Location: The property is located on the south side of Sheppard Road, approximately 1,027 feet north of San

Site Location: The property is located on the south side of Sheppard Road, approximately 1,027 feet north of San Pablo Drive, at
811 Sheppard Road, Stone Mountain, Georgia 30083.The site is zoned R-100 and is surrounded by R-100 zoned property to the
east, west, and south. Directly north are properties that are located within the City of Stone Mountain. The subject property fronts
Sheppard Road which is classified as a collector.

Variance request: The applicant is requesting a variance from section 24-2.2.1 of the DeKalb County Zoning Ordinance to reduce
the front yard setback from 35 feet to 15 feet for a proposed two story home..

Variance Analysis: Based on the submitted materials, the site has approximately 102 feet of street frontage along Sheppard Road.
The site has approximately 6,587 square feet of lot area. The R-100 zoning district requires a minimum lot frontage of 100 feet and
a minimum lot area of 15,000 square feet. Considering the size of the lot, the site does not comply with the minimum lot size
standards. Based on the county records, the house was constructed in 1940, and is therefore legally non-conforming.

Based on the submitted site plan, the site consists of a one level wooden frame house. The applicant is proposing to demolish the
existing residential structure and rebuild a new two story home over the existing foundation. Currently, the existing residential
structure encroaches approximately 20 feet in the front yard setback and is placed on an irregular shaped lot. Therefore, based on
staff’s site visit and submitted materials, the requested variance meets the criteria for approval, based on the following findings:

1. By reason of exceptional narrowness, shallowness or shape of a specific lot, or by reason of exceptional topographic
conditions, which were not created by the owner or applicant, the strict application of the requirements of this chapter
would deprive the property owner of rights and privileges enjoyed by other property owners in the same zoning district:
Due to the placement of the existing residence, for the strict application of the requirements of this chapter would deprive the
property owner of rights and privileges enjoyed by other property owners.

2. The requested variance does not go beyond the minimum necessary to afford relief, and does not constitute a grant of
special privilege inconsistent with the limitations upon other properties in the zoning district in which the subject property
is located:
Based on the submitted materials and site visit, the requested variance does not appear to go beyond the minimum necessary to
afford relief since the applicant is proposing to build the proposed two-story home over the existing foundation. The requested
variance does not constitute a grant of special privilege inconsistent with the limitations upon other properties in the zoning district in
which the subject property is located.

3. The grant of the variance will not be materially detrimental to the public welfare or injurious to the property or
improvements in the zoning district in which the subject property is located:
Granting this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the
zoning district in which the subject property.

4. The literal interpretation and strict application of the applicable provisions or requirements of this chapter would cause
undue and unnecessary hardship:
It appears that the literal interpretation and strict application of the applicable provisions or requirements of this chapter would cause
an undue and unnecessary hardship considering placement of the existing residence and the irregularly shaped lot.

5. The requested variance would be consistent with the spirit and purpose of this Chapter and the DeKalb County
Comprehensive Plan Text:
Based on the submitted materials, it appears that the requested variance would be consistent with the spirit and purpose of this
chapter and the DeKalb County Comprehensive Plan text as it adheres to the front and side yard setbacks.

FINAL STAFF ANALYSIS:


Based on the submitted materials and site visit, the requested variance does not appear to go beyond the minimum necessary to
afford relief since the applicant is proposing to build the proposed two-story home over the existing foundation. The requested
variance does not constitute a grant of special privilege inconsistent with the limitations upon other properties in the zoning district in
which the subject property is located.

It appears that the literal interpretation and strict application of the applicable provisions or requirements of this chapter would cause
an undue and unnecessary hardship considering placement of the existing residence and the irregularly shaped lot. Therefore, the
Department of Planning and Sustainability recommends that the application be “approved” based on the materials received on
November 7, 2019.

STAFF RECOMMENDATION: “Approval” to reduce the front yard setback from 35 feet to 15 feet for a proposed two story
home as shown on the submitted site plan dated received November 7, 2019.
