CERTIFICATION

To whom this may concern:

THIS IS TO CERTIFY that the provisions of Section 93 (Use of Fine Mesh Net)
Republic Act No. 10654 or the Fisheries Code provides that; It shall be UNLAWFUL to
engage in fishing using nets with mesh smaller than that which may be determined by the
Department.

That fine mesh nets are defined as net with mesh size of less than three centimeters (3
cm.) measured between two (2) opposite knots of a full mesh when stretched or as otherwise
determined by the appropriate government agency.

That as an exception to this provision the use of fine mesh net shall be allowed through
the passage of a scientific based Municipal Ordinance. These type of nets can only be allowed
in a certain period of the year to maintain the stock of the targeted species above 50%. A
specific gear license or permit is granted for this purpose, only in the following
circumstances:

1. If the net is used to catch:

a. Padas (Siganidae), bangus fry (Chanos chanos), sugpo fry (Penaeidae),
banak fry (Mugilidae), glass eels and elvers (Anguilidae) and such other immature
species for culture purposes;
b. Aquarium/ornamental animals; and
c. Other species already mature such as, but not limited to, alamang (Acetes
spp.), tabios (Pandaca pygmea), sinarapan (Mistichthys luzonensis), dilis
(Engraulidae), and snails (Ampularia luzonica and Vivipora spp.).
