AFFIDAVIT OF LOSS

I, DAMIANA S. MONCEDA, of legal age, Filipino, married and with

residence at Mananggal, Dalaguete, Cebu, after having been duly sworn in
accordance with law hereby depose and say that:

1. I am the Buyer and present possessor and occupant of one parcel of land
located at Mananggal, Dalaguete, Cebu designated as Lot No. 2859 covered by
Tax Declaration No. 11-21-0022-14034 registered under the name of Luzminda
S. Monceda-Miyazaki and Original Certificate of Title No. OP-32870 of the
Registry of Deeds Province of Cebu registered under the name of Apolinario
Monceda (the “Subject Property”);

2. Around 1989, my father, Agrifino Monceda married to Praxedes Sanoy, all

of legal age, Filipino Citizens, and residents of Mananggal, Dalaguete, Cebu
bought the Subject Property from Apolinario (one and the same with “Apolinar”)
Monceda. (A certified true copy of Tax Declaration No. 21-23734 and the
Municipal Assessor Certification of Lot History of 2859 are attached as an
integral part hereof.)

3. On July 31, 2006, a Deed of Absolute Sale was entered into between
Agrifino Monceda and my sister, Luzminda S. Monceda-Miyazaki for the sale of
three (3) parcels of land including Lot No. 2859; (A copy of the Deed of Absolute
Sale is attached as an integral part hereof)

4. On June 18, 2017, Luzminda S. Monceda-Miyazaki sold to me the

Subject Property; (A copy of the Deed of Absolute Sale is attached as an integral
part hereof)

5. However, it was belatedly discovered that the Subject Property was

covered by an Original Certificate of Title No. OP-32870 and registered under
the name of Apolinario Monceda as certified by the DENR-CENRO dated June
11, 2018; (A copy of the Certification dated June 11, 2018 is attached as an
integral part hereof).

6. After exerting diligent effort to locate the whereabouts of the heirs of the
late Apolinario Monceda, whom have all died. Furthermore, the heirs of the
latter have no idea of the OCT No. OP-32870 itself, more so with its
whereabouts;

7. I certify and confirm that the parcel of land covered by OCT No.
OP-32870 was never mortgaged, sold, conveyed, disposed and encumbered, to
any other person or entity. I certify and confirm further that the said document
was never confiscated nor relinquished in favor of any government entity or
authority; (A certified true copy of OCT No. OP-32870 is attached as an integral
part hereof)
 8. I am executing this Affidavit of Loss to attest to the truth of the foregoing
and for whatever lawful intents and legal purposes this may serve.
