SETTLEMENT AGREEMENT

This settlement Agreement is made effective this 24th day of January 2019
by and between.
1. Mr. Shoeb Hassan Hawa, Age 29 year, residing at Firdaus Manzil,
A-Wing, 301 3rd Floor, Near Kismat Colony, Kausa, Mumbra, Dist –
Thane. 400612.
Hereinafter referred to as “Party 1”, / Original Complainant
(Which term shall include unless repungnant to the context his/her heirs,
successors, legal representatives, nominee and assigns) of FIRST PART.

2. Mr. Dawood Miya Hussain Kondke, Age ___ Year, residing at
Amman Plaza, 3rd Floor, 301, Darga Road, Amrut Nagar, Mumbra, Dist
– Thane. 400612.
Hereinafter referred to as “Party 2” / Accused
(Which term shall include unless repungnant to the context his/her heirs,
successors, legal representatives, nominee and assigns) of SECOND PART.

WHEREAS a Settlement Agreement has been entered into between

the parties on 25th of January 2019 regarding Settlement of Payment:

WHEREAS the parties by mutual concessions, wish to enter into the

present Settlement Agreement in order to entirely, finally and definitively
settle and end all past, present and future dispute of payments between
both the parties, existing at present, or element which occurred prior to the
Effective Date and which are in connection with the above mentioned
Payment Settlement Agreement, its conclusion, execution, (performance),
interpretation, Validity, application or termination.

NOW THEREFORE, the Parties agree as follows:

1. That, the Party 2 had took the loan of amount Rs. 1 lakh from the
Party 1 and had made a declaration of Rs. 70,000/- (Seventy
Thousand Rupees Only) and Rs. 30,000/- (Thirty Thousand Rupees
Only) on two different occasions Vide Dated 25/02/2018 and
08/03/2018 respectively.
2. That, the party 1 / Original Complainant had filed a Criminal Case at
Mumbra Police Station against Party 2 / Accused in the Thane Court
vide Cr. MA No. 412/2018 for the non- payment of the said amount of
Rs. 1 Lakh.
3. That, Finally Party 2 had return the said amount of Rs. 1 Lakh to the
Party 1 on dated 25th of January 2019, and now no amount has been
left to repay to the Party 1.
4. That, after repayment of the said amount to the Party 1 / Original
Complainant, the Party 1 / Original Complainant further say that, had
no Grievance and Complaint against the Party 2 / Accused.
5. That, on the receipt of the said amount to the Party 1 / Original
Complainant, the Party 1 / Original Complainant undertakes to

 withdraw his complaint filed against the party 2/ Accused and
cooperate with the accused for bail and Anticipatory bail and further
to grant consent to quashing for the F.I.R.
6. Whatever stated above is true and correct and best of knowledge of
all the both the parties.
