ZAMBASULTA CHAPTER

REVISED SCHEDULE OF MINIMUM FEES

The following schedule of fees sets the minimum legal fees and may not be construed as the maximum and/ or
reasonable fees to be charged in any given case or situation (See. 15, By- Laws IBP) and without prejudice to such agreement on
reasonable fees that may be freely arrived at expressly or impliedly based on the criteria fixed by Sec. 4, Rule 138 of the Rules of
Court concerning (1) importance of the subject matter of the controversy, (2) extent of the services rendered, (3) professional
standing of the attorney, and (4) financial capacity of the client.

I. CONSULTATION AND LEGAL RESEARCH NEW MINIMUM


RATE
1. Legal Consultation P 400.00/ Hr
2. Legal research and study with written opinion 3,000.00
II. DOCUMENTATION
1. For notarization only of prepared affidavits and sworn statements NOT RELATED to any litigation
whether administrative, civil and criminal 150.00
2. For notarization only of prepared affidavits and sworn statements RELATED to any litigation whether
administrative, civil and criminal 600.00
3. For preparation and notarization of simple affidavit and sworn statement not related to litigation
400.00
4. For preparation and notarization of deeds and contract EXCEPT deeds of sale, transfer or
conveyance 1,000.00
5. For preparation and notarization of Special Power of Attorney 500.00
6. For preparation and notarization of General Power Of Attorney 800.00
7. For preparation and notarization of minutes of meeting or resolution of corporation secretary’s
certificate 800.00
8. For preparation and acknowledgement of a Last Will and Testament, 1% of actual fair market value
but not less than 10,000.00
9. For preparation and/ or acknowledgement Only of Deed of Sale, Deed of Donation, Real or Chattel
Mortgage, or other deeds of conveyance involving Real or personal including motor vehicles, 3% of the
amount involved, but not less than. 1,500.00
10. For Acknowledgement of contract lease; Determine of the amount of consideration of the first
two (2) years period and charge 1% of the amount involved but not less than
1,500.00
11. For preparation of Judicial Affidavit 1,500.00
12. Acknowledgement ONLY of Articles of Incorporation, Constitution and By- Laws 2,000.00
13. For preparation and Acknowledgement of subdivision Agreement and Deed of Extrajudicial
Partition, Extrajudicial Settlement of Estate of Deceased person, and Affidavit of Self-Adjudication, 2%
of the declared value of the properties, but in no case less than
5,000.00
14. Land Title Search 2,000.00
15. For preparation and acknowledgement of Articles of Incorporation, Constitution and By-Laws

III. COLLECTIVE BARGAINING AGREEMENTS
1. For negotiation of Collective Bargaining Agreement (CBA) but not less 1,500.00/Hr

IV. CRIMINAL, CIVIL ELECTION AND ADMINISTRATION CASES
1. Preliminary Study 3,000.00
2. Deposit to cover expenses such as photocopy, telephone, mailing, transportation and other
similar expenses 3,000.00
3. Acceptance Fee ( for Civil & Criminal) 10,000.00
4. Appearance Fees
a. Before the Municipal Trial Court 2,000.00
b. Before the Regional Trial Court 2,500.00
c. Before Labor Arbiter, Prosecutor’s Office and other judicial or administrative bodies
2,000.00
d. Before Court of Appeals 10,000.00
e. Before Supreme Court or COMELEC, Manila
( All expenses incidental to court appearances shall be borne by client) 20,000.00
5. In addition to acceptance fee to court appearance fee, a minimum CONTRACTUAL FEE in
criminal and civil cases shall be charged as follows:
a. Criminal and Civil Cases before the Municipal Trial Courts falling under Summary Rules
in City Court 8,000.00
b. Criminal and Civil Cases before the Municipal Trial Courts not falling under Summary
Rules in City Court 12,000.00
c. Criminal and Civil Cases before the Regional Trial Court 18,000.00
d. Original actions before the Court of Appeals or the Supreme Court 25,000.00
e. Special Proceedings 12,000.00
6. Cases before Administrative bodies and quasi- judicial bodies 12,000.00
7. Fees on contingent basis, 25% of the amount value of money/ property involved
8. Election cases- subject to AGREEMENT OF THE PARTIES considering the risk and personal
security involved, distance, issues and time involved
V. CORPORATIONS AND PARTNERSHIP
A. Domestic
 Simple Articles of Incorporation and Bylaws with the minimum authorized capital
stocks worth 1,000,000.00 Plus P4,000.00 per 1 million of capitalization, fraction
thereof 20,000.00

 Stockholders Agreement or voting trust 20,000.00


 Amending corporate charter 20,000.00
 Preparation of documents for registration to act as register agent 6,000.00
 Preparation and filing of corporate reports 3,000.00
 Preparation of documents for dissolution of corporation 20,000.00
 Preparation of corporate resolution 2,000.00
 Changed of registered agent office 2,000.00
B. Foreign
 Authority to do business in the Philippines 20,000.00
 Documents for registration to act as registered agent 20,000.00
 Preparation of necessary documents for withdrawal from country 20,000.00

C. Not For Profit
 Articles of Incorporation and By- laws of non- stocks nonprofit corporation 20,000.00
D. Partnership
 Drafting of articles of partnership with a minimum capital of P 1,000,000.00 plus P 20,000.00

 Registration of Trade name 4,000.00
 Dissolution, including notices to creditors and agreements 20,000.00
VI. COLLECTION
1. Collection without court action 10%

VII. APPEALS, CERTIORARI, PETITION FOR REVIEW, ETC.
1. From the office of the Prosecutor to the Department of Justice 8,000.00
2. From the Municipal Trial Court to Regional Trial Court 8,000.00
3. From the Regional Trial Court to the Court of Appeals or the Supreme Court, and all incidents 30,000.00
elevated thereto from inferior courts
4. From Administrative and Quasi- Judicial bodies to:
a. Its next higher level, or 10,000.00
b. Court of Appeals to the Supreme Court 25,000.00
5. From the Court of Appeals to the Supreme Court 30,000.00
VIII. FORECLOSURE OF MORTGAGES
In the absence of an express agreement with the client, in
1. Foreclosure of real estate mortgage, 10% of the highest bid but not less than 10,000.00
2. Foreclosure of chattel mortgage, 10% of the highest bid price, but in no case less than 8,000.00
3.NATURALIZATION, TESTATE AND INSTESTATE PROCEEDINGS
1. Election of Philippine citizenship 40,000.00
2. Naturalization proceedings ( Judicial/ Administrative) 40,000.00
3. Testate or intestate proceedings
a. Without opposition:
10% of the gross fair market value of the estate not exceeding P 1,000,000.00 plus 5%
additional on the value of estate in excess of P 1,000,000.00
b. With opposition:
25% of the gross fair market value of the estate in excess of P1,000,000.00

Note: All expenses shall be borne by the client. There is opposition where there is a claim against the
estate, or when there is opposition to the will, to the inventory, accounting, etc. All these fees are in
addition to acceptance and appearance fees.

4.MONTHLY RETAINERS AND PRIVATE EMPLOYMENT


1. Monthly retainer, which consist of legal advice upon consultation of client on legal matters 5,000.00
affecting their business affairs, EXCLUSIVE of fees of notarial services and for handling cases
before the courts and administrative bodies.
2. Private Employments: 500.00/Hr.
a. Teaching in the College of Law
b. Teaching Law subjects other than in the College of Law
c. Other private full time employments
5.GENERAL PROVISION
1. Expenses incidental to the trial or hearing of cases before courts and administrative bodies,
i.e. for transportation, hotel, food, transcript of stenographic notes, sheriff’s fees, etc. shall
be for the account of clients.
2. The foregoing schedule of standardized minimum fees shall not be applied when there is a
special law fixing the attorney’s fees chargeable in certain cases.
3. Strict observance of the foregoing schedule of Minimum Legal Fees by all members of this
Chapter is enjoined.
4. All legal work for prospective clients who cannot afford these should be either:
a. Referred to the Legal Aid Committee of the Chapter or Public Attorney’s Office.
b. Handled as a legal aid case, reported as such to the Legal Aid Committee by
accomplishing the form provided therefore, and considered as his contribution to
public service.

RECOMMENDED BY THE COMMITTEE ON REVISION OF SCHEDULE OF MINIMUM LEGAL FEES APPROVED BY THE
GENERAL ASSEMBLY on November 27, 2015 at the Grand Astoria Hotel, Zamboanga City.
