DEED OF HEIRSHIP AND PARTITION

KNOW ALL MEN BY THESE PRESENTS:

This Deed is entered into and executed by FABIAN ABO, married to Purifacation
Fonollera, AGUSTIN ABO, married to Gregoria Hipolan, and FELIPE A. DIONANAO, married
to Anita Duran, all of legal age, Filipinos, and residents of barangay Balugo, Sibulan, Negros
Oriental,

WITNESSETH:

That there is a parcel of land known as Lot No. 4156 of the Cadastral Survey of Sibulan,
Negros Oriental, situated in barangay Maningcao, Sibulan, Negros Oriental registered in the
name of FLORENCIO ABO, covered by Original Certificate of Title No. O-V-458 ; and which
parcel of land is more particularly described as follows

“A parcel of land (Lot No.4156 of the Cadastral Survey of Sibulan, Cadastral Case No.
16, L.R.C. Cadastral Record No. 359), with improvements thereon, situated in the Barrio of
Maningcao, Sibulan, Negros Oriental. Bounded on the N & NE., by Lot No. 4197; on the SE.,
Lots Nos. 4197 & 4161; on the S., by Lot No. 4160; and on the North-West by Lots Nos. 4159,
4157 and Sapang Tulac; containing an area of Forty Thousand Six Hundred Fifty Two (40,652)
square meters, more or less”.

That in an instrument known as Deed of Extrajudicial Settlement and Sale under Doc.
No. 76; Page No. 20; Book III; Series of 1973, notarized by HUMBERTO D. DIPALING,
Notary Public; the Heirs of the late FLORENCIO ABO, namely: AGUSTIN ABO, TEODORA
ABO, FABIAN ABO, and the children of APOLONIA ABO, namely: URBANO ABO; FELIPE
and HERMOSO all surnamed DIONANAO; had settled and adjudicated among themselves the
above-described parcels of land in a proportion of one-fourth (1/4) each considering that there
were four legitimate children and only compulsory heirs of the late Florencio Abo; FURTHER,
in the same Deed, TEODORA ABO, had sold her one-fourth (1/4) to FABIAN ABO, moreso, the
latter owned One-Half (1/2) share of the above-described parcel of land;
That URBANO ABO, died intestate sometimes in 1999, leaving without any testamentary
will nor debts not settled until the present and upon his death he was survived by his half
brothers, FELIPE and HERMOSO, all surnamed DIONANAO, because he died single without
any offspring;

That the parties herein y have agreed and caused the subdivision of the said parcel of land
into three sub-lots, namely: Lot No.4156-A; Lot 4156-B; and Lot No. 4156-C which are more
particularly described as follows:

LOT NO. 4156-A, Psd-07-076254

“A parcel of land, Lot No.4156-A, Psd 07-076254, being a portion of Lot 4156, Sibulan
Cadastre, Cad 141, (LRC Record 359), located in barangay Maningcao,Sibulan, Negros Oriental.
Bounded on the NW, along line 1-2-3 by Sapang Tulac; on the NE & SE., along line 3-4-5-6 by
Lot 4197; on the SE., along line 6-7 by Lot 4161; and on the SW along line7-8-1 by Lot 4156-B;
containing an area of TWENTY THOUSAND THREE HUNDRED TWENTY FIVE (20,325)
square meters, more or less.”

“A parcel of land (Lot 4156-B, Psd 07-076254, being a portion of Lot No.4156), Sibulan
Cadastre, situated in barangay Maningcao, Sibulan, Negros Oriental. Bounded on the NE, along
lines 1-2-3 by Lot No. 4156-A; on the SE, along line 3-4 by Lot 4161; on the SW, along line 4-5-
6 by Lot No. 4156-C; and on the NW, along line 6-1 by Sapang Tulac; containing an area of
TEN THOUSAND ONE HUNDRED SIXTY THREE (10,163) square meters, more or less”;

“A parcel of land (Lot No. 4156-C, Psd-07-076254, being a portion of Lot No. 4156,
situated in barangay Maningcao, Sibulan, Negros Oriental. Bounded on the NW., along line 1-2
by Sapang Tulac; on the NE., along lines 2-3-4 by Lot 4156-B; on the SE., along line 4-5 by Lot
No. 4161; on the SW., along line 5-6 by Lot No. 4160; and on the NW., along 6-7 by Lot 4159;
and along lines 7-8-1 by Lot No. 4157; containing an area of TEN THOUSAND ONE
HUNDRED SIXTY FOUR (10,164) square meters, more or less.”

That, in order that the rights, interests, and participations of the parties herein over the
above-subdivided parcels of lands be better served, they have mutually and voluntarily agreed to
officially partitioned and adjudicated unto themselves the above-described sub-lots and be
forever bound by this partitioned into the following manner:

1. Lot No. 4156-A, as above-described, shall belong to FABIAN ABO;

2. Lot No. 4156-B, as above-described, shall belong to AGUSTIN ABO; and,
3. Lot No. 4156-C, as above-described, shall belong to the Heirs of Apolonia Abo,
namely FELIPE and HERMOSO, all surnamed DIONANAO;

That further, the parties herein declare that the said parcels of land are not covered by the
provisions of the Comprehensive Agrarian Reform Law of the Philippines for they were the ones
in actual possessions of the said parcel lands,
