindi po ba issue yong

Nagtabon area, yong beach area na nasa baba or nandoon sa mas mataas siya nasa bundok
ganon?
MR. CORDIA: Issue po talaga ang terrain na tinatawag po namin, especially po sa mga areas na
hilly, pataas at pababa. Pero ginagawan po namin ng paraan yan sa aming mga solutions.
Usually po, hinahanapan po namin ng mga equipments po namin yang area na yan para po
nasi-serve. Example po, nasa taas tayo, ang tina-target natin ay medyo nasa baba natin,
hinahanapan lang po namin ng iba’t-ibang klase ng equipment o mga iba’t-ibang klase ng
solution….(interrupted)
HON. OLIVEROS: So, na-a-address naman po, naka-cover?
MR. CORDIA: Opo.
HON. OLIVEROS: Wow! Okay po, ano po? So, Mr. Presiding nandito na po yong development,
may tumugon na po sa atin at yong Globe nga po. So, I move Mr. Presiding, para po mabilis
yong ating magiging action that this be referred to the proper committee, para pag submit po
nila nong mga barangay endorsements, nagmo-move na rin po yong committee na mag-
coordinate sa...
HON. TEMP. PRES. OFFICER CARBONELL: Yes.
HON. OLIVEROS: Kung ano pong kailangang i-coordinate natin dito sa Pamahalaang Panlungsod,
sa mga ahensya natin, pagmeeting po pagtawag eh, yong hinihiling nilang one time, baka nga
po pupuwede. Ano po? At although hindi po ito exclusive sila po yong tumugon una sa ating
kahilingan, eh, nagpapasalamat din po tayo sa Globe. So, Mr. Presiding, I move that this be
referred to the proper committee, Mr. Presiding, for the immediate referral and action after the
deliberation Mr. Presiding.

matagal na po nating hinihintay yan. This is just unconfirmed concern, Mr. Presiding Officer,
meron pong mga balita na ang cell site daw po ay mayrong health hazard, gusto po nating
itanong sa ating bisita kung totoo po yon na kapag ka malapit ka daw po sa cell site eh, yon po
ang may dalang radiation or whatever doon sa mga immediate na vicinity nong cell site.

HON. TEMP. PRES. OFFICER CARBONELL: I am about to mention that likewise, because, I have
heard the proponent from Globe mentioning the area, school sites.

radiation, more particularly to those students within the school site. Yes, our guest.
MR. CORDIA: Maraming salamat po. Sa pag-raise po ng issue na ito. Ito po ay kagaya po ng sinabi
n’yo, karaniwang katanungan po sa amin. Ang isang cell site po ay hindi po… ay gumagamit
po ng tinatawag na, non-ionizing na radio frequency po. Ito po ay katulad lang ng ginagamit
na nating frequency sa ating mga two-way radios at sa mga radyo sa ating mga bahay at sa
mga kotse. Meron din po kaming certification from world health, ito rin po ay tinatatakan ng
ating DOH, Department of Health, na ito po ay wala talagang health hazard, at wala pa pong
patunay at kahit anong ebidensya.

napakalayo ng Barangay Napsan sa Lungsod ng Puerto Princesa at the same time hindi pa
kaagad makakatawag yong ating kapulisan wala doong cellphone, walang signal ang
cellphone para makapag responde yong ating kapulisan doon kung anuman ang mangyari
doon. Kaya ito eh, very welcome development ito, hindi lamang sa ating peace and order
kasama na rin yong ating mga investor. Alam n’yo naman kapag wala yong presence ng
pulisya medyo alanganin yong ating mga investors na mag-invest sa isang lugar. Kaya ako po
ay talagang sumusuporta sa project na ito ng Globe at ngayon pa lamang po ay
nagpapasalamat na tayo sa kanila at palagay ko po, yong ating mga kababayan sa tatlong
barangay na yon, Napsan, Simpocan, Bagong Bayan eh, magpapasalamat po sa inyo kapag
nalagyan n’yo po ng signal doon ng Globe Communication doon sa mga nasabing barangay.

nag-apply din ako, napakabilis, siguro mga one (1) month napakabilis nong internet, ngunit
habang tumatagal bumabalik na rin yata sa normal na napakabagal na. Dito po sa inyo, ano
ang assurance na yong Fiber Optic n’yo ay will actually and definitely, specifically provide
what you are advertising? Yong mabilis at efficient na internet.
MR. CORDIA: Part po ng core po ng Globe is to really give what is due to the service po ng aming
mga kliyente po. So, three (3) years or four (4) years ago po, nag-lay na po kami ng
submarine cables simula sa mainland of Luzon going to Palawan. So, ito po ang magbibigay
daan po talaga na mag-serve ang Globe ng mas magandang speed ng Fiber Optic Internet po
dito po sa Puerto Princesa.
HON. TEMP. PRES. OFFICER CARBONELL: Okay. Kasi pagnarinig ng mga taga Lungsod ng
Puerto Princesa, yong Fiber Optic nabubuhayan sila ng loob. Ngunit alam naman natin na
hindi lang tayo, hindi lang ako, hindi lang sila, lahat ay mag-a-apply dyan. So, dapat yong
inyong program ay mabilis din yong inyong reaction doon sa bulk… sa laki ng bulk ng mga
applicants, para hindi magkabuhol-buhol hindi babalik doon sa mabagal na sistema.

THIS CITY, FOR CALENDAR YEAR 2018.

WHEREAS, Article II, Section 25 of the Philippine Constitution guarantees that the State shall
ensure autonomy of local governments;

WHEREAS, Section 391 (a), (3) of Republic Act No. 7160, otherwise known as the Local
Government Code of 1991, provides, that Sangguniang Barangays shall have the power to enact
annual and supplemental budgets in accordance with the aforestated law;

WHEREAS, pursuant to Section 333 of the same Code, the Sangguniang Panlungsod is mandated to
review barangay budget to ensure that the provisions of the Code on Local Fiscal Administration are
complied with, which review power includes the authority to declare the same inoperative if it is
ascertained that the appropriations contained therein exceed the estimates of the income duly certified
as collectible or that the same has not complied with the budgetary requirements set forth; and the
authority to disallow the same if the items of appropriation are contrary to or in excess of any of the
general limitations or the maximum amount prescribed;

WHEREAS, in her letter dated March 5, 2018 addressed to the Honorable Members of the
Sangguniang Panlungsod, Ms. Maria Regina S. Cantillo, City Budget Officer, submitted the Annual
Budget of Barangay Irawan, this City, for the Calendar Year 2018, with the information that upon
preliminary review by her office, the Annual Budget of the aforesaid Barangay showed substantial
compliance with the provisions of the Local Government Code of 1991 and implementing circular
and issuances;

Government Code of 1991 provides, that for efficient, effective and economical governance the
purpose of which is the general welfare of the city and its inhabitants pursuant to Section 16 of the
same Code, the City Mayor shall exercise general supervision and control over all programs, projects,
services and activities of the City Government. In this connection, the City Mayor shall represent the
city in all its business transactions and sign in its behalf all bonds, contracts and obligations, and such
other documents upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance;

WHEREAS, in his letter dated March 08, 2018, addressed to the Honorable Acting City Vice Mayor
Maria Nancy M. Socrates and to the Honorable Members of the City Council of Puerto Princesa, thru
Atty. Philip Jerome J. Hilario, Secretary to the Sangguniang Panlungsod, this City, Atty. Arnel M.
Pedrosa, City Legal Officer, Acting City Administrator, requested authority for Honorable City
Mayor Lucilo R. Bayron to enter into and sign the Memorandum of Agreement for Work Immersion
Partnership with the Palawan Polytechnic College Inc.;

WHEREAS, pursuant to Republic Act No. 10533, otherwise known as the “Enhanced Basic
Education Act of 2013”, the Department of Education enacted the guidelines for work immersion
program for senior high school. In compliance with the Department’s guidelines, Palawan
Polytechnic College Inc. proposed a partnership with the City Government for their senior high
school students to be accommodated in a Work Immersion Partnership;

WHEREAS, this August Body, after deliberation, finds the request in order and proper to support the
implementation of the K to 12 Program of the Department of Education in this City, as provided in
Republic Act No. 10533.

NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,

BE IT RESOLVED, as it is hereby resolved, to authorize the Honorable City Mayor Lucilo R.


Bayron to enter into and sign the Memorandum of Agreement (MOA), for and in behalf of the City
Government of Puerto Princesa, with the Palawan Polytechnic College Inc. for the Work Immersion
Program of its Senior High School Students.

HON. GADIANO: Thank you, Mr. Chair. The committee has only one report to make. And this is a
letter dated December 07, 2017 from Teresita C. Austria, President of Puerto Princesa City
Community Based Sustainable Tourism Federation (PPCCBSTF), addressed to the Honorable
Members of the Sangguniang Panlungsod, submitting the attached position paper re: An
ordinance enacting the Revised Revenue Code of Puerto Princesa City 2016 with some
specific provisions affecting the CBST organization, though incapacity to comply
documentary requirements with corresponding regulatory fees. Mr. Presiding Officer, our
guests, Ms. Teresita Austria requested consideration that documentary requirements for the
application of renewal of business permit and corresponding regulatory fees and other
relevant provisions be held in abeyance in her application to them. And further, they sought
the implementation of particular provisions of the Philippine Cooperative Code of 2008 which
exempts duly registered cooperatives from payment of taxes, fees and charges which was also
reiterated in their position paper wherein they prayed that the exemption be granted to all
CBST for all reason as they manifested that the income coming from their operation are not
sufficient to sustain the daily operation. So, Mr. Presiding Officer, we have seen the interplay
of three (3) laws in this item, first is the CBST Ordinance and the Revised Revenue Code 794
and likewise the DILG Memorandum Circular 2010-120. All of them, Mr. Presiding Officer,
talks about exemption. However, we referred this to the City Legal Office to harmonize the
three (3) laws, Mr. Presiding Officer. And accordingly, according to the Legal Opinion which
we adopted, Mr. Presiding Officer, they’re all talking about exemption but only two (2)
member cooperatives only, Mr. Presiding Officer. So, CBST has no bearing in so far as these
exemptions are concerned, Mr. Presiding Officer.
HON. TEMP. PRES. OFFICER CARBONELL: Yes.
HON. GADIANO: And according to the Legal Opinion, the exemption is applicable only subject to
the performance of the following: No. 1, they still have to obtain the Mayor’s Permit and pay
the commensurate cost of regulation, inspection and surveillance of operation but not
exceeding One Thousand Pesos (P1,000.00). So, accordingly, as requested by Ms. Austria,
because they have difficulty complying with the provision of the zoning fee under the CBST
rule, lodging fee was being charged to them, Ten Thousand Pesos (P10,000.00). However,
with this Legal Opinion, Mr. Presiding Officer, they would only be paying One Thousand
Pesos (P 1,000.00). And secondly, they have to secure the Community Tax
Certificate as juridical entity and pay the basic tax of Five Hundred Pesos (P 500.00). And
thirdly, pay service charge and rental for the use of property and equipment of public utilities
owned by the local government such as charges for actual water consumption, electric power,
the use of public roads and bridges and the like. So, with this, Mr. Presiding Officer, they
explained to the requesting party the Legal Opinion and we adopted the Legal Opinion, Mr.
Presiding Officer. And rather than passing a resolution for that matter, Mr. Presiding Officer,
we just agreed that their office will coordinate with the City Tourism Office regarding that
concern, Mr. Presiding Officer. So, that’s the report, Mr. Presiding Officer.

the part of the barangay that the illegal occupants should have to be demolished, then, the
proper Body that should have to act on this is the CASSAPS. So, in view of this, the

discussed it two (2) times. The first time that we discussed it, it was attended by the
complainant, but the one being complained of are not present. And we calendared it again last
committee meeting, but unfortunately, the complainant did not appear. But on
recommendation of the guest particularly Engr. Bundac, Mr. Presiding Officer, and for failure
on the part of the complainant to be present in the second time despite due notice, the
committee recommends that this item be properly endorsed to the City Engineering for
proper action and to update this Council regarding the action taken with respect to this subject
matter, Mr. Presiding Officer. That is the recommendation of the committee.

requesting for intervention and investigation regarding the Notice of Final Closure and
Demand to Pay and illegal demolition of their stalls in Puerto Princesa City Baywalk for
information and appropriate action. Mr. Presiding Officer, we calendared it for two (2) times.
The first time that we discussed it, it was continued the following week, Mr. Presiding Officer.
But the bottom line here, Mr. Presiding Officer, the complainant wanted to at least discipline
those who violated the rights of the stall owners, allegedly. And for that reason, as the
committee or the entire Council has no jurisdiction to impose disciplinary action with respect
to the persons involved in the complaint by Mr. Arnold Buenafe, the recommendation now of
the committee is to have it endorsed to the City Legal Office for proper investigation and to
update this Council with respect to the action taken pertaining to this subject matter, Mr.
Presiding Officer. That is the recommendation of the committee.

was only a clearing. And in fact, we made our suggestion with respect to the existing policy
of Baywalk. Because based on the policy of Baywalk, the action which the Baywalk can
only do is only to demand, even our existing ordinance. That’s why the committee made an
advice to the management of Baywalk that as far as the use of space within the Baywalk it
should have to be as much as possible covered by a Lease Contract. Second, they have to
amend their existing policy, because if they don’t have a clear policy regarding this subject
matter, then we do not know what would be the proper action that should have to be taken by
the Baywalk Management. That’s why as far as this subject matter is concerned, the
committee made a suggestion before Mr. Dangan, that they have to amend the policy of the
Baywalk as far as the use of the space there. And secondly, is to come up with a Lease
Agreement, Mr. Presiding Officer.
HON. OLIVEROS: So, now, the recommendation of the committee is to have this endorsed to the
City Legal?
HON. AWAT: Yes. Because the complainant wanted that the persons involved should have to be
disciplined. We don’t have administrative sanction against those persons involved, because
they are coming from the executive. So, we believe, that if ever there will be process that
should have to be conducted, it should have to be done by the City Legal Office. That’s why
the recommendation of the committee is to have it endorsed to the City Legal for proper
investigation and to update us from time to time of the action taken by the City Legal
regarding the process that they have conducted as far as this complaint is concerned.

HON. AWAT: The next item, Mr. Presiding Officer, is SDO No. 224-2017 “An ordinance amending
Section 13 of Ordinance No. 560, otherwise known as the Revised Zoning Ordinance of the
City of Puerto Princesa of 2013”. Mr. Presiding Officer, we calendared it for several times,
until finally in the last scheduled committee meeting, we come up with the final amendment
to this proposed ordinance. The proposal is to have them exempted. But according to Engr.
Bundac, it cannot be done. The problem for the Indigenous Peoples, they cannot apply
because they don’t have the title, they don’t have the tax declaration but we agreed in the
middle, Mr. Presiding Officer that if ever they have a certification from the National
Commission on Indigenous Peoples here in Palawan or NCIP Palawan, then, that will be the
start of the process for the City Planning Office and they will entertain for purposes of the
issuance of locational clearance. So, in view of this amendment Mr. Presiding Officer and
upon prior consent on the part of the office of the City Planning Office we agreed to have the
amendment be made subject to the amendments of the said proposed amendment to the said
ordinance. So, the final amendment now will be read in the power point, the amendment is
only with respect to the word, however… yes, “all owners”… I will read it Mr. Presiding
Officer, this is now the final version of the amendment “all owners, developers shall secure
locational clearance from the Zoning Officer for its project listed under allowable uses or
from the DCEPC for proposals requiring consent on merit prior to conducting any activity or
construction on their property/land. This is now the amendment Mr. Presiding Officer.

However, in case the area being applied for locational clearance is within the ancestral
domain of the indigenous peoples, a certification from the National Commission for
Indigenous Peoples (NCIP) Palawan Office to that effect shall be sufficient as proof of the
applicants rights over the property. So, that would be the basis now of the City Planning for
purposes of the issuance of locational clearance, because before, they cannot do it because
they don’t have the title of the tax declaration. Now, the certification would be a sufficient
document to start with for the application for locational clearance eventually for Mayor’s
Permit Mr. Presiding Officer. So, the recommendation of the committee is to approve the
proposed amendment subject to the amendment as read and this be approved on the second
reading and to be calendared for the third and final reading in the next session Mr. Presiding
Officer.

Angelo R. Arizala in Civil Case No. 5122, dated February 9, 2018, re Global Sports
Center/Eduardo S. Matillano versus the City Government of Puerto Princesa, represented by the
City Mayor Lucilo R. Bayron et al, for injunction with prayer for temporary restraining order,
for information and appropriate action. Mr. Presiding Officer, this is only about the decision of
the Regional Trial Court of Palawan regarding the motion for reconsideration filed by
respondent Michael Tan. It appears that the said motion for reconsideration was denied and as
such it maintains the prior judgment that as far as the bidding is concerned then, that is null and
void. And as such, there is now no franchise for cockfighting is allowed within the poblacion.
But I understand, this subject matter was elevated to the Court of Appeals, Mr. Presiding
Officer. So, the recommendation of the committee, considering this is only for the information
of all of us, is to have this kept on file Mr. Presiding Officer.

HON. MARISTELA: Thank you Mr. Presiding, may I recommend to the Reporting Chairman that we
ask the legal opinion of the City Legal Office if we can have a rebidding of the cockpit in
poblacion, considering that the bidding conducted by the Bids and Awards Committee
previously, was already declared null and void by the Regional Trial Court and the motion for
reconsideration filed by Mr. Michael Tan was denied by the Regional Trial Court. Because if
we’ll wait for the… in case Mr. Tan appeal the decision to the Court of Appeals it will delay the
rebidding of the cockpit in poblacion, Mr. Chairman. So, may I suggest that we ask the legal
opinion of the City Legal Office if we can conduct a rebidding for this cockpit considering that
the City Government is one (1) of the respondents in this case did not file a motion for
reconsideration and will never file an appeal to question the decision of the Regional Trial
Court, Mr. Presiding.

pursuant to our ordinance. So, I do believe that it will not cause any harm on the part of the City
Council and I’m in support of that manifestation made by Councilor Maristela, after all it’s only
a legal opinion, Mr. Presiding Officer.

Excellent Government, a C.S.O (Civil Society Organization) Inc., addressed to the
Sangguniang Panlungsod, City Government of Puerto Princesa, through Atty. Philip Jerome J.
Hilario, Secretary to the Sangguniang Panlungsod, this City, forwarding the attached copy of
the Indirect People’s Initiative transmitted by the Convenor Group led by the former Mayor
Edward S. Hagedorn to the 3rd Palawan District Congressman Gil P. Acosta for his endorsement
to and support at the House of Representatives signifying the petition of more than the
minimum required 1,000 residents to convert the Highly Urbanized City of Puerto Princesa to
the Province of Puerto Princesa, comprised of a Component Capital City of Puerto Princesa and
a minimum of two (2) municipalities, the clustering of barangays and names to be determined
at a further future time or after further consultation with the local citizens, for information,
reference and appropriate action. Mr. Presiding Officer, this is all about the idea that the
province of Palawan will be divided into four (4) provinces. And one (1) of the provinces that
will be created as being envisioned is Puerto Princesa with only one (1) component city and
two (2) municipalities. So, considering this is very important subject matter, this representation
is not recommending to the body but take action with respect to this subject matter, but I need
the individual answer or action taken by the members of this August Body as to what would be
our action to take, as far as this subject matter is concerned.

considering that the issues involved is the same as that of the two (2) items which are still

subject matters pending before the Committee on Legal Matters.

HON. SOCRATES: Still in need of a locational clearance. So, the paragraph that is amending this,
refers to the requirement. Is that correct? Because you are saying shall be sufficient as proof
of the applicants right in order to get a locational clearance. They have to prove that it is their
property. Is that right?
HON. AWAT: Well, basically before you can apply for locational clearance the number one (1)
requirement is that he should have the title, in the absence of the title he should have the tax
declaration. Here, for the Indigenous Peoples to apply for Mayor’s Permit basically they don’t
have the title, they don’t have the tax declaration. So, they cannot apply for a Mayor’s
Permit. So, they are doing a business without Mayor’s Permit that becomes the activity
illegal.
HON. SOCRATES: Okay, so… (Interrupted)
HON. AWAT: Now, to start the process, is of course something that they have a document. That is
why we made an amendment to the existing ordinance that a mere certification from the NCIP
will be sufficient enough for them to start for the application for locational clearance and
eventually it will be processed and ultimately will be a basis for the issuance of Mayor’s
Permit.
HON. SOCRATES: Okay. Thank you. So, perhaps just to avoid misinterpretations in the future siguro
po tanggalin na lang natin yong “however”, kasi pag sinabi mong “however”, parang
bagama’t ito ang sitwasyon, ito dapat… (Interrupted)

AN ORDINANCE CREATING THE PUERTO PRINCESA CITY JOINT TASK FORCE ON


PEACE AND ORDER AND PUBLIC SAFETY.

WHEREAS, Article II, Section 5 of the Philippine Constitution declares that the maintenance of
peace and order, the protection of life, liberty, and property, and the promotion of the general welfare
are essential for the enjoyment by all the people of the blessings of democracy;

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code
of 1991, provides that every local government unit shall exercise the power expressly granted, those
necessarily implied there and from, as well as powers necessary, appropriate or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare and ensure and support, among other things, the maintenance of peace and order within their
territorial jurisdiction;

WHEREAS, presented to this August Body is a letter dated February 27, 2018 from Atty. Arnel M.
Pedrosa, City Legal Officer, Acting City Administrator, requesting for a legislative measure creating
the Puerto Princesa City Joint Task Force directing all uniformed agencies to constitute themselves
accordingly, primarily focused on the maintenance of peace and order situation, anti-terrorism and
counter insurgency measures;

WHEREAS, pursuant to its mandate, this August Body finds it necessary to enact this ordinance
considering that the maintenance of peace and order in the city is an imperative requirement in
various areas of development such as eco-tourism, agriculture, transportation and education.

NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,

BE IT ORDAINED by the Sangguniang Panlungsod of the City of Puerto Princesa in its regular
session assembled, THAT:

SECTION 1. TITLE. This Ordinance shall be known and cited as the “Puerto Princesa City Task
Force on Peace and Order and Public Safety Ordinance”.

SECTION 2. SCOPE AND COVERAGE. This Ordinance shall be enforced within the territorial
jurisdiction of Puerto Princesa City.

SECTION 3. DECLARATION OF POLICY. It is hereby declared the policy of the City


Government of Puerto Princesa to maintain peace and order in its territorial jurisdiction and endeavor
to obtain a society suitable for human habitation.

SECTION 4. OBJECTIVES AND PURPOSES. This Ordinance is enacted primarily for the
maintenance of peace and order situation, and the formulation of anti-terrorism and preventive and
counterinsurgency measures for the City of Puerto Princesa.

SECTION 5. CREATION OF JOINT TASK FORCE. There is hereby created the Puerto Princesa
City Joint Task Force on Peace and Order and Public Safety, which shall oversee the implementation
of the provisions of this Ordinance and other related activities as may be provided by rules and
regulations, as well as guidelines promulgated by higher authority or mandated by national laws.

SECTION 6. COMPOSITION. The Puerto Princesa City Joint Task Force on Peace and Order and
Public Safety shall be composed of the following:

SECTION 7. DUTIES AND RESPONSIBILITIES. The Puerto Princesa City Joint Task Force on
Peace and Order and Public Safety shall have the following duties and responsibilities:

a. Convene the Task Force at least every two (2) months except in case of emergency
situation where the Chairman may call for a special meeting;

b. Formulate peacekeeping operational plans and mechanisms and anti-terrorism and


counterinsurgency measures;

c. Contribute to the strategies of the City Peace and Order Council that would effectively
address peace and order problems;

d. Coordinate and monitor the implementation of peace and order plans in the City;

e. Provide a forum for inter-disciplinary dialogue and deliberation of major issues and
problems affecting peace and order, including insurgency;
f. Make periodic assessment of the prevailing peace and order situation in the City;
g. Create a Special Action Committee to address immediately the issues on peace and order
and public safety in case of emergencies;
h. Perform all other functions assigned by the Chairman of the Task Force.

SECTION 8. REPEALING CLAUSE. All ordinances, rules and regulations, or any part thereof not
consistent with this ordinance are hereby repealed, amended or modified accordingly.
SECTION 9. SEPARABILITY CLAUSE. If any provision or part of this Ordinance is declared
invalid and unconstitutional, other provisions and parts hereof not declared shall remain in full force
and effect.
SECTION 10. EFFECTIVITY CLAUSE. This Ordinance shall take effect fifteen (15) days
following its publication in a newspaper of local circulation in the City of Puerto Princesa.

WHEREAS, Article II, Section 5 of the Philippine Constitution declares that the maintenance of
peace and order, the protection of life, liberty, and property, and the promotion of the general welfare
are essential for the enjoyment by all the people of the blessings of democracy;

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code
of 1991, grants to local government units the power to pass ordinances for the purpose of the welfare
of the constituents within the jurisdiction of the City Government, under which, every local
government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as
well as powers necessary, appropriate, or incidental for its efficient and effective governance, and
those which are essential to the promotion of the general welfare;

WHEREAS, the 7th Sangguniang Panlungsod of the City Government of Puerto Princesa approved
Ordinance No. 17-92, entitled: “An Ordinance fixing curfew hours for minors below eighteen (18)
years of age and imposing penalties for its violation”;

WHEREAS, Chapter Three (3), Article XVI, Section 1 of Ordinance No. 544, known as the “Code
of General Ordinances of the City of Puerto Princesa”, enacted by the 13th Sangguniang Panlungsod,
prohibits minors below eighteen (18) years of age to roam around or loiter in public places or move
about outside their residences between the hours of 10:00 o’clock in the evening and 4:00 o’clock in
the morning without a curfew pass from the Office of the City Mayor or unless accompanied by their
parent or parents, responsible relative or guardians, or unless the minor, who is not a resident of the
City, is only passing through the City;

WHEREAS, be it noted that in view of Section 57 of Republic Act No. 9344, otherwise known as
the Juvenile Justice and Welfare Act of 2006 and other laws and rules as to minors, the penalty of
imprisonment cannot be imposed to persons fifteen years old and below and to those above fifteen,
below eighteen acting without discernment curfew violations, being the same as a status offense;
WHEREAS, it is the object of the ordinance to prevent the sustaining of injuries arising from
accidents happening during curfew hours and to promote morality, dignity, and decency within the
City of Puerto Princesa;

WHEREAS, there has been a lenient enforcement of the ordinance in the past years that resulted to
several commission of crimes during night time.

NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,

BE IT RESOLVED, as it is hereby resolved, to request the Office of the Honorable City Mayor to
strictly implement Chapter III, Article XVI, Section 1 of Ordinance No. 544, otherwise known as
“Code of General Ordinances of the City of Puerto Princesa”.

RESOLVED further, that copies of this Resolution be furnished to Honorable City Mayor Lucilo R.
Bayron, the City Administrator, the City Legal Officer, and the City Information Officer, all of this

At dito po ay pino-propose po namin na tanggalin sa membership yong Chairman ng

doon lahat po ng mga applications sa DCEPC na kung saan member yong dalawang
chairman. Pagkatapos po noon ay ini-endorse din po sa City Council yoon pong mga
projects. So kung member po tayo doon sa DCEPC ay parang nawawalan nap o tayo ng
independence at nao-obliga na tayo mag-approve dahil dumaan na po doon. So minarapat po
namin na tanggalin po yong chairmanship ng dalawang (2) Konsehal. Anyway, parang lalong
mapag usapan po ito, I move that this item be referred to the Committee on Landed Estate
and the Committee on Environment chaired by the Committee on Landed Estate.
