Response o Protest of Intent to Award by Letter dated December 20, 2019 Reference: Solicitation B2002 Student Transportation Services| Dear Ms, Cunningham, 1am in reeeipt of your letter on behalf of Durham School Services (“DSS”) dated December 20, 2019 ("Protest") in which DSS protests the issuance by Charleston ‘County School District (*CCSD") of the December 18, 2019 Intent to Award the above referenced solicitation to First Student, In. (“Fist”), As Director of ‘Contacts and Procurement Services for CCSD and in accordance with Section 4210 of the CCSD Consolidated Procurement Code, | am requited to attempt to reach a settlement by mutual agreement, if possible. Ihave reviewed your letter in accordance with the CCSD Procurement Code and have reviewed the procurement file for this solicitation. However, due tothe fact thatthe relief which DSS has requested inthe Protest isto withdraw the award to First and make the award to DSS, [have determined that this Protest cannot be resolved by mutual agreement. Accordingly, I will address each ofthe grounds set forth in the December 20, 2019 Protest by DSS, DSS states inthe fest paragraph of the Grounds for Protest that rand equitable review ofthe DSS bid id not occur based upon DSS's review ofthe Evaluation Summary Sheet *ESS") prepared by CCSD. ‘This solicitation was a Competitive Best Value Bid authorized under Section 1528 ‘of CCSD’s Procurement Code. Each of the Bids received in response to this solicitation were independently reviewed by the members ofthe selection panel \who completed their respective evaluation form using the eriteria described in Section 6.0 ofthe Solicitation entitled “Basis of Award.” My review has confirmed ‘that the allocation of points was weighted and calculated in accordance with the
