Respectfully Showeth:-
1. That the abovesaid Criminal appeal against acquittal was
filed before this Hon’ble Court and petitioner/ applicant is
very hopeful of its success on the basis of grounds taken
therein.

2. That the grounds of main petition may kindly be read as part

and parcel of this application, because same are not
repeated here for the sake of brevity.

3. That the abovesaid case was fixed for hearing on 02.04.2019.

When the matter was called for hearing by this Hon’ble court,
undersigned counsel was busy as he was arguing a part-
heard matter before the Coordinate Bench of this Hon’ble
court and by the time the undersigned counsel reached this
Hon’ble court, case was already called and when the
undersigned counsel checked the status, once the court time
 was over it was found that main case has been dismissed in
default, due to non appearance of undersigned counsel.

4. That the absence of the undersigned counsel before this

Hon’ble court was neither intentional nor willful but due to
bonafide reasons explained above.

5. That if the abovesaid Criminal appeal against acquittal is not

ordered to be restored and not ordered to be heard on
merits, then applicant/petitioner shall suffer an irreparable
loss.

It is, therefore, respectfully prayed that present

application may kindly be allowed and the above
mentioned Criminal appeal against acquittal may kindly be
restored and order dated 02.04.2019 may kindly be recalled,
in the interest of justice and fair play.
