As per Office Report dated 8-3-2018, service is complete on


the sole respondent but nobody has entered appearance on his behalf
so far.
This petition under Section 25 of the Civil Procedure Code,
1908 read with Order XLI of the Supreme Court Rules, 2013 has been
filed by the petitioner (wife) for transfer of Application
No.38/17/2017 titled as “Sumit Kaushik vs. Nisha Kaushik” pending
before the Court of Additional District and Sessions Judge, Serial
No.1, Tijara, Alwar, Rajasthan to any court of competent
jurisdiction in Gurugram, Haryana.
After having heard the learned counsel appearing for the
petitioner and taking into consideration the grounds taken in the
transfer petition, we direct transfer of Application No.38/17/2017
titled as “Sumit Kaushik vs. Nisha Kaushik” pending before the
Court of Additional District and Sessions Judge, Serial No.1,
Tijara, Alwar, Rajasthan to any court of competent jurisdiction in
Gurugram, Haryana.
Let the record of the case be transferred without delay.

The Transfer Petition is allowed in the afore-stated terms.

We have heard the learned counsel appearing for the parties.

During the course of hearing, learned counsel appearing for
the   parties   state   that   their   clients   may   be   allowed   to   resolve
their disputes through mediation.
In   view   of   request   made,   we   direct   that   the   parties   shall
approach the Supreme Court Mediation Centre on Wednesday, the 30th
November, 2016. 
The   Supreme   Court   Mediation   Centre   shall   make   an   effort   to
settle the disputes between the parties and submit its Report to
this Court.
List   the   matters   immediately   after   receipt   of   the   Supreme
Court Mediation Centre's Report.
