4. Circulation of compound feedingstuffs ***II

European Parliament legislative resolution on the common position adopted by the Council with a view to the adoption of a European Parliament and Council directive amending Council Directive 79/373/EEC on the circulation of compound feedingstuffs and repealing Commission Directive 91/ 357/EEC (13292/1/2000 C5-0002/2001 2000/0015(COD))

(Codecision procedure: second reading)

The European Parliament,

having regard to the Council common position (13292/1/2000 C5-0002/2001) ( 1 ),

having regard to its position at first reading ( 2 ) on the Commission proposal to Parliament and the Council (COM(1999) 744),

having regard to the amended Commission proposal (COM(2000) 780),

having regard to Article 251(2) of the EC Treaty,

having regard to Rule 80 of its Rules of Procedure,

having regard to the recommendation for second reading of the Committee on Agriculture and Rural Development (A5-0079/2001),

Amends the common position as follows;

Instructs its President to forward its position to the Council and Commission.

Accordingly, it is appropriate, at this stage, to impose a

the feed materials in compound feedingstuffs for production animals.

(8) The declaration of the feed materials in feedingstuffs con- stitutes, in certain cases, an important item of information for stock farmers. It is therefore appropriate that, at the individual request of the stock farmer, the person responsible for labelling supply a detailed list of all the feed materials used and their percentages by weight.

Moreover, it is also important that the manufacturer of com-

Amendment 4 RECITAL 10a (new)

(10a) The BSE crisis and the recent dioxin crisis have shown once again that the safety of feedingstuffs can only be guaranteed by a binding definition of permissible feed materials. The Commission should therefore submit to the European Parliament and the Council by 31 December 2001 proposals for a positive list of permis- sible feed materials for feedingstuffs.

Amendment 5 ARTICLE 1, PARAGRAPH 1, SUBPARAGRAPH b Article 5, paragraph 1, subparagraph 1 (Directive 79/373/EEC)

(b) the following point (l) shall be added:

(l) In the case of compound feedingstuffs other than those intended for pets, the indication ‘a list of feed materials used in this feedingstuff and their percentages by weight may be obtained from: …’ (name or trade name, address or registered office and telephone number of the person responsible for the particulars referred to in this paragraph).

At a customer’s request, a manufacturer of compound feedingstuffs shall inform that customer of the percentage of each feed material included in the compound feedingstuff in question.

Amendment 6 ARTICLE 1, PARAGRAPH 4 Article 5c, paragraph 2, subparagraph a (Directive 79/373/EEC)

(a)

compound feedingstuffs intended for animals other than pets:

(i)

(ii)

listing of feed materials for feedingstuffs with an indication, in descending order, of the percentages by weight present in the compound feedingstuff, expressed in accordance with the brackets laid down in part C of the Annex, or

where Article 5(3)(g) is applied, listing of the feed materials with an indication, in descending order, of their percentages by weight;

(a)

compound feedingstuffs intended for animals other than pets: listing of the feed materials with an indication, in descending order, of their percentages by weight;

7. The Annex shall be supplemented by the text given in the Annex to this Directive.
