Subject : Gang Assault on a Drunken Man at the Storefront, October 23, 2017

Problem Description

A commotion happened in front of our store last October 23, 2017 at around 2:51 a.m. where a
group of seven people, whose ages range from early teens up to late twenties, assaulted a male
in his mid-twenties. At first, the victim rushed inside our store at around 2:34 a.m. and was
consequently followed by the group. The latter’s entry was promptly dissuaded by SG Carlo A.
Legacion and Mr. Joshua C. Espiritu, utility man. Seeing both the fact that the man was drunk
and the danger that might arise upon the forced entry of the group, SG Legacion requested him
to leave the premise. Mr. Espiritu notifed Ms. Nelia O. Valdez, supervisor, of the incident and from
her end connected with the nearest police station for assistance. SG Legacion then turned to the
group outside and warned them to disperse quietly since the police will be arriving soon. The
victim stayed inside until 2:50 a.m. when he headed towards the entrance and waved at the
tricycle’s queue but the driver did not respond. When he was assured that no one was outside
the store, he stepped out. However, at 2:51 a.m. the group suddenly appeared out of nowhere
and pounced on the victim. The commotion lasted only for a minute since SG Legacion took the
shotgun; thus, the group abruptly fled away. He claimed that his act was only intended to disperse
the group to prevent the victim from being harmed further. At around 2:53 a.m., the mobile patrol
arrived and took the victim.

As early as 6:00 a.m., two females claiming to be the siblings of the victim came to our store
threatening to charge both SG Legacion and Ms. Valdez with negligence resulting to assault of
their brother. However, the desk officer of the police station concerned assured that we have no
liability since we have done our part.

Morning
Tony Valdez 45-year old carpenter fell from bridge 80 ft into the river and died no life jacket on
Account of workers – placed metal bridge decking onto the bridge deck to be welded into place
then stepped onto decking that was not yet secured

Action Taken

The employees who witnessed the incident cooperated with the inquiry and investigation of the
police on site. Nevertheless, the store operation was not affected and continued with its business.
SG Legacion particularly went to the police station after his duty to clarify the incident. The
following day, I validated the police reports with SPO1 Joselito D. Fernandez, Desk Officer, if
indeed our establishment was neither mentioned nor charged by the victim but none was found.

Recommendations

I recommend SG Legacion be assigned to another of our outlet. Although the incident was
responded appropriately, the victim might harbor a grudge against him. This will also serve as
protection for him and our store as well.20 years experience in
Occupational Safety and Health Administration (OSHA) requires safety nets whenever a work are
is 25 ft or more above ground or water also requires life jackets or buoyant work vests for
employees working near or over water
