University of the Philip-
pines (PUP) walked out
of their classes on November 19 and
declared a weeklong student strike,
marking the beginning of a series of
nationwide mobilizations against the
impending cut in the budget for state
universities and colleges (SUCs).
The students draped the main
gate of the school with a “We are on
strike” banner and held programs and
education discussions on the state of
the education sector.
Faculty, employees and even high-
ranking university officials including
PUP President Dante Guevarra
joined the students’ protest march.
In a November 18 press conference,
Guevarra said he “fully supports” the
strike and the call for higher state
subsidy.
The six-day strike continues on its
fifth day and will end on November
26. The PUP mobilization is first in the
series of strikes among SUCs including
UP, Eulogio Amang Rodriguez
Institute of Technology and Philippine
Normal University.
The nationwide strike was
prompted by the reduced SUC
budget for 2011 that the House of
Representatives (HOR) approved
without amendments last November
8, according to the National Union of
Students of the Philippines (NUSP).
In the HOR-approved budget, only
P23.4 billion was allocated for all 112
SUCs, a 1.7 percent or P400-million
decrease from the current P23.8 billion
budget.
The proposed 2011 national budget
will still undergo deliberations in the
Senate and the Congress Bicameral
Committee before the president signs
it into law.
“We need to escalate our protests
as Senate is set to vote on the
budget. Students, faculty, employees,
administrators, and other stakeholders
should build the broadest and widest
possible unity in our campuses for the
people’s right to education,” the NUSP
statement read.
Dwindling subsidy
Under the proposed 2011 budget,
PUP is set to receive P672 million,
less than a quarter of the P2 billion
needed by the university to maintain
the current state of facilities and
operations, said PUP Student Regent
Sheryl Alapad.
Although the PUP budget increased
from P640 million this year to P672
million, the increase was mostly due
to the implementation of the Salary
Standardization Law III, which hiked
up the budget for Personal Services
by more than P60 million, explained

A closer look at the PUP budget
would reveal that the budget for
maintenance and other operating
expenses even decreased by P14
million, Bañez added.
Budget cuts will “force the
University to improve the condition of
facilities at the expense of the students,
such as in the form of tuition and other
fee increases” said Alapad, citing the
previous attempt to raise the PUP
tuition from P12 to P200 per unit.
The increase, however, did not push
through after PUP students stormed
the Commission on Higher Education
Office to protest against the proposed
increase last March 24.
“Decades of budgetary neglect have
taken its toll on our university. Decrepit
facilities and overworked but under-
compensated faculty members are
some of the results of the government
giving us insufficient funds,” said
Alapad.
‘UP on strike’
Meanwhile, in a November 18

and employees in UP Diliman (UPD)
announced that the UP community
will hold a strike on November 25 and
26.

services.
COA was the second

the validity of the FMAB contract.
On a February 9 opinion, the
Department of Justice (DOJ)
explained that the FMAB contract
has violated provisions of the UP
Charter.

UP Charter violation
In a November 9 letter to the
BOR last year, the All UP Workers
Union (AUPWU) Manila Chapter
explained that the BOR violated
certain provisions of the 2008 UP
Charter when it approved the lease
contract for the FMAB.
Certain requirements for asset
disposition set by Section 23 of the
new UP Charter were not followed
by the BOR. These requirements
include basing lease transactions
exceeding five years on a multi-
year development plan and having
a third party assessment after the
FMAB project underwent two
failed biddings.
The UP administration has
initially dismissed the AUPWU’s
contentions, explaining that
Section 23 of the UP Charter is not
applicable to the FMAB contract
as the cited provisions were “not
yet existent” when UP and MGHI
negotiated the terms of the contract
of lease from 2006 to 2008.
Republic Act (RA) 9500 or the
new UP Charter, which contains
the asset disposition clause, was
passed in April 2008.
However, the DOJ released a
legal opinion on February 9 this
year, upholding the contentions
raised by the AUPWU. According
to former Justice Secretary Agnes
Devanadera, the FMAB contract
is covered by RA 9500 as UP and
MGHI is still in the middle of
negotiations when the law took
effect in April 2008.
The FMAB contract between
UP-PGH and MGHI was signed by
the BOR on June 18 last year, and
its effectivity confirmed on August
28 of the same year. 
The UP administration,
however, did not follow DOJ’s
recommendation to cancel the
contract due to its illegality,
adding that the legal opinion is
“not binding” and UP can opt to
disregard it.
Additional violations
In the 2009 CAAR, the
audit agency compelled the UP
administration to resolve the legal
issues on the FMAB contract.
Aside from the violating the
UP Charter, COA also noted the
absence of several documents and
permits “necessary to determine
reasonable assurance of the
contract’s compliance to existing
government rules to establish
the validity and regularity of the
transaction.”
These deficiencies include the
lack of permit from the National
Historical Institute (NHI) to
convert and rehabilitate the PGH
Dispensary Building. Being part of
the original PGH complex, which
the NHI declared as an “historic
edifice,” no alterations can be
done to the said building without
permission from the NHI.
Also, as the FMAB project is under
the Build-Operate-Transfer scheme, the
project should have been first examined
by the Investment Coordination
Committee of the National Economic
Development Authority to gauge its
profitability for UP.
The FMAB project also lacked
a clearance from the Department
of Environment and Natural
Resources and other government
regulatory institutions.
PGH director Rolando Enrique
Domingo refused to comment on
the issue, saying that the FMAB
contract was approved by the prior
hospital administration.

Ongoing operations
Though the FMAB, which
operates under the name “University
Physicians Medical Center” or
UPMC, is not yet fully functional,
several private laboratories and
pharmacies have already started
operations since August this year.
Services such as radiology,
fluoroscopy, ultrasound and laboratory
services have also started operations in
the UPMC.

of Science released a statement in its
website urging the students and faculty
to participate in the “multisectoral
activities” against the budget cut.
“The College is in dire need of
additional funding support to properly
maintain and operate the National
Science Complex that is scheduled for
completion in 2011,” the statement
read.
The UP Manila (UPM) community
announced in a press conference that
the campus will also go on strike on
November 25 and 26. In the proposed
budget, the allocation for the
Philippine General Hospital decreased

Last November 19, the faculty of the
UPM Department of Social Sciences
passed a resolution calling for the
students to participate in the strike.

as it may affect income from PGH’s
own laboratory facilities and pharmacy.
In a statement released last October,
the AUPWU-Manila has already
reported decreased sales in the PGH
pharmacy, which they attributed to the
“direct competition” from UPMC.

UP Law profs
defend stand in
plagiarism issue

Mariano Del Castillo, who allegedly
plagiarized international law journals
in a decision.
In a compliance document filed
in the SC last November 19, the law
professors explained that it was their
duty as “law professors and members
of the Bar” to issue the statement
entitled “Restoring Integrity” last
August 9.
The SC is not exempted from “high
standards of intellectual honesty,” the
professors said in the November 19
response. “The Court is held to the
highest standards precisely because
its decisions affect the lives of each
and every Filipino, assume the weight
of precedent, and become part of the
national legal memory and the law of
the land,” the professors explained.
‘Protracted battle ’
In an April 28 decision penned
by Del Castillo on the Vinuya et al.
vs Executive Secretary et al. case, the
SC denied the petition of surviving
“comfort women,” who were abused
by Japanese soldiers during World
War II. The petition will compel the
Philippine government to demand
public apology and remuneration
from Japan.
On July 18, Attys. Harry Roque
and Romel Bagares, legal counsel of
the comfort women, filed a complaint
in the high court accusing Del
Castillo of plagiarizing the works of
international experts Christian Tams,
Evan Fox-Decent, Evan Criddle, and
Mark Ellis in writing the ponencia or
decision for the Vinuya case.
Consequently, the 37 UP Law
professors released a statement on
August 9 condemning plagiarism and
compelling Del Castillo to resign.
“The plagiarism and
misrepresentation are not only
affronts to the individual scholars
whose work have been appropriated
without correct attribution, but also
a serious threat to the integrity and
credibility of the Philippine Judicial
System,” the UP Law professors said
in the statement.
The SC released a ruling on
October 12 which absolved Del
Castillo of plagiarism. Meanwhile,
on October 20, the SC ordered the
37 UP law professors to “show cause”
for the release of the said statement,
explaining that the professors
violated the Code of Professional
Responsibility.
According to the show cause order,
the professors violated Canons 10, 11,
13 and Rules 1.02 and 11. 05 of the
Code of Professional Responsibility,
which prohibits the airing of public
statements that might influence public
opinion while a case is pending.
The UP Law faculty risk sanction,
suspension or disbarment due to the
statement, according to the SC’s show
cause order.
The SC earlier gave 10 days for
the UP Law faculty to comply with
the show cause order. However, it
extended the deadline from November
2 to November 20 after Dean Leonen
filed a motion of extension.
‘It’s our duty ’
On November 19, simultaneous
with UP Law’s alumni homecoming,
the 37 professors submitted their
reply to SC.
“Intellectual honesty is a bedrock
principle in the academe and
plagiarism is intellectual dishonesty
and misrepresentation,” the professors
said, explaining that it was their duty
as law practitioners to criticize any
case of intellectual dishonesty.
“Our statement was issued so that
the Court could urgently act to correct
a wrong so as to inspire confidence in
the legal system rather than to lessen
it,” UP Law Dean Marvic Leonen said
in a statement.
The SC is set to deliberate on the
UP Law faculty’s response.

Various colleges, law schools,
academic institutions, and
international law organizations have
already expressed support to the UP
Law faculty.

information needed in the professions
we have chosen. We accept our posi-

knowledge, a setup integrated in our
consciousness as natural and normal.
After all, we get something invaluable
from the university.
With these notions in mind, we find
it hard to skip classes, to leave the class-
room for trivial reasons. We feel bound
to our seats out of gratitude for our
education.
Blinded by our gratitude, it takes a
great force to jolt us out of our accepted
realities and see our everyday in a new
light: we keep the learning institutions
running by our mere presence. The
cessation of school, then, is possible
through student upheaval. If every stu-
dent refuses to go to his or her classes,
the school is as good as an empty struc-
ture bereft of purpose.
Halting classes
is an opportu-
nity to imagine

a new reality—
a reality that
breaks away
from the dog-
mas of the cur-
rent order.
(Un)productivity
The concept of halting classes can
be likened to the stoppage of produc-
tion by workers, commonly called a
strike. Holding a strike in factories had
devastating effects on production and
thus reduced, if not completely oblit-
erated, the profit made by capitalists.
The logic governing strikes is founded
on the basic relations between factory
owner and laborers; the capitalists take
advantage of the work input of laborers
to accumulate profit.
Though there appears to be historic
evidence of a strike by Egyptian arti-
sans around 1152 BC, the term strike
was first used when English merchant
sailors debilitated a ship in 1768 in pro-
test of harsh working and living condi-
tions. Since then, the term strike has
referred to an organized stoppage of
work or production by laborers, a tactic
employed by workers to force their em-
ployers to address their demands and
work grievances.
When production is put to rest,
the whole economic base is disturbed

with tension. There are no goods to
be sold in the market, the government
cannot extract tax from purchases and
the public is drawn to the problems
faced by the ordinary laborer.
Indeed, strikes have become in-
strumental in alleviating the worker’s
plight. It comes as no surprise that
strikes are regulated, even forbidden,
in some of the world’s leading coun-
tries in the manufacturing business
such as China and the Unites States of
America. Inevitably, other sectors have
adopted the worker’s defiant display of
collective collection, calibrated to at-
tain their own causes.
Counterflow
Students who hold strikes often
come from state-supported schools.
In these cases, strikes are often held to
demand larger state funding or protest
diminishing budget for social services
such as education.
As in a labor strike, a student strike
aims to cripple school operations and
render schools useless. The organized
stoppage of the production of knowl-
edge within the hallowed halls of the
university is not an exercise of anarchy
or simple student disobedience, rather
it is a symbolic act meant to taunt the
state and demonstrate the power of the
students.
Though the students seem to be at
the receiving end in the education sys-
tem, they are actually forces needed by
the state to propagate certain ideolo-
gies. In other words, under the tutelage
of state apparatuses, students become
carriers of the status quo. In the Phil-
ippines, the status quo for tertiary
education has been deftly described by
the government as controlled by the
private sector. Thus, state universities
and colleges (SUCs) are slowly trans-
formed to imitate private universities.
The initial step in this program is the
reduction of funding for SUCs.

Moreover, as the education system
produces subservient employees out of
its students, a strike actually becomes a
venue for students to subvert the state’s
plans for them. The strike, after all, is
not only a disruption in the production
of knowledge and docile employees; it
also serves as a break for students to
examine the system that has swallowed
them all their lives. Halting classes is
an opportunity to imagine possibilities
of a new reality—a reality that breaks
away from the dogmas of the current
order.
In an essay, John Berger notes that
mass actions such are rehearsals for
drastic societal changes where the ma-
jority will steal political power from
the ruling few. For a student strike, the
rehearsal goes deeper by another layer.
The students, who are actually mem-
bers of the labor force in transition,
already practice organizing themselves
against oppression. In the process, they
re-educate themselves and discover
that gratitude does not drive them to
be compliant; it is the years of educa-
tion itself.
The impact of a strike lies on the
damage it deals on the daily grind of
factories or schools. Of course, the
success of mass actions is largely deter-
mined by the number of people who
join the action. The formula, is simple:
the magnitude of success is proportion-
al to the number of protesters.
In a strike, the dynamics of power
and the everyday life are reversed
through collective action. Certainly, a
strike is a desirable alternative to the
monotony of oppression and state ne-
glect. q

Shooting Urban Poverty (A
Photo Exhibit)
Shooting Urban Poverty is a compilation
of original photos that depict urban
poverty and the struggles of the urban
poor in the Philippines. It is a campaign
that aims to reach out to other sectors
and forces in Philippine society with
the objective of generating support for
the advancement of the rights of the
urban poor to jobs, livable wages, food,
decent housing, and social services.
An open-ended project, it is set to be
launched on December and will run
until next year. Shooting Urban Poverty
is initiated by the Urban Poor Resource
Center of the Philippines (UPRC) and
the Kalipunan ng Damayang Mahihirap
(Kadamay) and in coordination with
Gabriela Women’s Partylist and
Anakpawis. The target launching of the
photo exhibit will be on December 1,
2010 at the House of Representatives and
will run for one week. It is set to be shown
in churches, schools, government offices
and other significant public places.

In Pursuit
of Justice
T he image of the brutal massacre is
hard to forget: a road leading to a mass
grave crammed with bodies, cars and
other vehicles — including a backhoe is-
sued by the provincial engineer’s office of
Maguindanao, allegedly used to bury the
victims.
Scenes of the senseless carnage haunt-
ed newspapers and news programs for
weeks after, the grim reality of the extent
to which one political clan in the south had
consolidated power, to the point that they
enjoyed immunity and support from then-
President Gloria Arroyo herself.
A year later, the images have changed,
but the story remains: private armies con-
tinue to run rampant; the trial is ongoing,
with no convictions in sight; and the fami-
lies of victims are still searching for justice
amidst a culture of impunity and violence.
The massacre of 58 people, including
32 journalists, in broad daylight — the
crime drew international and national
outrage, yet justice is moving at an un-
bearably slow pace. The families of the
victims, who have bravely lobbied against
the might of the Ampatuans, still yearn for
the conviction of murderers who have long
been identified by various witnesses and
evidence. From investigations, pieces of
the story came together. How the private
armies of the Ampatuans blocked the way
of more than fifty people on the way to
file a certificate of candidacy from a con-
tending clan, how the Ampatuan family
polished plans of the mass murder over
dinner. Indeed, the identity of the per-
petrators is no longer a mystery. Despite
this fact, the families continue to yearn for
justice, and no conviction had ever been
made since the case opened last year.
Aquino’s administration has promised
the people many things, including justice
for those oppressed and victimized by the
Arroyo regime. Yet, the motion for the
live coverage of the trial is still pending in
court, and witnesses continue to fear for

Justice for these families necessitates the
speedy resolution of the case. At the rate
the trials are going, the case could drag
on for decades, an inappropriate response
to the shocking deaths of November 23.

Moreover, the government should move to
dismantle the paramilitary groups hired by

Bagaman tatlong taon nang bukas ang
UP Baler, umaabot lamang sa 124 ang
kabuuang bilang ng mga estudyante.
Kakaiba rin ang proseso ng pagtang-
gap ng estudyante sa mga SHS. Hindi
dumaan sa UP College Admission Test
ang mga aplikante. Sa halip, dumadaan
sa masusing screening ang mga estudy-
ante. Tanging mga target communities
lamang ng SHS ang maaaring pumili ng
mga estudyanteng ipapadala sa Baler
upang mag-aral. Rekisito rin sa pag-
pasok sa UP Baler ang kahandaan ng
estudyanteng bumalik sa komunidad

kanyang pinagmulang komunidad ang
bawat estudyante. Umaabot sa P2,000
hanggang P4,000 kada buwan ang sus-
tento ng isang iskolar, batay sa kakaya-
han ng pinanggalingang barangay, mu-
nisipyo at probinsya.
Nagmumula pa ang mga estudy-
ante ng UP Baler sa iba’t ibang mga
probinsiya sa hilagang Luzon tulad ng
Batanes, Isabela at Quirino. Layunin ng
UP Baler na ilapit sa mga estudyanteng
nakatira sa hilagang Luzon ang pagka-
kataong makapag-aral ng mga kursong
may kinalaman sa kalusugan.Tumutu-
gon ang mga komunidad sa panawagan
para sa mga iskolar sapagkat itinuturing
na investment ang bawat estudyante,

Pag-abot
Kahit malayo sa kanilang pinagmu-
lang lugar, pinipili ng mga estudyante
na mag-aral sa UP Baler sapagkat lim-
itado ang oportunidad para mag-aral
sa kanilang mga komunidad. Bagaman
mayroong mga state university and col-
leges (SUCs) sa kanilang lugar, marami
sa mga estudyante ng UP Baler ang
walang kakayahang pasanin ang matri-
kula at iba pang mga bayarin .
“Malamang hindi ako nag-aaral
ngayon kung wala itong opportunity
na ibinigay ng SHS at saka ng munici-
pal government sa akin ,” ani Irma, 2nd
year sa UP Baler. Bagaman mayroong
SUCs sa kanilang lugar, hindi siya kay-
ang paaralin ng kanyang mga magulang,
na parehong walang maayos na trabaho.
Bilang isang extension program,
nakadisenyo ang UP Baler na bigyan
ng oportunidad mag-aral ang mga es-
tudyanteng hindi kayang pag-aralin ng
kanilang pamilya. Sa pamamagitan ng
ganitong uri ng mga programa, tinutu-
pad ng UP ang tungkuling nitong ilapit
ang dekalidad na edukasyon sa mga ta-
ong pinagkaitan ng yaman.
Pagmulat
