Air Law and ATC Procedures

1944 – 32 states signed convention on International Civil Aviation (7300) in Chicago
They signed also: Doc7500 (International Air Services transit Agreement)
Doc 9587 (Transport agreement of ‘five freedoms agreement’)

Rules:
Art 1: Sovereignity (Elk territorium mag zelf bepalen we wel of niet in hun luchtruim mag)
Art 2: National Airspace (Airspace loopt van land naar luchtruim, open water is voor iedereen)
Art 5: Non-scheduled air services (3 Freedoms for general aviation flights)
1. overfly a country without landing there,

3. allow to pick up mail, cargo, passengers (based on rules state)
Wel moeten deze vliegtuigen zich aan routes houden die de states voorleggen.
Art 10: Every plain needs to land at custom airport at other country
No matter what nationality a plain is, stick to air regulations in the state you are.
Art 12: Rules of the air: elke staat is verantwoordelijk voor naleving regels. Contracting state needs to
prosecute violations.
Art 13: Entry and clearance regulations: Entry, clearance, immigration, customers regulations for passengers,
crew and cargo shall be complied with.
Art 16: Search of aircraft: Every authority has right to search aircrafts, without unreasonable delay
Art 22: Facilitation of formalities: state must take measures to prevent unnecessary delays due to
administration, immigration, etc.
Art 23: Custom and Immigration procedures: nothing shall prevent oprichting custom-free airports.
Art 24: Customs duty: Temporarily duty-free for fuel, consumables or spare parts, provided those items remain
on board.
Art 29: Documents to be carried in aircraft, such as crew licenses, passenger list, certificate or registration and
airworthiness. Cargo manifest.
Art 30: Use of Aircraft Radio Equipment: only use radio with crew license to install and operate.
Art 31: Certificate of Airworthiness: issued by state in which plane is registered.
Art 32: Licenses of Personnel: pilot license issued by authorities where aircraft is registered.
Art 33: Recognition of Certificates and Licenses: licenses issued recognised as being valid by another
contracting state. (issued with minimum standards of the convention).
Art 34: Journey Log Books: voorgeschreven door contracting state met aircraft particulars and crew data.
Art 35: Cargo Restrictions: Transportation of weapons and war ammunition only allowed if the state overflown
has granted permission.
Art 36: Photographic Apparatus: je mag als staat kiezen om geen foto’s toe te staan in luchtruim.
Art 37: Adoption of International Standards and Recommended Practices: Iedereen moet moeite doen to aim
for uniformity in regulations, standards and procedures. Technical part is for the International Civil
Aviation Organisation. Differences in standards or recommended practices should be published in the
National Aeronautical Information Publication of the state. Amendement to an International Standard,
state must give notice within 60 days of adoption to the ICAO Council.

There are 19 annexes from ICAO (2,5,7,8 contain no recommended practices, rest contain both). (ALLEMAAL

Art 39: Endorsement of Certificates and Licenses: when aircraft or pilot fails to meet standards, will be attached
to certificate of Airworthiness or Pilot License.
Art 40: Endorsement of Certificates and Licenses: No aircraft or personnel having licence so endorsed, shall
participate in International navigation except with permission of state that is entered.
