Suit  is for declaration that the plaint scheduled propertyies exclusively
belong   to   plaintiff,   consequential   permanent   injunction   restraining   the
defendants and their men , declaration that the cancellation of release deed
document   No.   1161/2003   dated   21.05.2003   and   the   sale   deed   document
number 1237/2003 dated 30.05.2003 are not binding on the plaintiff and for
costs.

This suit was originally filed before Principal District Munsif
Court, Tirunelveli as O.S.No. 387/2003. Subsequently as per order in Tr.O.P.
190/2004 transferred to this Court and renumbered as O.S. 71/2005. This suit
came up before this Court on 22.02.2019 for final hearing, in the presence of
Thiru. G. Maharajan Advocated for the Plaintiff and of Thiru. R. Ramakrishnan
Advocate for the 2nd defendant and of Tmt. A.Kannagi advocate for 3,4 and 5
defendants and 1st defendant died and upon hearing the argument of both
sides and on perusing evidence and exhibits of both sides and having stood
over for consideration till this day this court  delivered the following  :
DECREE

1.That the Suit be and the same is hereby decreed declaring the  
title of plaintiff  over the plaint Scheduled properties.
2. that the defendants 2 to 5 are hereby restrained by an order of 
permanent injuction not to disturb the peaceful possession of the  
plaintiff over the plaint scheduled property .
3.   that   the   cancellation   deed   doucment   No.   1161/2003   dated  
21.05.2003 of Joint No.2 Sub registrar, Tirunelveli and sale deed   
document   No.   1237/2003   dated   30.05.2003   of   Joint   No.2,   Sub  
Registrar, Tirunelveli  are hereby declared as null and void and not 
binding on this plaintiff.
4. that both the parties directed to bear their own costs.
