AFFIDAVIT

I, RAVEN ELY O. OJASCASTRO, 19 years old, Filipino citizen,

single and a resident of Brgy. Corro-oy, Santol, La Union, after having been
duly sworn to in accordance with law, hereby depose and state:

1. That I am the son and the second child of ELPIDIO V.

OJASCASTRO, JR., who is the respondent/accused in the
Administrative Case No. IAS1-NMP-ADM-18-0044 filed by
Marilyn R. Oriente before the office of the PNP Regional Internal
Affairs Service in Camp BGen. Oscar Florendo, Parian, San
Fernando City, La Union for Grave Misconduct re: violation of Sec.
5 (i) of Republic Act No. 9262, Anti-Violence Against Women and
their Children Act of 2004, and in relation to Sec 2 (C) (3) (r), Rule
21 of NAPOLCOM Memorandum Circular No. 2016-002;

2. That I know personally the complainant, Marilyn R. Oriente being

the former girlfriend of my father with whom he has a dating
relationship between the period, 2015- 2016;

3. That sometime in January 2016, I had several text

conversation/messages with my father regarding his request for me
to ask my tita (Marilyn Oriente) for some funds for his medical
check up since he was then coughing heavily and was having high
temperature; and again sometime in April 2016, I also had several
text conversations with my father regarding his advise for me to go
to my tita (Marilyn Oriente) because according to him, she had
something to give me; (copies of these text messages are herein
attach as Exhibits “12-A and “12-B”);

 4. That the foregoing text conversation/messages are now being used
by Marilyn Oriente in evidence against my father in the
administrative case she filed before the PNP RIAS-1 on the
allegation that he was using me to “milk” money from my tita
Marilyn;

5. That the allegation in paragraph 5 by my tita Marilyn against my

father is a falsity and is not the correct depiction of the real
circumstances described in the subject text conversation/messages
between me and my father;

6. That those text conversation/messages between me and my father

are private communications and I did not authorize nor give my
consent to tita Marilyn Oriente to use the same in evidence against
my father especially in the administrative case she filed;

7. That while it is true that I forwarded her those text messages

between me and my father after they had their falling out from each
other in the later part of 2016, I did so because she made me to
believe that by sending those messages to her, would lessen the pain
she was experiencing as a result of their break-up and that she just
wanted to know what I and my father were talking about her during
the time that they were still on the relationship and to appease her
and in good faith, I obliged and sent her some text
conversation/messages between me and my father that were still
saved in my cellphone but not for the purpose of using it against my
father in any case/proceeding such as this Administrative case she
filed before the PNP-RIAS;

8. That I had no idea, nor any suspicion that my tita Marilyn will use
those text messages/conversations between me and my father in
filing a case against my father, for which now, I feel sorry for my
father and felt betrayed by tita Marilyn;

9. That at the time I sent those messages to my tita (Marilyn Oriente), I

just had a misunderstanding with my father and wanted to get even
after having been scolded over some disciplinary matters I
committed, for which my father called my attention and in the
process I felt bad and resented to being scolded, although in the end,
I felt sorry for what I did and ultimately made amends with my

 father, as it was really my fault and he was just acting as a good
father to his son and for my own good;

10. That when I learned from my father that those text

messages/conversations between the two of us were presented in
evidence against him in the administrative case filed before the
PNP-RIAS-1. I felt really bad and felt betrayed by no less than the
person I trusted as my second mother, tita Marilyn;

11. That she tricked me into sending those text messages knowing pretty
well that I knew nothing about evidences because had I known, I
could not have been made a party to indicting my own father;

12. That she used the prevailing animosity then between me and my
father at the time when she wanted to get evidences against my
father and made me send her those text messages/conversations
exploiting my innocence and vulnerability on matters I have no
knowledge of nor competence to understand the consequences;

13. That as far as I can remember, the two (2) instances described from
the foregoing messages (Exhibits “12-A” and “12-B”) being used in
evidence against my father in relation to the allegation that he was
using me to “milk” money from my tita Marilyn, are the only
instances where my father asked me to do something which concern
my tita Marilyn, but not to “milk” money from her as in the first
Exhibit “12-A”, my father only sought help for some funds for his
medical check up from tita Marilyn and that was during their happier
times together which was normal between them at that time because
most of the time, tita Marilyn checks on my father if he is well and if
there are instances she gets to know that my father is sick, she
readily advises my father to seek medical attention; and with regard
to the second Exhibit “12-B”, the tenor of our text conversation was
advising me to get something from tita Marilyn, which she told my
father, who just relayed the matter to me, and has nothing to indicate
that my father is “milking” her of money, as she contends now;

14. That I am executing this affidavit to attest to the truthfulness of the

foregoing averments and for all legal intents and purposes it may
serve.
