1.

Objectives of the programme


- The main ideas in the strategies, the scope of the scheme, the goals related to subsidize
UCT
- Main obj – modal shift from roads to UCT
- Sec obj – a better protection of the environment, better protiection of the towns,
historical monuments, redicution of the noise , reduction of emissions of co2 and other
gases, a decrease in the number of accidents on public roads, decrease of the external
costs
- Indicate the legal basis for the programme
- Copy what’s written in programme justification, maybe less developed style

2. Funding conditions
- Indicate the aid intensity, the budget and the um which will be granted for every
container
3. Eligibility criteria and selection criteria
- Copy from general criteria from document related to marco polo, and adapt this rules
for our programme
- Could be general criteria;
- We will finance only transport services and not purchasing of different equipment or
vehicles
- Nationality of the applicant/beneficiary – indicate that any company registered in EU
which is a railway operator could be beneficiary in the programme

- E5 copied as in the document – marco polo
- E6 is related to the period in which subsidies could be given to any legal person
compliant with the eligibility criteria
- Specific criteria:
o Applicant must be a railway operator
o Applicant must not be in an undertaking or financial difficulties
o Applicant must not have debts to the state budget or to the local budget
o Applicant must not have debts to the environment fund
o Applicant must not be bankrupted, in insolvency or in similar situations
o Applicant must not be subject to a decision to recover an illegal state aid
o Applicant must prove that it has the resources to implement the project
o Applicant must have all expertise in order to implement the project, knowledge,
experience and expertise
o Applicant must have a good financial status and financial resources to support
the implementation of the project
- Ro la applicants guideline in Romania: applicant must have at least 3 years of economical activity
- Undertaking – communication from the commission – point 20 – definition (page 6/28) –

4. Award criteria
- Take from marco polo document

- Credibility of the action – we can give points - ask for fesability studies proving that the
project is viable - copiat din marco polo

5. How to prepare a proposal
- Indicate documents that need to be submitted to the ministry of transport

6. How to submit the proposal
- Rules both in marco polo and in guidelines of ro la in Romania
- You have to submit documents both on paper and cd/dvd in a pack and envelope
submitted to a specific address and having indicated the name of the programme (not
the name of the project)
- Documentele se transmit in perioada indicata in documentele sesiunii de proiecte – data
viitoare!!
- Provide very clear rules:
o Decide between 2 options:
 Allow appl to submitted whenever they want: indicste that appl are
allowd to submit proposals at every moment during the year, it is
possilbe to finish the funds while applicants are still submitting proposals
 Allow appl to submit only in specific periods, ehich are specified in
periodical calls: work in sessions specified in calls, budget is very clear,
specifiy criteria for choosing the winner

 The form in which the docs must be submitted: the appl must put
in an envelope a lot of docs and cd/dvd. Indicate the programme
and session for admission.

 Contents of the envelope: article 23 in ro la: what is asked from
the railway operators in order to accept a proposal
o Form that request the subsidies; such forms are anexes to
the guidelines,we have to create such a form - model is
annex 1 in ro la document. Such a form must be an annex
to our guideline.

o Evaluation/assesment of the proposals:
 Financial authority must establish an evaluation comission having 3-5
members, one of them being the president of the comission
 The members could be employees of the authority or independent
evaluators
 This comitee must prepare a report regarding every proposal indicating:
 The proposal is to be rejected or admitted, and reasons if they
rejected the proposal
 For accepted proposals they must have sections regarding the
eligibility of the benficiary, regarding the credibility of the
probosals, regarding how the competition is distorted by the
subsidy

defined OR we can grant points for different aspects like in marco polo

 PRACTIC AWARD CRITERIA
 DE PUS DUPA AWARD CRITERIA After the accepted proposals are
announced, the rejected applicants must be allowed to appeal. We have to
describe the appeal procedure - articolul 12 din ro la . The results of the
appeal must be published in order to ensure the transparency of the
programme (also the reason must be mentioned clearly)
7. Financing contract
● Every contract must be signed only after the evaluation and after all the appeals are resolved

● Subsidies are possible only after the conclusion of a specific contract and the text of the contract
is indicated in another annex.
● Procedure for negotiation and signing the contract - cannot be negociated in the ro la case

● Indicate the number of copies: one for authorities, one for beneficiary, both copies have the same
power in front of the court

8. Drawing procedures

● Start with paragraph 6 - idea that financing is given only for activites regarding the project
● Second idea is that beneficiary must submit a request for subsidies and other docs at a specific
date or specific period indicated in the contract only for services already performed - paragraph 3
● Documents needed are indicated in article 16:
○ Request for financing: form indicated in the annex of the contract
○ Invoices issued by the railway operator for every client interested in container transport

○ Copies of the transport docs - consignment notes
○ Rest of the docs are financial docs - indicating that the operator payed its taxes and duties in time
■ Ask for licence of railway operator and for the safety certificate if this documents were renewed
from the last drawing or from the beginning of the project;

○ Style in which these docs are written and ordered
○ Extract only what is specific to our programme
○ It is recommended that for every drawing there is a list of all transports for which a subsidy is
requested
9. Miscellaneous
● Rules about project monitoring: the representatives of the authority must be allowed every time to
check the financial and fiscal docs related to the transports in order to check that the request for
funds are correct. They can perform checks at HQ and other working points of the beneficiaries
and if they find negative aspects they can impose corrections.
● All data, info, instructions in connection with the programme are allowed to be oublished on the
website of the authority in order to ensure the transparency of the programme
● The beneficiaries must indicate in every communication in mass media / scientific paper that the
achievements are due to the subsidies offered by the authority.
