Pawleys Island Election Protest and Hearing Request

Dear Chairman md Members of the Georgetown County Elechon Commission:

This telter is a formal protest and contest to dre most recent Pawleys Island Municipr I
Election held on November 5, 2019. Pusuant to the Election Challenge and Protest Laws an,l
S.C. Code Ann. Section 7-13-10 et. seq., 1976 as amended which provides for 0re conduct ol
elections and municipalities, I protest the November 5, 2019 Pawleys Island election results for
member of council, and the findings and decision of the Creorgetown County Electiorr
Commission on November 1, 2019. l request a prolest hearing based upon the followinl;
grounds:

l. The ballot challenge hearing of Novembet 7, 2019, protesting the balloS of absentee an,l
polling place voters by poll works lacked due process of law in that witresses could nc t
be cross-examined;
2. In the ballot challenge hearing, inappropriate laws were considered. Only rtether or not
the contested ballol was casted by a person who registered to vote more than ftirty (30)
days before the election was considered;
3. The ballot cballenge hearing failed to consider de legal standard for daermining ar
individua.l's residence as mdified in Sec. 7-l-25 of the S.C. Code and the factors t'r
consider in determining I person's intention regarding his or her domicile and residenq.

including address, the voters' physical mailing address, vote$' address on financia I
documents, voters' automobile registration or the tax assessment ratio claim pusuant tl

be discovered prior to a hearing;
6. The commission at the ballot challenge hearing considered the testimony/statements of
Karl Bowers, Esquire who allegedly represented both the candidates (Green and Hemy )
and absent voters rto did not appear or provide any evidence or testimony at the hearintl
in contravention of state law'
7. The commission failed to consider legal requirements for registered voters as set forth il
the South Carolina Constitution and in the voting laws for South Carolina; and
8. The commission faited to consider ihat both candidates Crreen and Henry were not
qualified electon entitled to vote based on tre evidence and testimony of the pol I
watchers; and
9. The commission failed to make their decision based upon the applicable election law;
goveming the conduct of challenge hearings.

Please advise me of lhe time and place of the hearing so I can be prepared and present

This letter is a formal protest and contest to the most recent Pawleys Island Munici nl
Election held on November 5,2019. Pursuant to the Election Challenge and Protest Laws and
S.C. Code Ann. Section 7-13-10 et. seq., 1976 as amende{ which provides for the conduct of
elections and municipalities, I protest the November 5,2019 Pawleys Island election results br
mayor, and the findings and decision of the Georgetown County Election Commission on
November 7,2019.I request a protest hearing based upon the following grounds:

L The ballot challenge hearing of November 7 , 2019, protesting ttre ballots of absentee a rd
polling place voters by poll works lacked due process of law in trat witnesses could r ot
be cross-examined,
2. In the ballot challenge hearing, inappropriate laws were considered. Only wtredrer or rot
the contested ballot was casted by a person wtro registered to vote more than thirty (3 0)
days before the election was considered,
3. The ballot challenge hearing failed to consider the legal standard for determining u
indrvidual's residence as codified in Sec. 7-l-25 of the S.C. Code and tre factors to
consider in determining a person's intention regarding his or her domicile and residen ry
set fortr therein;
4. The ballot protest hearing failed to consider substantial evidence to property ownership,
including address, the voters' physical mailing address, voters' address on financial
documents, voters' automobile registration or the ta:l assessment ratio claim pursuant tro
the list in $12-a3-220(C);
5. The commission in the ballot challenge hearing failed to consider other such facts that mrry
be discovered prior to a hearing;
6. The commission at the ballot challurge hearing considered the testimony/statements ,lf
Karl Bowers, Esquire wtro allegedly represented both the candidates (Green and Henr r)
and absent voters who did not appear or provide any evidence or testimony at the hearir g
in contravention of state law;
7. The commrssion farled to consider legal requirements for registered voters as set forttr n
