COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS

This agreement is made and executed by and between:

________________, of legal age, Filipino, single and a

resident of Davao City, Philippines, hereinafter referred to as
the “PRIVATE COMPLAINANT”;

-and-

________________, of legal age, Filipino, married, and

a resident of Davao City, Philippines, hereinafter referred to
as the “ACCUSED”;

The PRIVATE COMPLAINANT and the ACCUSED

shall be hereinafter collectively referred to as the
“PARTIES”;

WITNESSETH, THAT:

WHEREAS, the PARTIES are the litigants Criminal Case Nos.

________________, entitled People of the Philippines vs. ________________, pending
before the Municipal Trial Court in Cities, Branch __ in Davao City, Philippines, for
Violation of B.P. 22;

WHEREAS, the criminal cases were filed because of the issuance by the
ACCUSED of ___ (_) checks in the aggregate amount of ________________ Pesos (Php
_________.00) in favor of PRIVATE COMPLAINANT;

WHEREAS, the parties desire to enter into an amicable settlement in order to

end the controversy;

NOW THEREFORE, for and in consideration of the above-premises, the

PARTIES hereby agree as follows:

1) The PRIVATE COMPLAINANT and ACCUSED agree that the

abovementioned criminal cases be settled in the amount of ________________ PESOS
(Php ________________.00), which shall be paid in the following manner:

a) Upon the signing of this Agreement, the ACCUSED agrees to pay PRIVATE
COMPLAINANT the amount of _____________ PESOS (Php __________.00)
as downpayment;

b) The remaining balance of ________________ PESOS (Php _________.00) shall

be paid by the ACCUSED in cash in favor of the PRIVATE COMPLAINANT
in ____________ (__) equal monthly installments, in accordance with the
following schedule:

c) The ACCUSED shall have a seven (7)-day grace period following the
payment due dates as provided above, within which to make the said
payments;

d) On the scheduled dates of payment indicated above, and within the 7-day
grace period given, such cash payments shall be delivered by the ACCUSED
to PRIVATE COMPLAINANT’s counsel at _____________;

2) The ACCUSED agrees that in case of default in any of the above-

mentioned payments, the entire obligation shall become due and demandable. Further,
in case of default on the part of the ACCUSED, the PRIVATE COMPLAINANT shall
be entitled to the execution of this agreement without necessity of demand and/or
notice, without prejudice to the filing of other appropriate action under the Revised
Penal Code and other applicable laws. Furthermore, if the ACCUSED fails to pay his
obligations, the PRIVATE COMPLAINANT shall likewise have the option to cause the
revival of the criminal cases against the ACCUSED by causing the re-filing of the
corresponding Informations before the court;

3) In case of execution proceedings, the ACCUSED agrees to pay the original

obligation in the sum of _____________PESOS (Php_______.00) less the amount that has
already been paid, plus twenty five (25%) percent of the remaining balance as attorney’s
fees. All other expenses of execution in enforcing the judgment shall be for the account
of the ACCUSED;

4) Conditioned upon the faithful compliance of this Agreement, the

PARTIES shall move for the provisional dismissal of the above-enumerated criminal
cases before the Honorable Courts where such cases are pending;

5) Upon the provisional dismissal of the said criminal cases, the ACCUSED,
on the same day the case is provisionally dismissed, shall immediately move for the
release of the abovementioned cash bond deposited with the Office of the Clerk of
Court, amounting to _____________PESOS (Php _____________.00), and upon the
release of the said amount, shall then be delivered to PRIVATE COMPLAINANT’s
counsel in his office address as indicated above.

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in the City of Davao, Philippines,
personally appeared the PARTIES whom I have identified through their respective
competent evidence of identity as indicated above and who represented themselves to
me to be the same persons who executed the foregoing Compromise Agreement,
consisting of three (3) pages including the page on which this Acknowledgment is
written, the same having been signed by the parties and their witnesses on each and
every page hereof, and acknowledged and sworn to me that the same is their own free
act and voluntary deed.
