DEFINITION OF TERMS
Legal
Allowable or enforceable by being in conformity with the law of the land and the public policy; not
condemned as illegal
Moral
Concerned with or derived from the code of behavior that is considered right or acceptable in a
particular society
Ethics
Ethics is a branch of philosophy that is concerned with moral principles of behavior or conduct of
individuals in society. Ethics defines and provides ideas that sustain action that is good and right in terms
of obligation, fairness and benefits to society.
Ethics is the “melting pot” of those grey areas not covered with formal sanctions such as laws, or
religious convictions
Law
Generally, law is any set of rules that guide the conduct of individuals/groups in a given set up and is
enforced by those in authority. They include the constitution, acts of Parliament and/or rules. Law may
start from the family and community levels, to national and international levels. Laws can be written or
unwritten.
Characteristics of Law
Set of Rules: Law is a set or body of rules. These rules may originate from customs, acts
of parliament, court cases or some other acceptable sources.
Guidance of human conduct: These are enforced to guide human conduct. Human beings
follow these rules for their own safety and betterment.
Enforcement: The law must be enforced. Enforcing agencies include the Police, and the
Court of law.
Establishing Standards
The law is a guidepost for minimally acceptable behavior in society. Some activities, for instance,
are crimes because society (through a legislative body) has determined that it will not tolerate
certain behaviors that injure or damage persons or their property. For example, under a typical
state law, it is a crime to cause physical injury to another person without justification—doing so
generally constitutes the crime of assault. Aid planning

Resolving Disputes
Disputes are unavoidable in a society made of persons with different needs, wants, values, and
views. The law provides a formal means for resolving disputes—the court system.
The constitution and statutes of Kenya and its constituent states provide for various rights. A
purpose and function of the law is to protect these various liberties and rights from violations or
unreasonable intrusions by persons, organizations, or government
Why should we study information ethics
Studying ethics will teach us how to avoid information abuse and catastrophes.
We should study ethics because the use of computers in information transfer opens up
new ways to exploit, covet, and hide information.
We should study information ethics because the use of computing technology will create
ethical issues that require special study
We should study ethics because the set of novel and transformed issues is large enough
and coherent enough to define a new field.
