A RESOLUTION AUTHORIZING SHOW CAUSE HEARING
WHEREAS, Section 16-101 of the Code of Ordinances provides procedure for
revocation or suspension of license or refusing to grant a license; and
WHEREAS, the Montgomery Police Department through Mayor Strange has
requested a Show Cause Hearing for Melinda Futrell, d/b/a Club Sky Bar, 3627 Debby Drive,
Montgomery, Alabama 36111, by the Council pursuant to the attached memorandum to
Chief of Police Finley (Exhibit A); and
WHEREAS, said Exhibit A list the calls for service and incidents at this business
location; and
WHEREAS, the Council of the City of Montgomery desires to schedule a show cause
hearing for Melinda Futrell, d/b/a Club Sky Bar, 3627 Debby Drive, as to why her business
license should not be revoked pursuant to offenses as set forth in Exhibit A, and as set forth
in Section 16-101 of the Code of Ordinances of the City of Montgomery:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MONTGOMERY, ALABAMA, that, Melinda Futrell, d/b/a Club Sky Bar, 3627 Debby
Drive, Montgomery, Alabama 36111, is hereby set for a Show Cause Hearing on Tuesday,
January 21,2020 at 5:00 p.m. to show cause why her business licenses should not be revoked,
and City Clerk is instructed to notify licensee. Licensee may be represented by an attorney
and have witnesses to appear at said hearing.

Club Sky Bar — Show Cause Hearing Request
Tam requesting a Show Cause Hearing for Club Sky Bar. During the probationary period, Club
Sky Bar has failed to adhere to the stipulations agreed upon with the Montgomery Police
Department. There has been additional crime reported at the business. Just recently, a robbery
occurred at Club Sky Bar in which the owner was arrested. Due to the continuous crime at the
business and the failure of meeting the requirements, I am requesting the revocation of Club Sky
Bar’s business license.

from the general funds thereof in amounts not exceeding $6,000,000 and (ii) any such
reimbursement be made in accordance with Treas. Reg. 1.150-2.
Section 3. This Resolution shall not compel the City to execute and deliver the tax-
exempt lease referenced herein.
Section 4. All ordinances, resolutions, orders, or parts of any thereof, of the City
in conflict, or inconsistent, with any provision of this resolution hereby are, to the extent of
such conflict or inconsistency, repealed.
Section 5. This Resolution shall take effect immediately.
Councillor Bollinger made a motion to suspend the rules in order that the foregoing
resolution could be placed upon its final passage, which motion carried with the following
vote:

The Clerk stated this was the time and place for the Show Cause Hearing on the
proposed Revocation of the Business License of Melinda Futrell, d/b/a Club Sky Bar, 3627
Debby Drive. Ms. Melinda Futral was present representing this item. Chief Finley was
present representing MPD. Ms. Futrell agreed to the stipulations as set forth by C!
and reflected in his memorandum.
The Clerk stated this was the time and place to hear and consider the following,

WHEREAS, pursuant to Resolution No. 186-2019, under the provisions of Section 16-
101 of the Code of Ordinances, the Business License of Melinda Futrell, d/b/a Club Sky Bar,
3627 Debby Drive, Montgomery, AL 36111, was scheduled for a Show Cause Hearing as to
why her business license for this establishment should not be revoked; and
WHEREAS, Melinda Futrell, d/b/a Club Sky Bar, 3627 Debby Drive, Montgomery,
AL 36111, was afforded a hearing on October 1, 2019, concerning said license; and
WHEREAS, after reviewing all the facts, the City Council is of the opinion that the
business license of Melinda Futrell, d/b/a Club Sky Bar, 3627 Debby Drive, Montgomery,
AL 36111, should be revoked by adoption of this resolution:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MONTGOMERY, ALABAMA, that said Council revokes said license and the Director of
Finance is hereby instructed to revoke the Business Licenses of Melinda Futrell, d/b/a ClubSky Bar, 3627 Debby Drive, Montgomery, AL 36111, and the owner/proprietor of the
business must appear before the City Council prior to being awarded any future business
license.

Upon receipt and review of the recommendation from the Club Sky Bar, Iam presenting four additional
stipulations of the Club Sky Bar to City Council. The following are the stipulations | aon requesting to be
ceadorsed by the City Council and put into the minutes:

3. The security company must be approved by the Alabama Security
Regulatory Boar.
4. A security mechanism must be in place inside the Club Sky Bar hat allows

Lam also requesting that the hearing on the proposed revocation ofthe business license of Club Sky Bar be
placed on hold fora period upto six (6) months for review and monitoring.
It was the consensus of the Council to allow Chief Finley and MPD up to six months
for their review of this establishment and the compliance of the owners to the stipulations as
discussed and set forth in Chief Finley’s memorandum.
The Clerk stated this was the time and place for the Show Cause Hearing on the
proposed Revocation of the Business License of Vencine Smith and Javar Bruce, d/b/a Club
Envi, 3439 McGehee Road. Mr. Javar Bruce was present representing this item. ChiefG-11- 2019
