(a) Subject matter of information:

Marking of (Right to Information) RTI Applications by the DTO before


being diarised, fee in cash, as well as implementation of other provisions
of RTI Act by DTO office, Ludhiana.

(b) The period to which the information relates:

Currently applicable in the DTO Office, Ludhiana.

(c) Specific details of information required:

Please provide the following information seriatim as requested in the


following paras:

(i) A copy of the order(s) and/or notification(s) and/or any other


document(s), currently in force, under the authority of which the DTO,
Ludhiana, requires that the applications filed under the RTI Act be got
marked/approved from him before filing subjecting the applicants to
undue harassment. If practice of marking is not prevailing, please deny
the same expressly;

(ii) A copy of the relevant Rule(s) that empower(s) the issuing authority to issue the
directions mentioned in Para (i) above;

(iii) Please mention whether any officer has been designated as PIO in DTO office for
RTI matters and any separate counter has been arranged for entertaining the
applications. If designated, has this fact been displayed any where in the office
premises? If not designated so far, please mention the reasons for that and the
time likely to be taken for doing so.

(iv) According to the RTI Act and Rules made thereunder, the fees in cash for
RTI application/information should be received then & there under due
receipt without delay, but an applicant approaching the DTO office,
Ludhiana, with application fees in cash, is directed to deposit fee on the
main counter dealing with other matters like Registration Certificates
(RCs), Driving Licences, Road Tax, Fines etc., that too for a limited time
during the day, and where long queues of people are a common
phenomenon, whereas the RTI Act provides for submission of
applications throughout the whole working day. Please mention the
reasons why you (the PIO) have not made separate arrangement for
receiving cash from RTI applicants so far.

(v) Please mention the detail of voluntary disclosure made by the DTO
proactively u/s 4 of the RTI Act. Also mention the mode of dissemination
of those disclosures to public. If no disclosures have been made so far,
please mention the reasons for that.

(vi) The Applicant would, at his discretion, also like to inspect, either himself
or through his representative, all the records (both in electronic and
paper form), documents, notes etc. relied on by your office for supplying
the information. Please mention the working hours of your office and the
name, contact details and exact location of the record officer/other
officials in whose custody the said records are available and who would
facilitate the inspection thereof. The undersigned requests you to provide
certified copies/extract of records, documents, letters, communications,
notes, electronic documents, e-mails and relevant portion/noting of any
or all the documents required by the him after the inspection.
