COMMITTEE REPORT

This is a committee report as a result of the public hearing conducted in the


matter of the “PROPOSED CARLESS DAY ORDINANCE OF BACOLOD
CITY”, docketed as SP Correspondence No. 10-19-0237, presided by SPM Carlos
Jose V. Lopez, the undersigned Proponent and Author of the Proposed Ordinance.

Attached herein is the attendance sheet.

DISCUSSION

The public hearing was called to order at around 2:00 P.M. As per
discussion, Atty. Randy Agot of the DPWH reiterated the provision of the Republic
Act 7160 or the Local Government Code of 1991, particularly Section 21,
Paragraph C, to wit:

“Section 21, Paragraph C, that any national or local road, alley,


park or square may be temporarily closed during an actual emergency,
fiesta celebrations, public rallies, agricultural or industrial fairs, or an
undertaking of public works and highways, telecommunications and
waterworks projects, the duration of which shall be specified by the
local chief executive concerned in a written order: Provided, however,
That no national or local road, alley, park, or square shall be
temporarily closed for athletic, cultural, or civic activities not
officially sponsored, recognized, or approved by the local government
unit concerned”.

The undersigned took note of the statement made by Atty. Randy Agot of
DPWH Regional Office VI and that he will be passing a local Ordinance
temporarily closing the said roads for a period of one (1) year and to ask Congress
to make another law allowing for its closure. Atty. Agot, however, manifested that
Congress will only act with regards to permanent closure of roads.

Engr. Ephraem Hechanova of the City Engineer’s Office manifested that he


agree with the statement made by Atty. Agot with regards to temporary closure. He
further stated that in his experience with the City, closure of roads are allowed only
for a short period of time and that he has not yet experienced a temporary closure
for a period of one year and if whether the same is feasible.

The undersigned manifested that the proposed temporary closure of the said
roads will be subject for further study since the closure will only affect a portion of
the roads and that ingress and egress to the different roads will not be hampered.

Engr. Hechanova further manifested that he was confused with the title of
the proposed Ordinance (Carless Day Ordinance) and that his perception of the
purpose of the proposed Ordinance is to disallow cars from passing through or
traversing the roads on a certain day.

The undersigned opined that based on the statement made by the DPWH,
there should be a reasonable ground to justify closure of the roads based on the
Local Government Code. He further manifested that he will seek the comment of
Ayala regarding the proposed measure.

Adjournment

There being no other matters brought to the floor for further discussion, the
public hearing was adjourned at 2:10 in the afternoon.
