AFFIDAVIT OF UNDERTAKING

I, MR. AMOL BHAGWAN CHAVAN adult Indian inhabitant aged 24 years residing at FLAT NO.

B/37, E1-WING, GOPAL GANESH NAGAR, SATAPALA ROAD, UMBERGAOTHAN, VIRAR (W)

401301, TAL-VASAI, DIST-PALGHAR, MAHARASHTRA, do hereby state on solemn formation as

under :-

1. I say that I have approached Carnival Support Services India Pvt Ltd. [hereinafter

referred to as the CSSI] who is the recruiting Agent for Carnival Cruise Line, a division

of Carnival Corporation [hereinafter referred to as the Principal], a Company

registered in United States of America having registered office at 3655 NW 87th

Avenue, Miami, Florida 33178, USA , for work as a crew member on ships owned or

operated by the said Principal.

2. I have had it explained to me and have clearly understood that CSSI is only a

recruiting Agent for the Principal. Except the correspondence & completion of

+formalities in the capacity of an Agent of the Principal, CSSI has no other liability in

respect of my employment on the ship owned or operated by the Principal. I clearly

understand and accept that there shall be no employer-employee relationship

between myself and CSSI and all my correspondence with CSSI shall only be in their

capacity of Agent of the said Principal.

3. I have had it explained to me and have clearly understood that I am being recruited

for work as a crew member on Ships that are owned or operated by the Principal,

noting that the Principal will also be my contractual Employer, that being Carnival

Cruise Line, a division of Carnival Corporation, a Company registered in USA having

 registered office at 3655 NW 87th Avenue, Miami, Florida 33178, USA as clearly

mentioned in my Seamen’s Employment Agreement that I have received and signed.

I shall be receiving wages and working under the control and supervision of the

Principal, who are also my Employer, on the ship owned or operated by the

Principal.

4. I say that I am giving this undertaking to the Principal as well as CSSI as the Agent of

the Principal and the Employer that if I am recruited by the Employer to work as a

crew member on the said ships of the Principal, I shall report for work on the said

ships strictly on the date, time and place in accordance with the instructions of the

Employer communicated directly or through CSSI. I further undertake that on

reaching the country/port of reporting for work I shall not abscond/desert ship at

any time during the tenure of my work contract with the Employer and I shall abide

by all the terms and conditions of my Contract with the Employer. I further

undertake that in the event the Employer or Principal declares me as an

absconder/deserter in accordance with the law applicable to the port/country in

whose jurisdiction the ship is docked, I shall be liable to pay to the Employer,

Principal or CSSI as Agent for the Principal, all expenses and penalties levied on any

of them including, but not restricted to, penalties levied by Customs and Border

Patrol or similar government agencies in the port of desertion, expenses incurred for

sourcing a replacement crew member including flight costs to replace me, etc. The

said amount shall be recoverable by the Employer, Principal or CSSI acting as Agent

for the Principal in the courts of Mumbai.

 5. I say that MRS. SUNITA BHAGWAN CHAVAN, who is related to me as MOTHER, has

agreed to stand as a Guarantor for me in respect of my liability to pay the aforesaid

sum of Rs 10,00,000/- (Rupees Ten Lakhs) in case I am declared as

absconder/deserter by the Employer or Principal as stated in the foregoing clause or

if I commit any breach of Contract with the Employer, by providing an irrevocable

Guarantee/Undertaking in favour of the Employer, Principal and CSSI as Agent of the

Principal in Mumbai. I say that written declaration by the Employer, the Principal, or

CSSI as Agent of the Principal that I have absconded/deserted from the ship and/or

not reported on the ship or committed any breach of employment contract, shall be

sufficient for invoking the said irrevocable Guarantee provided by the Guarantor.

The said liability will be joint and several.

 AFFIDAVIT OF GUARANTOR
I, MRS. SUNITA BHAGWAN CHAVAN, adult Indian inhabitant aged 42 years residing at FLAT

NO. B/37, E1-WING, GOPAL GANESH NAGAR, SATAPALA ROAD, UMBERGAOTHAN, VIRAR

(W), TAL-VASAI, DIST-PALGHAR, MAHARASHTRA, do hereby state on solemn formation as

under :-

1. I say that I am related to MR. AMOL BHAGWAN CHAVAN [hereinafter referred to as the

crew member] as MOTHER. I say that I have seen and understood the affidavit of undertaking

dated given by the said crew member in favour of (i) Carnival Support Services India Pvt Ltd.

[hereinafter referred to as the CSSI]; (ii) Carnival Cruise Line, a division of Carnival Corporation,

a Company registered in United States of America, the Principal and the Employer, for which

CSSI are the recruiting Agents.

2. I have had it explained to me and have clearly understood that in case the said crew

member is declared as absconder/deserter during the tenure of employment, s/he shall

be liable to pay to Principal/CSSI as its Agent/Employer all expenses and penalties levied

on CSSI or their Principal or the Employer. E.G. penalties levied by Customs and Border

Patrol or similar government agencies in the port of desertion, expenses incurred for

sourcing a replacement crew member including flight costs to replace the deserted

individual, etc.

3. I hereby provide this Guarantee that in case of any breach of the said Affidavit of

Undertaking if the crew member is required to pay the expenses mentioned in foregoing

para on account of being declared an absconder / deserter, I shall stand Guarantee for
 the said amount payable by or recoverable from the said crew member and the said

liability shall be joint and several between myself and the said crew member.

4. I say that I am giving this Guarantee to the Principal as well as CSSI as the Agent of the

Principal and to the Employer that the said crew member shall report for work on the

said ship strictly on the date, time and place in accordance with the instructions of the

Employer communicated directly or through the CSSI and shall not abscond/desert ship

at any time during the tenure of work contract with the Employer or commit any breach

of Contract with the Employer. The said amount shall be recoverable by the Employer,

the Principal or CSSI acting as Agent for the Principal from me in the courts of Mumbai.

 DEED OF GUARANTEE FOR PAYMENT

To

In consideration of your having arranged employment as a crew member for MR. AMOL

BHAGWAN CHAVAN as per his/her Employment Contract with Carnival Cruise Line, a division of

Carnival Corporation, the Principal and the Employer, a Company registered in United States of

America, having registered office at 3655 NW 87th Avenue, Miami, Florida 33178, USA , at my

request, I, the undersigned MRS. SUNITA BHAGWAN CHAVAN Age-42 Years, residing at FLAT

NO. B/37, E1-WING, GOPAL GANESH NAGAR, SATAPALA ROAD, UMBERGAOTHAN, VIRAR

(W), TAL-VASAI, DIST-PALGHAR, MAHARASHTRA do hereby Guarantee the payment of

expenses/damages in case the said crew member is declared as absconder/deserter from the

said Ship by the Employer or Principal during the tenure of employment. Myself and the said

crew member shall be liable to pay to Principal or CSSI as its Agent or the Employer all expenses

and penalties levied on CSSI or their Principal or the Employer under or in relation to such

circumstances . E.G. penalties levied by Customs and Border Patrol or similar government

agencies in the port of desertion, expenses incurred for sourcing a replacement crew member

including flight costs to replace the deserted individual, etc. I shall be jointly and severally liable

to pay the said amount along with the said crew member.
I hereby agree to be and shall, at all times hereafter until repayment of liabilities arising out of

breach of Contract of Employment or the circumstances as aforesaid, remain responsible to you

for and guarantee payment of the said sum together with interest thereon at the rate of 18 per

cent per annum, such interest to be calculated with effect from the date of service of the

registered notice of demand on me. This guarantee is given without prejudice to all my rights of

reimbursement as against the said crew member, or his estate as surety for him, for all sums

paid to you and costs, charges and expenses incurred in connection therewith. This Guarantee

is subject to the jurisdiction of Courts of Mumbai.
