SUBJECT : REQUEST FOR PAYMENT OF CATERING SERVICES OF BARANGAY

AGUSTIN NAVARRA ENVIRONMENTAL CONSERVATION
ASSOCIATION (BANECA)

This is refers to your memorandum relative to your request to waive the PhilGeps
registration of Barangay Agustin Navarra Environmental Conservation Association (BANECA) in
order for you to facilitate the payment of its catering services rendered during the conduct of
exposure trip in the province of Capiz of the partner-People’s Organizations of research project
on development of mangrovetum in support to biodiversity conservation towards ecotourism
held last December 2018.

Please be informed that under Rule III, Section 8 of the Revised Implementing Rules
and Regulations of Republic Act (RA) 9184, PhilGeps registration is necessary in the conduct of
procurement procedure, thus government agencies, as well as suppliers, contractors,
manufacturers, distributors and consultants, are mandated to register with PhilGeps in the
conduct of procurement of goods, civil works and consulting services. In this connection, it is
our perception that BANECA must register with PhilGeps to be able to participate in the
procurement activities of PhilGeps.

Accordingly, BANECA’s registration is disapproved due to the incorrect/ invalid

Registration Number because its registration is with the Department of Labor and Employment
(DOLE), and those organizations registered with the Securities and Exchange Commission
(SEC) are eligible to PhilGeps registration.

In this regard, you are hereby advised to write a letter to the ERDB-Bids and Awards
Committee (BAC) stating justification on why this office would facilitate the payment of services
rendered by BANECA notwithstanding their non-compliance with PhilGeps registration. You are
likewise advised to coordinate with ERDB-AFMD-GS to assist your office with its future
transactions that needs PhilGeps registration.

Please be informed further that commission of the same or similar acts in the future will
be dealt with accordingly. The Center is further admonished to be more diligent in complying
with the directives of RA 9184.
