EXTRA-JUDICIAL SETTLEMENT OF REAL

ESTATE WITH DEED OF SALE

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, JUANITA M. MASCARDO, died intestate at Davao City on ________


leaving no will nor debts settled to date but leaving one (1) parcel of land covered with Transfer
Certificate of Title No. _________ , 8000, Davao City;

WHEREAS, at the time of her death, she left as forced heirs, the following and to wit:

1. JESUS MASCARDO, of legal age, Filipino, widower and a resident of


Bunawan, Davao City, Philippines,
2. JUSITA M. VALLES, of legal age, Filipino citizen, married to Dr. Romeo
Raul Valles and a resident of Block 14, Lot 4, Luzville Subd.m Panacan,
Davao City;
3. JEANNITH M. MASCARDO, of legal age, Filipino citizen, single and a
resident of Davao City;
4. JESSWANIE M. MASCARDO, of legal age, Filipino, single and a
resident of Bunawan, Davao City;

WHEREAS, they are all her legal heirs by reason of the fact that they are all her
legitimate children and who are supposed to inherit by way of intestate succession;

WHEREAS, at the time of her death, she left a parcel of land together with improvement
thereon:
Technical Description
WHEREAS, the above-named decedent left no debt or obligations which remain
unpaid and unsettled and chargeable against his estate.

WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the
Philippines, and being with full capacity to contract, we do hereby adjudicate unto
ourselves the parcel of land described above, in equal shares.

WHEREAS the party hereto being of legal age and with full civil capacity to
contract hereby by these presents agree to sell the portion of the above-said property
containing an area of Two Hundred Twenty Five (225) square meters, more or less;

DEED OF ABSOLUTE SALE

FOR AND IN CONSIDERATION of the sum of ______________________


(P____________) ONLY, Philippine Currency, paid by ____________________,
(Vendee) of legal age, married to ____________, Filipino, and resident of
_________________________, Philippines, receipt of full amount of which is hereby
acknowledged by the herein VENDOR-HEIRS the herein parties hereby SELLS,
TRANSFER AND CONVEY by way of absolute Sale all their rights, interest and
participation over the above-described property in favor of _____________________,
his heirs, assign and successors in interest free from any lien or encumbrances
whatsoever and further warrant their Title and ownership thereof against any claim
from third persons whosoever.

of JUANITA M. MASCARDO and that the parties as well as their instrumental witnesses have
signed each of the pages hereof.
