Plaintiffs BANYAN LICENSING L.L.C. and CONTOUR PRODUCTS, INC.
(collectively “Banyan”), bring this action against Defendant MENARD INC. (“Menard”) for
patent infringement, alleging as follows:
NATURE OF THE LAWSUIT
1. This is a civil action involving patent infringement, arising under the patent laws of
the United States, 35 U.S.C. § 1 et seq. Banyan seeks to enjoin Menard’s infringement and recover
monetary damages, along with all other appropriate relief, resulting from Menard’s unauthorized
manufacture, use, sale, offer to sell, and/or importation into the Unites States for subsequent use
or sale of products that have infringed, or do infringe, United States Design Patent Number
D846,312 S, entitled “Pillow” (hereinafter the “’312 Patent”).
PARTIES
2. Banyan Licensing, L.L.C. is a limited liability company organized under the laws
of North Carolina, having a principal place of business at 1430 West Pointe Drive, Ste. K,
Charlotte, North Carolina, 28214. Banyan Licensing L.L.C. is the owner and assignee of the ’312
Patent.
3. Contour Products, Inc. is a corporation organized under the laws of North Carolina,
having a principal place of business at 1430 West Point Drive, Ste. K, Charlotte, North Carolina,
28214. Contour Products, Inc. is the exclusive licensee of the ’312 Patent.
4. On information and belief, Menard is a corporation organized under the laws of the
state of Wisconsin, having a principal place of business at 5101 Menard Drive, Eau Claire,
Wisconsin, 54703, and is doing business in this State and District.
JURISDICTION AND VENUE
5. This Court has subject matter jurisdiction over this action pursuant to 28 U.S.C.
§§ 1331 and 1338(a) as this action arises under the Patent Laws of the United States, 35 U.S.C.
§ 100 et seq.
6. This Court may exercise personal jurisdiction over Menard based upon Menard’s
contacts with this forum, including regularly and intentionally doing business here. Menard,
directly, or through intermediaries, ships, distributes, offers for sale, sells, and advertises various
products in this State and District, including upon information and belief the products accused of
patent infringement. More specifically, on information and belief, Menard makes, uses, offers to
sell, sells, markets, distributes, and/or imports products embodying the invention patented in the
’312 Patent, including a Miracle Knee Pillow (“Miracle Pillow”) and a Linear Leg Pillow (“Linear
Pillow”), within this State and District and without the authority of Banyan, as shown and
described in Exhibit A.

7. As set forth herein, upon information and belief, Menard has committed patent
infringement and has contributed and induced acts of infringement by others, within this State and
District, and continues to infringe presently in this State and District.
8. Venue is proper in this Judicial District pursuant to 28 U.S.C. §§ 1391(b)-(c), and
§ 1400(b).
COUNT I
(Infringement of the ’312 Patent)
9. Banyan realleges and incorporates by reference the foregoing paragraphs herein.
10. Banyan owns all the rights and interest in ’312 Patent. A true and accurate copy of
the ’312 Patent is attached as Exhibit B.
11. The ’312 Patent was duly and legally issued by the United States Patent and
Trademark Office on April 23, 2019. The ’312 Patent is presumed valid.
12. The ’312 Patent relates to a novel and non-obvious ornamental design for a pillow,
as shown and described in Exhibit B.
13. Banyan has developed, manufactured, and made commercially available the
Contour Legacy Knee Pillow (the “Banyan Product”) based on ’312 Patent.
14. On information and belief, Menard makes, uses, offers to sell, sells, markets,
distributes, and/or imports products embodying the invention patented in the ’312 Patent, including
the Miracle Pillow and the Linear Pillow, through numerous retail stores and outlets throughout
several states in the United States, including within this State and District, without the authority of
Banyan. Moreover, Menards own website shows that it sells and has sold the Miracle Pillow and
the Linear Pillow, either online or in stores. See Exhibit C.
15. Menard has infringed and continues to infringe the ’312 Patent within the meaning
of 35 U.S.C. § 271.

16. The claimed ornamental design for a pillow in the ’312 Patent is shown in Figures
1-21 of the patent and described in the figure descriptions accompanying the figures in the patent.
See Exhibit B.
17. Comparisons of the product designs claimed in Figures 8-14 of the ’312 Patent, the
Banyan Product, and the Miracle Pillow are attached hereto as Exhibit D. The photographs are
true and accurate images of the Banyan Product and the Miracle Pillow, both purchased from
Menards as shown in Exhibit E. Below, representative images of the ’312 Patent (Figure 8), the
Banyan Product, and the Miracle Pillow demonstrate how the Miracle Pillow infringes patented
product designs in the ’312 Patent and how it is a replica of the Banyan Product:

18. In the eye of the ordinary observer familiar with the relevant prior art, giving such
attention as a purchaser usually gives, the claimed design of the ’312 Patent (as shown in at least
Figures 8-14) and the design of the Miracle Pillow are substantially the same, such that the ordinary
observer would be deceived into believing that the pillow design of the Miracle Pillow is the design
claimed in the ’312 Patent.

19. Comparisons of the product designs claimed in Figures 8-14 of the ’312 Patent, the
Banyan Product, and the Linear Pillow are attached hereto as Exhibit F. The photographs are true
and accurate images of the Banyan Product and the Linear Pillow, which was also purchased from
Menard as shown in Exhibit G. Below, representative figures of the ’312 Patent (Figure 8), the
Banyan Product, and the Linear Pillow demonstrate how the Linear Pillow infringes patented
product designs in the ’312 Patent and how it is a replica of the Banyan Product:

20. In the eye of the ordinary observer familiar with the relevant prior art, giving such
attention as a purchaser usually gives, the claimed design of the ’312 Patent (as shown in at least
Figures 8-14) and the design of at least the Linear Pillow are substantially the same, such that the
ordinary observer would be deceived into believing that the pillow design of the Linear Pillow is
the design claimed in the ’312 Patent.
21. Banyan did not give Menard authorization or license to make, use, offer to sell, sell
or import into the United States the infringing products.
22. Banyan has directly infringed, and continues to directly infringe, the ’312 Patent by
making, using, offering to sell, selling and/or importing pillows, including the Miracle Pillow and

the Linear Pillow, having substantially the same ornamental design as the design claimed in the
’312 Patent, in violation of 35 U.S.C. § 271(a) and § 289.
23. On information and belief, Menard has had actual knowledge of its infringement of
the ’312 Patent since at least as early as the date Menard received service of the complaint in this
action.
24. Menard has had constructive knowledge of the ‘312 Patent because the Banyan
Product has been properly marked pursuant to 35 U.S.C. § 287(a).
25. On information and belief, Menard is actively, intentionally, and/or knowingly
inducing the infringement of the ’312 Patent by encouraging and promoting the use by others of
pillows that infringe the ’312 Patent, including but not limited to the Miracle Pillow and the Linear
Pillow as provided by or through Menard in violation of 35 U.S.C. § 271(b).
26. On information and belief, Menard has sold and continues to sell, offer to sell,
distribute and market pillow products that infringe the ’312 Patent, including the Miracle Pillow
and the Linear Pillow, to end consumers with the intent that these parties will use the products in
the United States in violation of Banyan’s rights in the ’312 Patent.
27. On information and belief, Menard knew or should have known that the
manufacture, use, offering to sell, sale and/or importation of the infringing products by Menard or
its customers would infringe the ’312 Patent.
28. On information and belief, Menard engaged, with full knowledge of Banyan’s
rights in the ’312 Patent, in solicitation of customers in an intentional effort to convince others to
purchase the Miracle Pillow and/or the Linear Pillow from Menard without regard for Banyan’s
patent rights.

29. On information and belief, Menard’s acts of infringement have been or will be
undertaken with knowledge of the ’312 Patent. Such acts constitute willful infringement and make
this case exceptional pursuant to 35 U.S.C. §§ 284 and 285, and entitle Banyan to enhanced
damages and reasonable attorneys’ fees.
30. Banyan has been damaged by Menard’s direct and induced infringing conduct.
31. Banyan has been and will continue to be irreparably harmed by Menard’s direct
and induced infringement of the ’312 Patent unless such infringing conduct is enjoined pursuant
to 35 U.S.C. § 283 and/or the equitable powers of this Court.
PRAYER FOR RELIEF
WHEREFORE, Banyan respectfully prays that the Court:
1. Enter judgment that Menard has directly and/or indirectly infringed the ’312 Patent;
2. Enter judgment that Menard willfully directly and/or indirectly infringed the ’312
Patent;
3. Enter a permanent injunction pursuant to 35 U.S.C. § 283 and/or the equitable
powers of this Court, to prevent further direct and/or induced infringement of the ’312 Patent by
Menard, its agents, servants, employees, officers, and all others controlled by or acting in concert
with them;
4. Award Banyan monetary damages, in an amount to be determined, adequate to
compensate Banyan for the infringement that has occurred, pursuant to 35 U.S.C. § 284;
5. Award Banyan any and all profits made by Menard from sales of its infringing
products pursuant to 35 U.S.C. § 289;
6. Award Banyan enhanced damages pursuant to 35 U.S.C. § 284;

7. Award Banyan its costs, expenses, and fees, including reasonable attorneys’ fees in
this action, pursuant to 35 U.S.C. § 285 and/or other applicable laws;
8. Award Banyan pre- and post- judgment interest at the maximum rate allowed by
law;
9. Award Banyan any such further legal and equitable relief as this Court may deem
just and proper.
Banyan demands a trial by jury on all issues so triable.

Authority For Civil Cover Sheet
The JS 44 civil cover sheet and the information contained herein neither replaces nor supplements the filings and service of pleading or other papers as
required by law, except as provided by local rules of court. This form, approved by the Judicial Conference of the United States in September 1974, is
required for the use of the Clerk of Court for the purpose of initiating the civil docket sheet. Consequently, a civil cover sheet is submitted to the Clerk of
