AFFIDAVIT OF LOSS

I, ALBERT JEFFREY DELFINO y TULAÑA, of legal age, single,

Filipino and presently residing at 2010-A Severino Reyes Street, Sta. Cruz,
Manila, after having been duly sworn to in accordance with law, depose
and state:

1. That I was formerly issued a Philippine Passport by the

Department of Foreign Affairs on December 7, 1992 bearing Passport
Number L513593 which expired on December 7, 1997;

2. That in view of the fact that I was only six (6) years old when I
was issued a Passport, and was able to use the said passport only once
when I was only eight (8) years old when me and father went to Malaysia;

3. That in view of my minority then, the said passport was

entrusted to another relative of ours when we returned to the Philippines;

4. That despite exhaustive measures taken by me and my

relatives for the longest time, we can no longer find the said passport;

5. That I am executing this affidavit to attest to the truth of the

foregoing statement and likewise to be able to secure a new Passport.

1. That since I passed the Medical Technology Board in

September 2002 I did not practice my profession as Medical Technologist
due to the fact that I went to the province to attend to the need of my
parents;

2. That I am executing this affidavit to attest to the truth of the

foregoing and for whatever legal purpose this may serve.

I, NERISSA P. TUNGCAB, of legal age, married, Filipino citizen, and

with postal address at B40 L14 Villa Luisa North, Bagumbong, Caloocan
City, after having been duly sworn in accordance with law do hereby
depose and state that:

1. I am an employee of PUBLIC ATTORNEY’S OFFICE – Manila

District Office and was issued a Company ID;

2. On May 29, 2006 while I was having my lunch break outside

the office I left my bag in my drawer and when I came back
may bag was missing, somebody stole my bag;

3. The said bag contained several identification cards, cellphone

and documents, to wit:

1. PAO ID;
2. Cellular phone; and
3. Several documents.

4. That I am certain that the bag is beyond recovery;

5. I am executing this affidavit to attest to the truth of the

foregoing for whatever legal purpose it may serve.

REPLY-AFFIDAVIT

WE, GERALDINE A. ESTENZO and RITCHELLE A. MANGAOANG,

both of legal age, after having been sworn in accordance with law do
hereby depose and state that:

1. The allegations and averments contained in our Affidavit dated

3rd day of November 2003, a copy of which is hereto attached as
Annex “A”, are deemed reproduce and reiterated herein;

2. The allegations of Merla Ilagan in her Counter-Affidavit dated

June 18, 2004 are mere fabrication and should not be given
scant consideration for whatever purpose said Counter-Affidavit
was executed;

3. The signature of Ms. Ilagan, which she alleged as forgery was

made by Ms. Ilagan herself in the 2 February page of my diary in
my (Geraldine Estenzo) presence and for the purpose of
acknowledging receipt of the amount of P10, 000.00. As
evidence, attached hereto is a copy of said page of my diary as
Annex “B” hereof;

4. Based on the aforementioned Affidavit (Annex “A”) executed by

herein affiants, there is probable cause to hold Ms. Merla Ilagan
liable for illegal recruitment and/or Estafa, and the averments in
her Counter-Affidavit dated June 18, 2004, are evidentiary
matters which should be proven in a full blown trial;

5. We are executing this Reply-Affidavit to attest to the truth of the

foregoing and for whatever legal purpose this may serve.
