COMES NOW PLAINTIFF, through undersigned counsel, and unto

this Honorable Court most respectfully states that:

In compliance with the directive of this Honorable Court to show

proof of notice to the adverse party, EL PALMA BUS LINER/ARABIA
BOY EXPRESS, of the Motion For Leave of Court to File Second
Amended Complaint, plaintiff has gone to the terminal of EL PALMA
BUS LINER and personally handed to one ELVERA PALMA a copy of the
said motion on August 10, 2009, despite which no responsive pleading
has been filed up to the present. A copy of the motion bearing the
signature of Elvera Palma on the first page of the motion is hereto
attached while the motion with the original signature is already
attached to the record of the case.

WHEREFORE, it is most respectfully prayed of this Honorable

Court to consider the proof of notice as sufficient compliance with the
requirement of due notice to adverse party and to grant the Motion to
File Second Amended Complaint.
