Further to your above referred letter we would like to bring your kind attention to the facts of the

project which has had a feeling of concerns in the schedule of approved execution plans which are as
follows:-

1. Collection of Ownership Records

From the progress reports it is clear that we are and is doing good progress in our physical
surveys. During the survey works OR had additionally asked to collected ownership records. On
a good faith upon requested by your side we had tried to do the same which was met with little
success on most of the occasions as the property owners were not cooperating. Your kindself
might be aware that we had deployed more personnel to achieve this task.
We wish to bring your attention to our Scope of Works as per the contract document page 3 of 5
Section 3, wherein we are only obligatory to conduct survey and record various inventories in
the proposed alignment.

2. Ariel Mapping-Permission
We were denied permission for the works by the authorities citing government safety/security
laws/procedures and were instructed to approach through Oman Rail.
Though Oman Rail has taken up the matter on 10th May 2015, we are still awaiting permission to
commence our works. In pursuant to clause 14 program we will require 10 weeks to complete
the works post receipt of permission for the works.

Further regarding the quality of submission, there is no standard format for the deliverables. We are
making the submissions as advised by OR. If the same needs improvement we are ready to cooperate in
the best interests of the project.

We would like to add that regarding the checking of files with MRWMR, meetings, public liaising are
strictly not in accordance with Section 3 of Contract Documents Scope of Works and attracts cost and
time impact on the Works.

From the above discussion it is clear that the progress made by our survey team is commendable
whereas the works(owner ship records, MRMWR, Public coordination etc) required to be carried out by
OmanRail has been laden to Al Manarah which is the real substance of threat which might derail
approved execution plans.

On account of these additional works we shall be claiming for additional time and cost .
