ABSTRACT

One of the common problems encountered in most households and industrial places
(such as manufacturing firms, restaurants, grocery stores) is the problem of pest’s
infestations. The pestering of rodents and insects (cockroaches, rats, flies, ants,
mosquitoes) has been very rampant these days. People would use the conventional pest
and insect killers, and insect and mouse traps to alleviate this problem. This method could
be costly and harmful to the environment and to the health. This is the reason why the
researchers came up with a solution that could solve these pests problem without harming
the environment and the people around.
Through a series of procedures, the researchers came up with CANEPI Pest-Killer
Feed. The main ingredients of this feed includes, bromelain extracted from pineapples, a
cyanogenic glycoside called linamarin from raw cassava, and a limonoid called azadirachtin
extracted from Neem seeds, honey as the preservative, and cornstarch as a binder. After
peeling, slicing, crushing, mixing and cooking the raw materials, the products were then
rolled into balls. The molded balls were then wrapped and packed inside a box. The finished
product was then subjected to inspection to make sure that the product is in its best state
and quality.
The product is attractive to the pests since it looks and smells like food. It also an
effective pesticide and insecticide because it contains constituents such as, bromelain that
causes diarrhea, intestinal and stomach discomfort leading to death when taken in high
amounts; linamarin that releases hydrocyanic acid in the body causing death; and
antifeedant called azadirachtin. Since, this product uses organic raw materials only, it is
easier to dispose and decompose. It does not emit harmful and toxic substances and the
smell is more bearable. It is totally safe to the environment and to the health of people.

CHAPTER I: EXECUTIVE SUMMARY

Project Background

Pest control has long and interesting history that appears to have begun around 2500 BC

when the Sumerians began using sulfurs as an insecticide. Around the time of Christ, the Chinese

and Egyptians were using herbs and oils to control insect pests. By 300 B.C., the Chinese started to

monitor the emergence of pests and regulate when they planted their crops to avoid certain pests.

Between 1100-1600 AD the Chinese started using soaps, tobacco and arsenic to control pests; these

are techniques that again are used today. Since 1962, the focus has been on Pest Management

rather than on pest elimination. Rather than thinking in terms of "Let's sterilize the field and kill all the

insects," the goal was now to manage the pests to prevent their numbers from reaching the EIL. If

you notice from the Pest Management industry, exterminators are now known as PMPs or pest

management professionals.

Chemical controls of insect pests are sometimes necessary. Insects compete with us for

food, water and shelter and some may transmit disease. Chemistry has advanced so that we can

now carefully choose what type of chemical control measures will help us to control the insect pest

and still have minor impact on the environment. There are different chemistry's that impact insects

in different ways. But, many insecticides are toxic to humans and other mammals. So, before an

insecticide can be sold, an estimation of how toxic it will be to humans must be determined and be

included on the label.

Insecticides are classified as inorganic, botanicals, synthetic organics, insect growth

regulators (IGR's), and microbial. Inorganic are usually obtained by mining and do not contain

organic compounds (those that contain carbon) in them. Botanicals are obtained from flowers and

synthetic organics are man-made. Insect growth regulators often kill insects by affecting insect

growth and microbial include a fungus, a bacteria or a virus applied to plants to kill insects.

The type of insecticide the researchers are going to make is a synthetic organic pest-killer feed made

from non-chemical ingredients which are unripe pineapple, raw cassava, and neem oil. This research

will require the proponents to form a partnership, make the product, market it to sellers, and handle

all its financial activities.

3JLR Inc. is a start-up business that produces a pesticide brand with no chemical additives

included. 3JLR Inc. designs and manufactures pest killers that serve as an alternative to normal

pesticides. The company’s main product, CANEPI is made up of only natural ingredients that are

harmless to humans such as Neem seeds, raw cassava, and unripe pineapple. CANEPI provides a

safer and reliable form of insect killer that does not contaminate any households and businesses.

Objective of the Study

In order to achieve this Feasibility Study, the objectives of this study are listed below.

General Objectives

To further improve the utilization of the ingredients used that can be found in the

Philippines

To give a high-quality product and provide customer satisfaction

To present possible job opportunities and give importance to the millennial

customers’ needs.

To prove good effects of the products to its users and continue and develop more

pure-organic products such as CANEPI.

Project Summary

1. Management Aspect

- This aspect contains the organizational chart where a particular person is assigned a

certain job. Management also includes the personnel to be hired, the process of

acquiring employees, the requirements need to possess and fulfill in order to fit, the job

description, specification, and classification as well providing the rules and regulations

of the company as well as shift schedules of each employee.

2. Marketing Aspect

- This aspect consists of demand and supply analysis, competitors’ analysis, supply

analysis, service capacity analysis and market share. Part of marketing is the gap

between the available demand and demand taken. The last part is the price study and

marketing strategies used in promoting the business.

3. Technical Aspect

- This aspect is all about the service description where step-by-step processes are stated

together with concept and additional services. Technological assistance, project site,

proposed layout, service/ business schedule, tools and equipment, rules and regulation,

manpower requirements and waste and waste disposal are also part of technical aspect.

4. Financial Aspect

- This aspect of the study refers to computation of total profit of the company which

subtracted from the total cost of establishing the business which includes building

constructions, equipment, maintenance and salaries. Financial aspect also includes

financial statement, income statement, stockholder equity and investment.

5. Socio-Economic Aspect

- This aspect of the study refers to the suitable annual amounts of taxes the business is

paying and the number of workers to be employed. How the business will benefit not

just to its consumers but also to the immediate consumers which is the employees, its

host community and also the communities around the vicinity.

- Legal and ethical issues form an important component of modern research, related to

the subject and researcher. The main role of human participants in research is to serve

as sources of data. Researchers have a duty to ‘protect the life, health, dignity, integrity,

right to self-determination, privacy and confidentiality of personal information of research

subjects’. Plagiarism is the use of others' published and unpublished ideas or intellectual

property without attribution or permission and presenting them as new and original rather

than derived from an existing source. Tools such as similarity check are available to aid

researchers detect similarities between manuscripts, and such checks should be done

before submission.

CHAPTER II: MANAGEMENT ASPECT

A. TYPE OF BUSINESS

A business is an association that utilizes monetary assets or contributions to give products


or administrations to clients in return for cash or different goods and services. This business is under
the assembling sort of business that offers intangible products.

Manufacturing businesses buy products with the intention of using them as materials in
making new products since there is a transformation of the products purchased combined with raw
materials, labor, and factory unit overhead.

This business uses unripe pineapple, peels and raw of cassava, chicken bones and Neem
oil. Which are the ingredients to produce 3JLR’s pesticide feed? And when the product is assembled
by the workers or employees, it will be converted to a new product that will provide an impact to the
market. Since the company has capital issues, this business will be a small scale commercial
enterprise.

B. FORM OF ORGANIZATION

This business will be considered as a form of ownership which can be easily established by
Partnership where the business is owned by two or more persons who are willing to give their share
to a business. This business creates an agreement to divide the profit to the people who contribute
resources to the entity. Depending on how the individuals agreed upon.

Basically, this kind of business will be referred to as a form of partnership where the persons
or the partners who are involved in this business are expected to do their part to make the legal
agreement, and also to make a decision to divide the profit and/or loss. And for the business, the
company makes a majority rule for the equal shares, and since the decisions were shared to know
the limitation about the business.

The Organization chart is a diagram that outlines the internal structure of a company. 3JLR

Inc. has one chief executive officer (CEO) which is the highest-ranking positioning in a company,

and their primary responsibilities include making major corporate choices, managing the overall

operations and resources of a company. Below the CEO are three managers wherein their task is to

manage a specific aspect of the company and make decisions particularly in the action that should

be taken. A Financial officer that manages finances and budgets, collects financial data and

assesses past performance, anticipates trends and developments, and plans policies accordingly.

The Marketing Manager ensures that customers' needs are met whilst maximizing the profits of a

company. And a Production Manager ensures that manufacturing processes run reliably and

efficiently.

Keeping in mind the end goal to give a reasonable comprehension about the particular areas

of the positions, and the separate tasks of the three managers of this business, their job

requirements, specification, responsibilities and functions are identified as follow:

1. Chief Executive Officer (CEO)

Requirements:

Bachelors or Master’s Degree at an accredited college or university in Business

administration.

6-10 years of corporate and managerial experience.

Can control all strategic and business aspects of the company.

Speak fluently in both English and Filipino

Required Skill(s): Microsoft Office, Leadership skills, technical skills,

management skills, conceptual skills, human relation, and communication skills

ICPM (Institute of Certified Professional Managers) is preferred

Responsibilities and Functions:

Creating the organization's vision, mission, and overall direction. Leading the

development and implementation of the overall organization's strategy.

Planning and implementing the key arrangement that aides the heading of the

business or association. Guaranteeing that the arrangement creation includes

significant contribution from the organization so that there is little pushback with

respect to the implementation.

CEO must guarantee that the association's pioneers encounter the outcomes

of their activities whether through reward and acknowledgment or execution

training and disciplinary activities.

Requirements:

Bachelor’s or Master’s Degree in Marketing or related fields is preferred.

a similar industry in two different firms.

Highly developed, demonstrated teamwork skills.

viability of ability markets before production of a product without a business case

or approach organized earlier.

3. Financial Manager

Requirements:

A bachelor's degree in finance, accounting, economics, or business

administration is often the minimum education needed for financial managers.

Have more than five years of experience in another business or financial

occupation, such as loan officer, accountant, auditor, securities sales agent, or

financial analyst.

Negotiation skills and the ability to develop strong working relationships

Good communication skills – both written and verbal

1.4 Training and Orientation

Company values the importance of newly hired employee orientation, as a medium of

establishing a positive impression, loyalty, and long-term employment. Orientation at company will

edify the newly hired employee regarding the company’s rules and regulations, its products and

procedures, the organizational culture and the likes. Most of the time new hire orientation is being

conducted during the newly hired employee’s first week of employment.

In order to make sure the success of the new hire orientation, it will be proactively conducted

1.4 Position, Duties and Responsibilities

Attached on the employment offer, is a detailed job description which includes but not limited to

the assigned responsibilities, any additional tasks that may be required, and job feedback. It will be

employee’s part.

1.5 Personnel File

As the employee signs the contract, he/she allows the company to collect and store his/her

personal information which includes but not limited to resume, job offer, job description, government

background check will be conducted as well regarding past employers (if there is any) and

educational background. This information will be then available for the employee, the company and

the business partners of the company.

1.6 Probation and At-will Employment

A newly hired employee will undergo a six (6) month probationary period to evaluate the

performance and opportunities that will be seen from him/her. Should the newly hired employee be

in need of an extension on the probationary period, an approval from the Director will be required.

The employee will be issued a written notice, once the request for extension is approved.

Prior to the completion of the six (6) month probationary period, the employee and/or the

company have the rights to cut or terminate the employment with the company be it personal or any

reason, considering the company’s rules and regulations and the public law. In such case, an

advance written notice may be required.

1.7 Compliance

Each employee should act accordingly based on the company’s policy, guideline, rules and

regulations. Any violation committed by an employee will have an equivalent corrective action.

Violations are classified in three (3), namely yellow, orange and red. Levels of violations and the

equivalent corrective actions are identified below:

1.8 Benefits and Vacations

Each employee is entitled to have 10 PTO (Paid Time-Off) credits after the probationary period

that he/she can use when requesting either a sick or vacation leave. PTO (Paid Time-Off) will roll-off

annually, unused credits are convertible to cash at the end of the year. Maximum credits that can be

converted is seven (7) days.

Employees that successfully completed the six (6) month probationary period are also entitled

to receive company premiums which include medical and dental assistance. Employees may also

add two (2) beneficiaries to receive the premiums.

1.9 Working Hours

All employees are expected to to work eight (8) hours a day, equivalent to forty (40) hours a

week. Excess hours of work rendered by the employee will be considered Over time, and will be paid

accordingly. Since the company is practicing the diverse work environment, flexible schedule are

offered to the employees.

1.10 Statutory Holidays

The Republic of the Philippines has (12) regular public holidays and other days for which staff

II. Separation or Departure

2.1 Termination

Employees are expected to comply to all the company’s policy, rules and regulations. Any

violation committed by the employee shall receive the equivalent corrective action. Any grave

offenses committed by the employee will result to immediate dismissal. The employee will

receive a written notice regarding the violation committed along with the exit form. Upon the

dismissal, the employee is required to return all of the company’s property including manuals

and identification cards.

2.2 Resignation

Should the employee decided to cut or terminate the employment with the company, he/she

is expected to submit a formal resignation letter thirty (30) days prior to the effective date, and

is required render for thirty (30) days. Upon resignation, the employee is required to return all

of the company’s property including manuals and identification cards.

F. Salary Rates and Benefits

It is mandated by law, that the fixing of the minimum wages applicable to different industrial

sectors, namely, non-agricultural, agriculture plantation, and no plantation, Cottage/handicraft, and

retail/service, depending on the number of workers or capitalization or annual gross sales in some

sectors which is stated in Republic Act No. 6727 (also known as the “Wage Rationalization Act”).

Assumptions made on this part of the study were based on the Labor Code of the Philippines. To

promote protection to labor, full employment, ensure equal work opportunities regardless of gender,

race, and creed.

1.13th month pay

All employees are eligible to receive their 13th Month Pay that will split into two payouts the

first half will be paid on the 2nd week of the month of May and the other half will be paid before

Christmas. The equivalent amount of the13th month that the employee will receive is computed on

a prorated basis which depends on the date of employment at the rate of the employee’s basic pay.

The employees who resigned or terminated before the date of the payout, will still receive the benefit

and will be added to their final pay together with the last salary not received.

2. Separation Pay

Separation pay is granted to any employee who decides to retire from the posts, given that the

employee has served the company for ten (10) years and up. The amount of the pay that the

employee will receive is equivalent to one (1) payout for every year of service, and a fraction of at

least six (6) months will be already considered as one (1) year

III. Leave Benefits

The employer is expected to provide eligible employees ten (10) paid time off credits which is

equivalent to five (5) days. This pertains to employees who successfully completed the six (6) months

probationary period. Employees are also entitled for government mandated leaves as listed below:

3.1 Maternity Leave

According to Republic Act 7322 Section 12-A, any female employee is entitle to be granted

of a maternity leave if she paid at least three (3) months of her contribution in the twelve (12)

month period preceding the semester of her childbirth, miscarriage, abortion and who is

currently employed shall receive a daily maternity benefit which is equivalent to 100% of her

present basic salary. All eligible female employees for this leave will be granted sixty (60) days

of leave if undergone normal delivery and seventy eight (78) days if undergone cesarean

section.

3.2 Sick Leave

Seven (7) days for the first six (6) months of service and additional 1 day every year

starting on the 2nd year. Maximum total sick leave is 15 days. Unused leave credits are

convertible to cash at the end of each year.

3.3 Paternity Leave

All married male employees are eligible to be granted of seven (7) working days up to four

(4) child births, this includes miscarriage of legitimate spouse to be used within sixty (60) days

from delivery/miscarriage.

3.4 Bereavement

Three (3) days of unpaid leave is granted to any employee, who has deceased immediate

family member which includes the employee’s children, parents, grandparents, brother, sister,

spouse, and parents-in-law (if married).

3.5 Solo Parent Leave

Seven (7) working days of unpaid leave is granted to a solo parent employee

(male/female), provided that they submitted a photocopy of their solo parent identification card.

3.6 Calamity Leave

Two (2) days leave is granted for employees who were affected by flood, fire and typhoon,

given that it is supported by a government declaration or company announcement.

3.7 Magna Carta for Women

Sixty (60) calendar days leave. This is given to all female employees who undergone

major surgery.

Dress Code Policy

3JLR Company derived Workplace’s objective in constitute a dress code policy to allow

employees to work comfortably without compromising one’s safety. All employees are requested to

practice professionalism at all times, as unexpected visits from the company business partners and

the likes may happen.

These results show that 26% of the respondents buy pesticides at a price range of 51-100

pesos, meaning they don’t usually spend a huge amount of money on pesticides. Both prices ranges

of 1-50 php and 101-150 php have the same percentage of respondents of 22%. 15% spend their

money buying pesticides at a price range of 151-200 php. 11% on the price range of 201-250 php

The technical study discusses how the products are to be produced, when these products
are to be produced, how much it will cost to produce the products, where to produce the products
and what technology to be used.

A. PRODUCT AND SERVICES DESCRIPTION

1. The Firm

3JLR Inc. is a start-up business that produces a pest-killer feed with no chemical

additives included. 3JLR Inc. designs and manufactures pest killers that serve as an

alternative to normal pesticides and insecticides. The company’s main product, CANEPI is

made up of only natural ingredients that are harmless to humans and to the environment.

CANEPI provides a safer and reliable form of insect killer that does not contaminate any

households and businesses. The company is located and in Brgy. Silangan, Cubao, Quezon

City. It is also the main target market of the company.

2. The Product

The company’s product is named as CANEPI Pest-Killer Feed, which is derived by

combining the three main ingredients Cassava, Neem seed oil, and Pineapple. The product

is a pest-killer feed that will look and smell like food to attract rats, cockroaches, mosquitoes,

flies and ants but will also contain an enzyme called bromelain extracted from pineapples, a

cyanogenic glycoside called linamarin extracted from raw cassava, and a limonoid called

Azadirachtin extracted from Neem seeds.

CANEPI Pest-Killer Feed is an organic, chemical-free pesticide feed made up of all-

natural ingredients, user-friendly, less harmful to humans, cheaper and definitely, a 100%

effective against annoying pests like rats, cockroaches, ants, mosquitoes and flies.

3. Product Variant

The company produces only one kind of product and therefore, has only one variant

as a start-up. It is a box containing five (5) pieces pest-killer feed, each piece contains

one (1.5) gram of ingredient.

Ingredients Description
Pineapple, Ananascomosus, is an herbaceous biennial
or perennial plant in the family Bromeliaceae grown for
Unripe Pineapple its edible fruit. It is a tropical fruit with a tough outer shell
that looks like a pine cone with edible yellow fruit inside.
The juice from unripe pineapples can cause severe
vomiting because of bromelain. Bromelain ingestion is
associated with a low incidence of adverse reactions,
including diarrhea, excess menstrual flow, nausea, skin
rash, and vomiting. Swelling of the mouth and cheeks
can result from eating large amounts of the fruit.
Manihot esculenta, is a perennial shrub in the family
Euphorbiaceae grown primarily for its storage roots

woody plant with erect stems and spirally arranged


simple lobed leaves with petioles (leaf stems) up to 30
cm in length. Raw Cassava contains Linamarin, it is a
glucoside of acetone 79 yanohydrins as is known to be
the toxic compound of cassava when ingested and
hydrolyzed inside the body releases hydrocyanic acid
which is a potent poisonous substance that can cause
death.

Neem oil is a vegetable oil pressed from the fruits and


seeds of the neem (Azadirachtaindica),
an evergreen tree which is endemic to the Indian

subcontinent and has been introduced to many other
areas in the tropics. It is the most important of the
commercially available products of neem for organic
farming, insect repellant and medicines.
Honey is a sweet, viscous food substance produced by
bees and some related insects. Bees produce honey
from the sugary secretions of plants (floral nectar) or
other insects (aphid honeydew) through regurgitation,

Cornstarch
Cornstarch, sometimes referred to as corn flour, is a

The process starts with the worker wearing proper attire such as apron, mask, gloves, and

hairnets for proper sanitation. The raw materials were then prepared. It is shown above how the

process was done and how the researchers came up with the product which involves a series of

peeling, slicing and crushing of ingredients such as pineapple and cassava. The ingredients where

then mixed, cooked, molded and wrapped. The finished product will undergo a series of inspection

to make sure that the product is good to go. Lastly, it will then be packed and stored.

3. Slicing and Crushing

Slicing involves cutting with or as if with a knife.

Crushing involves squeezing or forcing by pressure so as to alter or destroy

structure, or to reduce to particles by pounding or grinding.

Mixing is the combining or blending of ingredients into one mass or mixture.

Cooking involves the practice or skill of preparing food by combining, mixing, and

heating ingredients.

5. Inspection and Packaging

Inspection is a critical appraisal involving examination, measurement, testing,

gauging, and comparison of materials or items. An inspection determines if the material or

item is in proper quantity and condition, and if it conforms to the applicable or specified

requirements.

Packaging is the science, art and technology of enclosing or protecting products for

distribution, storage, sell, and use. Packaging also refers to the process of designing,

evaluating, and producing packages.

I. THE PROJECT LOCATION

The above shown figure shows the location of the production area and the target location of

the company.

The proposed project will be situated at a 16 sq. meter production area located at Unit I Lot

16 Potsdam St., Cubao, Quezon City. The proponents will be leasing a studio type room area where

the proposed planned layout for the production and office region will be installed on the

aforementioned location.

Below are the proponents’ major considerations in determining the project location:

On Climate:

In terms of environmental aspects, preferred location is suitable for the project because

factors such as air temperature, humidity, wind, rainfall, dusts and fumes as well as extremities (i.e.,

flood and earthquakes) are usually in average and in minimum.

On Site and Terrain:

The location is within Brgy. Silangan, Cubao, Quezon City, which contains a total of 1,340

homes, 1120 are households, and 220 are store and business.

On Transportation and Facilities:

The location of the 3JLR Inc. can access easily to the right transportation needed by the

customers such as jeepneys and other public vehicle. Facilities are in good quality and can be well

provided since it is in the middle of a modern community already.

On Fiscal and Legal Regulations:

Since the location is within Quezon City, the labor and rental costs are higher compared to

the nearby rural rate. The 3JLR Inc. agree to take the place even it has a cost of Php 20,000 monthly

which has a Ground Floor Area of 72 sq. m.

J. MATERIAL HANDLING DESIGN

In processing the raw materials, upon conveyance, the appointed worker will verify if the

delivered supplies are correct and in good condition. The raw materials will undergo quality check

from the assigned staff and will then sort the raw materials to observe how broad the sum or units

have been conveyed avoiding any delay. Things that are recognized will be stored to the stockroom

and will be set up for the availability for the first process. All through the live procedure of

manufacturing the CANEPI Pest-killer feed, there would be manual treatment of raw materials when

the dispensed laborer bunches the material for each of the progression required for the distinctive

strides in creating the CANEPI Pest-killer feed. On all process and activities involved in the making

consumption per capita in the country is 164 liters per day. This equates to 0.164 cubic meters in

one day. According to Maynilad, under the consumption of 10 cubic meters and above will be billed

W. PACKAGING REQUIREMENTS

Packaging involves wrapping up of the product for protection and for preservation of the

product. It protects the product during transportation and distribution, and during storage in the

warehouse. It also contributes to the presentation of the product, since customers tend to be

convinced to buy a product when the packaging is attractive and appealing.

In the case of the company, it limits its packaging by wrapping the final product within a cling

wrap then contained inside a simple eco-friendly white box to represent its socio-economic principles.

Y. WASTE AND WASTE DISPOSAL

Waste and Waste Disposal Proper waste management is a must especially in a

manufacturing company. Maintaining the sanitation of the workplace can help avoid legal issues that

would affect the growth of the institution.

Generation of Waste

The waste of the company is divided into two (2); The Domestic Waste and Electronic Waste.

Domestic Waste includes papers, dusts, food waste, and other waste that the company can possess.

On the other hand, the Electronic Waste includes all the equipment, tools, and other facilities that

are deficient and needs to be changed from the production area of the company itself. Normally,

Domestic Waste is way higher than the Electronic Waste of the 3JLR Inc.

Waste Disposal

The Domestic Waste will be segregated into biodegradable and non-biodegradable. Non-

biodegradable wastes will be disposed weekly based on the Barangay Waste Collector's schedule.

The biodegradable wastes will be disposed and can be sold to farmers which they can use as

fertilizer. The proceeds from the sale of the biodegradable wastes can be used as an additional profit

for the 3JLR Inc. The compost pit will be placed away from the water source, from crops and

vegetation, and residences. The electronic waste will be collected by the recycling groups such as

junk shops and others.

A. Starting a business in the Philippines

Doing business in the Philippines, either as single proprietorship, partnership or corporation,

B. Registering with the Bureau of Internal Revenue

For taxation purposes, every business enterprise has to register with the Bureau of Internal

Revenue (BIR) before the commencement of the business operation. The procedures in registering

at the BIR are the following:

The Social Security Program provides replacement income for workers in times of disability,

1. Employee

a. Private employees, whether permanent, temporary or provisional, who are not over 60

years old

b. Household helpers earning at least P1, 000 a month

c. Filipino seafarers upon signing of the standard contract of employmentbetween the

seafarer and the manning agency which, together with the foreign ship owner, act as

employers.

d. Filipino employees of foreign governments, international organizations, or their wholly-

owned instrumentality based in the Philippines, which entered into an administrative

e. Parent, spouse or child below 21 years of age, of the owner of a single proprietorship

business

2. Employers

a. Employers, or any person who uses the services of another person in business, trade,

industry or any undertaking a social, civic, professional, charitable and other non-profit

organizationwhich hire the services of employees are considered “employers.”

b. Foreign governments, international organizations or their wholly owned instrumentality

such as embassies based in the Philippines.

3. Self-Employed

Self-employed persons regardless of trade, business occupation, with an income of at least

P1,000 a month, and who are not over 60 years old. They include self-employed

professionals; business partners, single proprietors and board directors; actors, directors,

scriptwriters and news reporters who are not under any employer-employee relationship;

professional athletes, coaches, trainers and jockeys; farmers and fisher folks; and workers

in the informal sector such as cigarette vendors, watch-your-car boys, and hospitality girls.

Voluntary Coverage

1. Members who are separated from employment or ceased to be self-employed or overseas

Filipino workers or non-working spouse who would like to continue paying contributions.

2. A Filipino recruited in the Philippines by a foreign-based employer for employment abroad

or one who legitimately entered a foreign country (i.e. tourist, student) and is eventually

employed.

3. A person legally married to a currently employed and actively paying SSS member who

devotes full time in the management of household and family affairs may be covered on a

voluntary basis provided there is the approval of the working spouse. The person should

never have been a member of the SSS. The contributions will be based on 50 percent of the

working spouse’s last posted monthly salary credit but in no case shall it be lower than

P1,000.

General Requirements in the Application for SSS

How can one register with the SSS? A person registering with the SSS for the first time as

a prospective employee should accomplish SSS Form E-1 (Personal Record) and submit it together

with the original/certified true copy and photocopy of any of the following: baptismal, birth certificate,

driver’s license, and passport, Professional Regulation Commission (PRC) Card or Seaman’s Book.

In the absence of these documents, any two of the following, one of which recent photo and date of

birth, are acceptable.

For Employers

Single Proprietorships

An owner of a single proprietorship business should accomplish and submit SSS Form R-1

(Employer Registration) and R-1A (Employment Report).

Partnerships

Any of the partners of a partnership firm should accomplish SSS Forms R-1 (Employer Registration)

and (R-1A (Employment Report) and submit these forms together with a photocopy of the Articles of

Partnership. The original copy of the Articles of partnership must be presented to the SSS for

Authentication purposes.

Corporations

A corporation must accomplish SSS Forms R-1(Employer Registration) and R-1A (Employment

Report) signed by its President or any of the corporate officers and submit these forms together with

a photocopy of the Articles of Incorporation. The original copy of the Articles of Incorporation must

be presented to the SSS for authentication purposes.

Household-Helper Employers

A household employer who has an existing SS number should use this SS number as the employer

number and shall be used in all transactions with regard to the household helper. If no existing SS

number, the household employer should get an SS number by accomplishing SSS Form E-1

(Personal Record).

For Self-Employed Members

A self-employed person should accomplish SSS Form RS-1 (Self-Employed Data Record) and

submit it together with a photocopy of any of the following baptismal, birth certificate, driver’s license,

passport, Professional Regulation Commission (PRC) Card, Seaman’s Book. I n the absence of

these documents, any two of the secondary documents mentioned earlier. A self-employed member

who has employees, should also register as an employer and secure an employer ID number which

the company must use in all transactions with the SSS.

REPUBLIC ACT NO. 10068

AN ACT PROVIDING FOR THE DEVELOPMENT AND PROMOTION OF ORGANIC


AGRICULTURE IN THE PHILIPPINES AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1 Title. - This Act shall be known as the "Organic Agriculture Act of 2010".

Section 2 Declaration of Policy. - It is hereby declared the policy of the State to promote, propagate,
develop further and implement the practice of organic agriculture in the Philippines that will
cumulatively condition and enrich the fertility of the soil, increase farm productivity, reduce pollution
and destruction of the environment, prevent the depletion of natural resources, further protect the
health of farmers, consumers, and the general public, and save on imported farm inputs. Towards
this end, a comprehensive program for the promotion of community-based organic agriculture
systems which include, among others, farmer-produced purely organic fertilizers such as compost,
pesticides and other farm inputs, together with a nationwide educational and promotional campaign
for their use and processing as well as adoption of organic agriculture system as a viable alternative
shall be undertaken.

The State recognizes and supports the central role of the farmers, indigenous people and other
stakeholders at the grassroots in this program.

Section 3 Definition of Terms. - For purposes of this Act, the following terms shall be defined as
follows:

(a) Organic refers to the particular farming and processing system, described in the
standards and not in the classical chemical sense. The term "organic" is synonymous in
other languages to "biological" or "ecological". It is also a labeling term that denotes products
considered organic based on the Philippine National Standards for organic agriculture.

(b) Organic agriculture includes all agricultural systems that promote the ecologically sound,
socially acceptable, economically viable and technically feasible production of food and
fibers. Organic agricultural dramatically reduces external inputs by refraining from the use of

chemical fertilizers, pesticides and pharmaceuticals. It also covers areas such as, but not
limited to, soil fertility management, varietal breeding and selection under chemical and
pesticide-free conditions, the use of biotechnology and other cultural practices that are
consistent with the principles and policies of this Act, and enhance productivity without
destroying the soil and harming farmers, consumers and the environment as defined by the
International Federation of Organic Agricultural Movement (IFOAM): Provided, That the
biotechnology herein to shall not include genetically modified organisms of GMOs.

(c) Organic production system is a system designed to:

(1) enhance biological diversity within the whole system;

(2) increase soil biological activity;

(3) maintain long-term soil fertility;

(4) recycle wastes of plant and animal origin in order to return nutrients to the land,
thus minimizing the use of nonrenewable resources;

(5) rely on renewable resources in locally organized agricultural system;

(6) promote the healthy use of soil, water and air as well as minimize all forms of
pollution thereto that may result from agricultural practices;

(7) develop and promote the use of biotechnology in agriculture;

(8) handle agricultural products with emphasis on careful processing methods in


order to maintain the organic integrity and vital qualities of the product at all stages;
and

(9) become established on any existing farm through a period of convention, the
appropriate length of which is determined by site-specific factors such as the history
of the land, and type of crops and livestock to be produced.

(d)Conversion period refers to the time between the start of the organic management and
the certification of crops, animal husbandry or a aquaculture products as organic.

(e) Biodegradable wastes refer to organic matter for compost/ organic fertilizer for the
organic cultivation, farming of food crops and includes discards segregated farm
nonbiodegradable wastes coming from the kitchen/household (leftovers, vegetables and fruit
peelings and trims, fish/fowl cleanings, seeds, bones, soft paper used as food wrap and the
like), yard or garden (leaves, grasses, weeds and twigs), market (wilted, decayed or rotten
vegetables and fruits, fish/fowl cleanings, bones) and farm wastes (grass clippings, dead or
decayed plants, leaves, fruits, vegetables, branches, twigs and the like).

(f) Ecologically-sound refers to a state, quality or condition of a product, practice, system,


development mode, culture, environment and the like, in accord with the 1987 Philippine
Constitution, and as expounded in the above definition of organic agriculture.

(g) Commercialization is process of including a new agricultural and fishery technology either
as product, process or service that has undergone the intensive innovative activities of
assessment, promotion and transfer for economic benefit.

(h) Certification is the procedure by which official certification bodies or officially recognized
certification bodies provide written or equivalent assurance that foods or food control
systems conform to requirements.

(i) Accreditation is the procedure by which a government agency having jurisdiction formally
recognizes the competence of an inspection and/or certification body to provide inspection
and certification services.

(j) First party certification is defined as when the certification criteria and rules are set and
monitor/enforced by the producer or company itself.

(k) Second party certification is defined as when the certification criteria and rules are set by
buyers or industry organizations.

(l) Third party certification or independent certification is defined as when the firm requires
that its supplies meet a certain standard and requests an independent organization that is
not involved in the business relationship to control the compliance of the suppliers.

(m) Organic food establishment refers to an entity, whether local or foreign, that produces
inputs acceptable for organic agriculture.

Section 4 Coverage. - The provisions of this Act shall apply to the development and promotion of
organic agriculture and shall include, but not limited to, the following:

(a) Policy formulation on regulation, registration, accreditation, certification and labeling on


organic agriculture;

(b) Research, development and extension of appropriate, sustainable environment and


gender-friendly organic agriculture;

(c) Promotion and encouragement of the establishment of facilities, equipment and


processing plants that would accelerate the production and commercialization of organic
fertilizers, pesticides, herbicides and other commercialization of organic fertilizers,
pesticides, herbicides and other appropriate farm inputs; and

(d) Implementation of organic agricultural programs, projects and activities, including the
provision and delivery of support services with focus on the farmers and other stakeholders.

Section 5 National Organic Agricultural Program. - There is hereby established a comprehensive


organic agricultural program through the promotion and commercialization of organic farming
practices, cultivation and adoption of production and processing methods which have already been
developed, or to be developed, continuing research and upgrading thereof, the capacity building of
farmers and the education of consumers thereon, the extension of assistance to local government
units (LGU's), peoples' organizations (POs), nongovernment organizations (NGOs) and other
stakeholders including individuals and groups who are practicing and promoting these methods as
well as those who are willing to do other pertinent activities, and documentation and evaluation of
the program.

Section 6 National Organic Agricultural Board (NOAB). - To carry out the policy and the program
provided in this Act, there is hereby created a NOAB which shall be the policy-making body and shall
provide direction and general guidelines for the implementation of the National Organic Agricultural
Program. The NOAB shall be attached to the Department of Agriculture (DA).

The NOAB shall ensure the full participation of POs, NGOs and the general public through
coordination and consultative mechanisms such as, but not limited to, public hearings, meetings and
joint projects.

Section 7 Composition of the NOAB. - The NOAB shall consist of:

(a) The Secretary of Agriculture, or his duly authorized permanent representative, with a
rank of Undersecretary, as Chairperson;

(b) The Secretary of the Interior and Local Government, or his duly authorized permanent
representative, as Vice Chair;

(c) The Secretary of Science and Technology, or his duly authorized permanent
representative;

(d) The Secretary of Environment and Natural Resources, or his duly authorized permanent
representative;

(e) The Secretary of Education, or his duly authorized permanent representative;

(f) The Secretary of Agrarian Reform, or his duly authorized permanent representative;

(g) The Secretary of Trade and Industry, or his duly authorized permanent representative;

(h) The Secretary of Health, or his duly authorized permanent representative;

(i) Thee (3) representatives from the small farmers; and

(j) A representative each from the NGOs involved in sustainable agriculture for at least three
(3) years; agricultural colleges and universities; and private sector or agribusiness firms; as
members.

The designated aforementioned representatives of the various departments shall be occupying


positions not lower than a bureau director level and shall be on a conterminous basis.

The representatives of small farmers and NGOs and of agricultural colleges and universities shall be
chosen by the Secretaries of Agriculture and Science and Technology, respectively, from among
nominees submitted by their respective national organizations. These representatives must be
conversant in organic agriculture and committed to the policies and programs provided under this
Act.

The existing National Organic Agriculture Board created pursuant to Executive Order No. 481 shall
continue to function until the new NOAB created herein has been constituted pursuant to Section 8
hereof.

Section 8. Organization of the NOAB. - Within sixty (60) working days from the effectivity of this Act,
the national organizations of small farmers, of NGOs and of agricultural colleges and universities
shall submit their respective nominees to the Secretary of Agriculture and the Secretary of Science
and Technology, as the case may be, who shall evaluate the qualifications of the nominees and
appoint the most members to the NOAB.

The Chairperson shall call the members of the NOAB, or a majority thereof if not all have been
designated, to a meeting to organize themselves and prescribe its rules and procedure for the
attainment of the objectives of this Act. A majority of all the members of the NOAB shall constitute a
quorum.

The NOAB shall also determine its budget, including travel expenses, allowances and per diems of
its nongovernment members when attending official NOAB meetings or attending to maters assigned
to them subject to accounting and auditing rules and regulations.

Section 9 Powers and Functions of NOAB. - The NOAB shall have the following powers and
functions:

(a) Formulate policies, plans, programs and projects to develop and promote organic
agriculture, production, processing and trade;

(b) Oversee the successful implementation of the National Organic Agricultural Program;

(c) Identify sources of financing to expand organic agriculture;

(d) Monitor and evaluate the performance of programs for appropriate incentives;

(e) Undertake measures for the international recognition of local certification of organic
products;

(f) Call upon any government agency to carry out and implement programs and projects
identified by the NOAB;

(g) Call upon private sectors, POs and NGOs and the academe to provide advice on matters
pertaining to organic agriculture and conduct of capability-building initiatives to farmers,
producers, extension workers, consumers and other stakeholders in agriculture sector in
coordination with the Agricultural Training Institute;

(h) Submit annual and other periodic reports to the President, Secretary of the DA and
Congress of the Philippines through the Congressional Oversight Committee on Agricultural
and Fisheries Modernization (COCAFM);

(i) Promulgated such rules and regulations and exercise such other powers and functions
as may be necessary to carry out effectively the purposes and objectives of this Act; and

(j) Perform such functions as may be necessary for its effective operations and for the
continued enhancement, growth or development of organic agriculture.

Section 10 The Bureau of Agriculture and Fisheries Product Standards (BAFPS) of the DA. - The
BAFPS of the DA shall be strengthened and empowered in terms of establishing functional divisions
and incremental staffing to serve as the national technical and administrative secretariat of the NOAB
with the member agencies providing additional staff support as the need arises.

Section 11 Functions, Duties and Responsibilities of the BAFPS, in addition to its existing functions
and responsibilities shall perform the following functions, duties and responsibilities for purpose of
this Act:

(a) Implement organic agriculture programs and projects approved by the NOAB;

(b) Update the NOAB on the status of the programs, projects and activities undertaken for
the development and promotion of organic agriculture;

(c) Create effective networking with the various stakeholders involved in organic production;
and

(d) Perform such other functions, duties and responsibilities as may be necessary to
implement this Act and as directed by the NOAB.

Section 12 Work Plan. - In line with the national Organic Agricultural Program, the BAFPS shall
submit to the Board for approval the following:

(a) A plan of bringing the program down to the grassroots, utilizing available personnel and
facilities on the local level and those of LGUs;

(b) A pattern of cooperation and mutual assistance with LGUs, POs and NGOs, which will
maximize people empowerment and participatory approaches to program formulation,
implementation and monitoring; and

(c) A schedule of short-term, medium-term and long-term targets on research and


development, marketing, trade promotion/initiatives, capacity building, among others.

Section 13 Organic Agriculture and Protection of the Environment. - The NOAB shall constantly
devise and implement ways and means not only of producing organic fertilizers and other farms
inputs and needs on and off the farm but also of helping to alleviate the problems of industrial waste
and community garbage through disposal through appropriate methods of sorting, collecting and
composting. The BAFPS shall conduct continuing studies, with consultations among the people and
officials involved as well as POs and NGOs, in order to advise local governments, from the barangay
to the provincial level, on the collection and disposal of garbage and waste in such a way as to
provide raw materials for the production of organic fertilizers and other farm imputs.

Section 14 Local Executive Committees. - Every provincial governor shall, insofar as practicable,
form a provincial technical committee, and which shall, in coordination with and assistance of the
BAFPS/DA - Regional Field Units (RFUs) implement activities in line with the National Organic
Agricultural Program within each province.

Every municipal mayor shall likewise, insofar as practicable, form a municipal technical committee
for purposes of implementing activities in line with the National Organic Agricultural Program within
each municipality.

A local government unit that intends to shift its area of responsibility to organic agriculture must
ensure that local industries have been adequate informed and consulted and that a viable plan to
ensure supply for vulnerable industries is in place.

The governors shall monitor implementation of and compliance with this Act within their respective
jurisdictions.

Section 15. Accreditation of Organic Certifying Body. - The BAFPS is hereby designated and
authorized to grant official accreditation to organic certifying body or entity. The BAFPS is tasked to
formulate the necessary rules and procedures in the accreditation of organic certifying
body: Provided, That there shall be atleast one (1) accredited organic certifying body each in Luzon,
Visayas and Mindanao or in case of only (1) organic certifying body is accredited, it shall have at
least one (1) satellite office or processing unit each in Luzon, Visayas and Mindanao

Section 16. Registration of Organic Food and Organic Input Producers. - All organic food and input
establishments must register with the director, BAFPS, registration under this section shall begin
within ninety (90) days of the enactment of this Act. Each such registration shall be submitted to
director through an electronic portal and shall contain such information as the director by guidance
may determine to be appropriate. Such registration shall contain the following information:

(a) The name, address and emergency contact information of each organic food or input
establishment that the registrant owns or operates;

(b) The primary purpose and business activity of each organic food or input establishment,
including the dates of operation if the organic food establishment is seasonal;

(c) A list of the organic food or input produced and corresponding brand names;

(d) For organic food establishment, the name, address and contact information of the organic
food certifying body that certified the organic products sold by the company;

(e) An assurance that the registrant will notify the director of any change in the products,
function or legal status of the domestic food establishment (including cessation of business
activities) not later than 30 days after such change; and

(f) For organic input producers, a list of materials used in the production of each particular
input

Section 17 Labeling of Organic Produce. - The label of organic produce shall contain the name, logo
or seal of the organic certifying body and the accreditation number issued by the BAFPS. Only third
party certification is allowed to be labeled as organically produced.

Section 18 Retailing of Organic Produce. - Retail establishments or stores of organic produce shall
designate a separate area to display the organic produce to avoid mixing it with non-organic produce.

Section 19 Availability of Trading Post for Organic Inputs. - Local chief executives shall establish,
as far as practicable, at least one (1) trading post for organic inputs for every LGU in the area of
jurisdiction.

Section 20 Research, Development and Extension. - The Bureau of Agricultural Research (BAR),
as the lead agency, shall coordinate with the other agencies of the DA, the Department of Agrarian
Reform (DAR), the Department of Science and Technology (DOST), the Department of Education
(DepED), the Department of Interior and Local Government (DILG), the strategic agricultural-based
sate universities and colleges (SUCs), including private organizations, to develop, enhance, support
and consolidate activities and related technologies for the formulation and implementation of a
unified and integrated organic agriculture RDE plan and programs for the national to the field level.
The organic agriculture RDE plans and programs shall include, but not limited to the following:

(a) Research, development and commercialization of appropriate, innovative and viable


organic agricultural technologies;

(b) Nationwide promotion of developed and commercially viable biodegradable farm wastes
and by-products through various extension strategies to accelerate the production, use and
distribution of organic fertilizers; and

(c) Conduct research for market development, policy formulation, regulation and
certification.

Section 21. Creation of Organic Agriculture RDE Network. - An organic agriculture RDE network
shall be organized by the BAR, composed of research and educational institutions, LGUs,
nongovernment agencies and the recognized association of organic fertilizer manufacturers and

distributors, agricultural engineers, agriculturists, soil technologists, farmers group and/or


associations.

Section 22. RDE Centers. - National, regional and provincial organic R & D and extension centers
shall be organized, established and integrated as a major component of the existing RDE centers of
DA, the DOST, the DENR, SUCs and the LGUs. These will be strengthened and enhanced to
spearhead the integrated program to develop and promote organic agriculture throughout the
country.

Section 23. Organic Agriculture in the Formal and Non-formal Sectors. - The National Government,
through the DepED and in coordination with concerned government agencies, NGOs and private
institutions, shall strengthen the integration of organic agriculture concerns in school curricula at all
levels.

Section 24. Incentives. - The government shall extend incentives for the production and propagation
of organic farm inputs by maximizing their use in all government and government supported
agricultural production, research and demonstration programs. Incentive shall also be provided to
farmers whose farms have been duly certified as compliant to the Philippine National Standards
(PNS). Further, the DA may give cash reward in recognition of the best organic farm in the country.
The DA, the DAR, the DOST, the DILG, the Department of Trade and Industry (DTI), the DepED, the
Department of Finance (DOF), the Land Bank of the Philippine (LBP), and other government lending
and non-lending institutions shall also assist organic input producers and organic farmers through
the provision of adequate financial, technical, marketing and other services and resources. These
include, but shall not be limited to, the following:

(a) Exemption from the payment of duties on the importation of agricultural equipment,
machinery and implements as provided under Republic Act No. 9281, which amends
Republic Act No. 8435 or the Agriculture and Fisheries Modernization Act (AFMA);

(b) Identification by LGUs of local taxes that may be offered as incentives to organic input
production and utilization;

(c) Provision of preferential rates and special window to organic input producers and users
by the LBP;

(d) Subsidies for certification fees and other support services to facilitate organic
certification;

(e) Zero-rated value-added tax (VAT) on transactions involving the sale/purchase of bio-
organic products, whether organic inputs or organic produce; and

(f) Income tax holiday and exemption for seven (7) years, starting from the date of
registration of organic food and organic input producers on all income taxes levied by the
National Government.

The tax incentives shall be given only to purely organic agriculture entities/farmers and shall be
subject to the accreditation of the BAFPS and periodic reporting by the BAFPS to the DOF: Provided,
That the said incentives shall be available only to micro, small and medium enterprises as defined
under Section 3 of Republic Act No. 9501 or the Magna Carta for Micro, Small and Medium
Enterprises.

Section 25. Appropriations. - The sum of Fifty million pesos (Php50, 000, 000.00) and the existing
budget for the promotion of organic farming of the DA is hereby appropriated for the initial year of
implementation of this Act. Thereafter, such amount as may be necessary for the continuous
operation of the NOAB and the implementation of the program shall be included in the annual
General Appropriation Act (GAA).

The NOAB is hereby authorized to solicit and accept assistance or facilities in the form of grants from
individuals and entities here and abroad, and to utilize these funds and resources for purposes of
this Act, subject to the usual budget, accounting and auditing rules and regulations.

Section 26. Penal Provision. - Any person who willfully and deliberately:

(a) obstructs the development of propagation of organic agriculture, or the manufacture,


production, sale or use of organic agricultural inputs;

(b) refuses without just cause to extend the support and assistance required under this Act;
and

(c) mislabels or claims that the product is organic when it is not in accordance with the
existing standards for Philippine organic agriculture or this Act shall, upon conviction, be
punished by imprisonment of not less than one (1) month nor more than six (6) months, or
a fine of not more than Fifty thousand pesos (P50, 000.00), or both, at the discretion of the
court. If the offender is a corporation or a juridical entity, the official who ordered or allowed
the commission of the offense shall be punished with the same penalty. If the offender is in
the government service, he shall in addition, be dismissed from the office.

Section 27. Implementing Rules and Regulations. - The NOAB shall adopt rules and regulation to
implement the provisions of this Act within ninety (90) days from the effectivity of this Act and submit
the same to the COCAFM for review and approval. In the drafting of the implementing rules and
regulations, the DOF shall be consulted in connection with the tax incentive provided under Section
24 hereof.

Section 28. Annual Report. - The NOAB shall render an annual report to both House of Congress
on the accomplishment of the program. A review on the viability of the program shall be made by the
concerned agencies after three (3) years of its implementation.

Section 29. Congressional Oversight Committee. - The COCAFM shall be the congressional
oversight committee for purposes of this Act. The COCAFM shall review and approve the
implementing rules and regulations of this Act and also perform the following functions:

(a) Monitor and ensure the proper implementation of this Act.

(b) Review the proper implementation of the programs on organic agriculture and the use of
its funds;

(c) Review the performance of the NOAB; and

(d) Such other functions it deems necessary.

Section 30. Separability Clause. - if any provisions of this Act is declared invalid or unconstitutional,
the other provisions not affected thereby shall remain in full force and effect.

Section 31. Repealing Clause. - All laws, presidential decrees, executive orders, presidential
proclamations, rules and regulations or parts thereof contrary to or inconsistent with this Act are
hereby repealed or modified accordingly.

Section 32. Effectivity. - This Act shall take effect fifteen (15) days following its publication in at least
two (2) newspapers of general circulation or in the Official Gazette, whichever comes first.
