ng Magtaking, San Carlos City, Pangasinan on September 2019 held in Barangay Magtaking San
Carlos City, Pangasinan.

“AN ORDINANCE PROHIBITING OWNERS/OPERATORS OF RESORTS, HOTEL, INN,


SARI-SARI STORES, CIGARETTE/TOBACCO AND LIQUOR SHOPS, BARS, CIGARETTE
VENDORS AND PEDDLERS, OR ANY PERSON WHO HAS POSSESSION OF
CIGARETTES OR ANY TOBACCO PRODUCT OR LIQUOR OR INTOXICATING DRINK
IN BARANGAY MAGTAKING, SAN CARLOS CITY, PANGASINAN TO SELL OR
CAUSE THE SALE OF ANY SUCH CIGARETTE OR ANY TOBACCO PRODUCT OR
LIQUOR OR INTOXICATING DRINK TO MINORS AND FOR OTHER PURPOSES”

WHEREAS, smoking tobacco/cigars/cigarettes and drinking liquor among minors are rampant
throughout Barangay Magtaking, San Carlos City, Pangasinan;

WHEREAS, information and reports relayed by some cause-oriented groups and non-
government organizations to the Sangguniang Kabataan and Barangay Officials reveal that many
elementary pupils and high school students in the living, studying, and or traversing through the
barangay are already learning the habit of smoking cigarettes and drinking liquor;

WHEREAS, it is the responsibility of every government, being the guardian of the people, to
keep the little children away from the bad habit of smoking any tobacco product and/or drinking
liquor;

WHEREAS, such responsibility can only be accomplished when there are enough stringent
measures to ensure the protection of these little children from being exposed to any type of
activity including smoking tobacco product and drinking liquor that will surely cause damage to
their yet delicate physical and mental conditions;

WHEREAS, the government must initiate a radical social orientation to the effect that tobacco
and liquors are not good for the youth and that the enactment of an ordinance for that purpose is
a good beginning;
NOW, THEREFORE BE IT RESOLVED, as it is hereby resolved, to enact this Ordinance:

SECTION 1. SHORT TITLE. – This Ordinance shall be known as “THE ANTI


SMOKING/DRINKING ORDINANCE FOR MINORS”.

SECTION 2. PROHIBITED ACTS AND OMISSIONS. –

a. No owner/operator of resorts, hotel, inn, sari-sari stores, tobacco/cigarette/cigar and


liquor shops, bars, cigarette vendor and peddler, or any person who has the possession
of tobacco products such as but not limited to cigars and cigarettes, liquors or
intoxicating drinks in General Santos City shall sell or cause the sale of any such
tobacco product, liquor or intoxicating drink to any person who is below eighteen (18)
years of age.

b. No person shall give for free of any kind of cigarette or tobacco product, liquor or
intoxicating drink to minors;

c. No minor is allowed to buy or smoke any cigarette or tobacco product or to buy or


drink any liquor or intoxicating drink, However, if the minor buys any of these product
only on errand, the person who sent him on errand is the one liable as provided for in
the next paragraph hereof. Also, no minor shall sell any kind of cigarette or tobacco
product or liquor or intoxicating drink. However, if the sale by minor of any such
product is in line of his job assigned to him by his employer, it is the latter who is liable
under paragraph (f) of this section;

d. No person shall command/request a minor on errand to buy any cigarette or any other
tobacco product or liquor or intoxicating drink;

e. No owner/operator of resorts, hotel, inn, sari-sari stores shall assign their minor
employees to deliver to customers any kind of cigarette or tobacco product or liquor or
intoxicating drink;

f. All owners/operators of resorts, hotel, inn, sari-sari stores that sell any kind of cigarette
or tobacco product or liquor or intoxicating drink shall post on a conspicuous place of
their establishments/stores a notice to the effect that tobacco cigarettes or any tobacco
product or liquor or intoxicating drinks are not for sale to minors and indicating in that
notice the number of this ordinance;

Section 3. Penalty Clause. – Any person who violates any of the provisions of this Ordinance
shall pay the following fines accordingly:
a. First Offense- Five hundred pesos and zero centavos (P500.00)
b. Second Offense- Eight hundred pesos and zero centavos (P800.00)
c. Third Offense- One thousand pesos and zero centavos (P1000.00)

Provided, that the minor under eighteen (18) years of age is exempt from this penalty. Instead, he
or she should be brought to the Department of Social Welfare and Development for proper
counselling for one (1) hour.

Section 4. Repealing Clause. – All ordinances, resolutions, orders, memoranda and other
issuances not consistent with this ordinance are hereby repealed.

Section 5. – Separability Clause. – If for certain reasons some provisions of this ordinance are
found to be invalid or unconstitutional, all other provisions thereof not affected thereby shall
remain to be in full force and effect.

Section 6. Effectivity Clause. – this Ordinance shall take effect after being published
and posted in at least three (3) conspicuous places for a period of three (3) weeks within
Barangay Magtaking, San Carlos City, Pangasinan.

Enacted by the Barangay Magtaking, San Carlos City, Pangasinan, on its regular session of
September 2019.
