That this Deed is entered into and executed by EXPEDITO J. LINEJAN, of legal age,
Filipino, married, and a resident of Poblacion, Sibulan, Negros Oriental, hereinafter called the
FIRST PARTY; and in favor of,
GEMMA P. LINEJAN, in her behalf and in behalf of her minor child EDSEL P.
LINEJAN, as Guardian Ad Litem, married; and GREFEL JANE P. LINEJAN, single; and
GEXYL P. LINEJAN, single, all of legal ages, Filipinos, and residents of Poblacion, Sibulan,
Negros Oriental, hereinafter called the SECOND PARTIES;
W I T N E S S E T H:
That Spouses EXPEDITO J. LINEJAN and GEMMA P. LINEJAN are conjugal owners
of three (3) parcels of land known as (1) Lot No. 409, situated in barangay Poblacion,
Santander, Cebu, covered by Original Certificate of Title No. OP-55532, consisting of One
Thousand Fifty Six (1,056) square meters, more or less; with an improvement found therein
which is a house covered by Tax Declaration No. 410001-00921 with a Market value of
Php370,000.00; (2) Lots Nos. 383-C, 383-D, & 383-E, being a portion of Lot No. 383 consisting
of Three Hundred Forty Five (345) square meters, more or less, which they acquired thru
purchase in a document known as Doc. No. 1076; Page No. 82; Book No. VII; Series of 2006
notarized by Judge Tirso F. Banquerigo, Ex Officio Notary Public, with an improvement found
therein which is a house; (3) Lot No. 468-A, being a portion of Lot No. 468, consisting of One
Hundred Sixty Seven (167) square meters, more or less, with an improvement therein which is a
house and acquired by them by purchase in a Deed known as Doc. No. 194; Page No. 38; Book
No. X; Series of 2005, notarized by Geoffrrey P. Villahermosa, Notary Public; and portion of Lot
No. 468, consisting of Twenty Six (26) which they acquired thru purchase in a Deed known as
Doc. No. 205; Page No. 42; Book No. 35; Series of 2005, notarized by Atty. Santiago Sameon V,
Notary Public;
That for an in consideration of the sum of TEN PESOS (Php 10.00), Philippine Currency,
coupled with LOVE and AFFECTION to the SECOND PARTIES, they being his wife and ren,
and that by virtue of these presents the FIRST PARTY, does hereby TRANSFER and CONVEY
unto the SECOND PARTIES, their heirs and assigns, ALL his rights, interests and participations
over the aforementioned parcels of land including all of the improvements found therein and
WAIVE and QUIT all his claim over the aforementioned parcels of land in favor of the
SECOND PARTIES herein, free from all liens and encumbrances;
WITNESSETH FURTHER:
That the FIRST PARTY is allowed to stay in the Houses found on the aforementioned
parcels of land alone without a paramour, except when already encumbered to a third party;
That the First Party will sent to his wife and children an allotment of NINETY SIX
THOUSAND PESOS (Php96,000.00) from his salary abroad, as a Chief Engineer;
That the First Party shall also settle their accounts or Loan with the Dumaguete City
Development Bank in the amount of TWO HUNDRED THOUSAND PESOS,(Php200,00), more
or less.
That the parties herein declare that this parcels of land are not subject to the
Comprehensive Agrarian Reform Law because they are all Residential Lots.
