The   matter   above­mentioned   was   listed   before   the   Hon'ble
Court   on 16.04.2018 when the Hon’ble Court   was pleased to pass
the following order:­
“Issue notice.
In the meanwhile, there will be a stay of the
operation   of   impugned   judgment   and   order   dated
09.02.2018 passed by the High Court of Karnataka,
Dharwad Bench in Writ Appeal No. 100173/2017.”

  Accordingly   show   cause   notice   has   been   issued   to   sole

Respondent   through   registered   AD   post.   Mr.   S.   N.   Bhat,   Advocate
has   filed   vakalatnama/memo   of   appearance   on   behalf   of   sole
Respondent.
Service of show cause notice is complete.
SLP(C ) NO. 15126 OF 2018
The   matter   above­mentioned   was   listed   before   the   Hon'ble
Court   on 02.07.2018 when the Hon’ble Court   was pleased to pass
the following order:­
 “Exemption from filing O.T. granted. 
Issue   notice   on   SLP   as   also   on   prayer   for
interim relief. 
In   the   meanwhile,   there   shall   be   a   stay   of
operation   of   the   impugned   judgment   and   order
passed   by   the   High   Court   of   Karnataka   Circuit
Bench at Dharwad. 
Tag with SLP(C) No.9125 of 2018.”

  Accordingly show cause notice has been issued to all three
Respondents   through   registered   AD   post.   Mr.   A.   S.   Kulkarni,
Advocate   has   filed   vakalatnama/memo   of   appearance   on   behalf   of
Respondent  Nos. 1 and 2. Respondent No. 3 is sole Respondent in
SLP(C   )   No.   9125   of   2018   and   same   is   represented   by   Mr.   S.   N.
Bhat, Advocate in SLP( C) No. 9125 of 2018.
Service of show cause notice is complete.
It   is   submitted   that   matters   above­mentioned   were   lastly
listed before the Ld. Registrar Court on 18.09.2018 when following
order was passed:­
“SLP(C) No. 9125/2018 
Sole   respondent   has   not   filed   counter
affidavit,   despite   last   and   final   opportunity
having   been   granted.   Further   opportunity   is
declined. 
SLP(C) No. 15126/2018 
Last   and   final   opportunity   is   granted   to
respondent   Nos.1   and   2   for   filing   counter
affidavit within four weeks. 
Respondent No.3 is common as sole respondent
in   connected   SLP(C)   No.   9125/2018   and   is
represented,   as   such,   service   is   deemed   to   be
complete but none has entered appearance. 
Registry   to   process   the   matters   for   listing
before   the   Hon'ble   Court   after   completion   of
period   of   four   weeks   as   further   opportunity   to
file counter affidavit stands declined.”

 It is further submitted that counsel for sole Respondent in
SLP(   C)   No.   9125   of   2018  has   on   22.10.2018   filed   statement   of
objections on his behalf along with application for exemption form
filing official translation, same is registered as I.A. No. 152225
of   2018.   Statement   of   objections   along   with   application   for
exemption from official translation has been included in SLP paper
books.
It is further submitted that counsel for Respondent No. 1 in
SLP(   C)   No.   15126   of   2018   has   on   26.11.2018   filed   counter
affidavit on behalf of Respondent No. 1, same has been included in
SLP paper books.
The   matters   above   mentioned   are   listed   before   the   Hon'ble
Court with this Office Report.
