Dear Ms, Cunningham,
1am in reeeipt of your letter on behalf of Durham School Services (“DSS”) dated
December 20, 2019 ("Protest") in which DSS protests the issuance by Charleston
‘County School District (*CCSD") of the December 18, 2019 Intent to Award the
above referenced solicitation to First Student, In. (“Fist”), As Director of
‘Contacts and Procurement Services for CCSD and in accordance with Section
4210 of the CCSD Consolidated Procurement Code, | am requited to attempt to
reach a settlement by mutual agreement, if possible. Ihave reviewed your letter in
accordance with the CCSD Procurement Code and have reviewed the procurement
file for this solicitation. However, due tothe fact thatthe relief which DSS has
requested inthe Protest isto withdraw the award to First and make the award to
DSS, [have determined that this Protest cannot be resolved by mutual agreement.
Accordingly, I will address each ofthe grounds set forth in the December 20, 2019
Protest by DSS,
DSS states inthe fest paragraph of the Grounds for Protest that rand equitable

‘This solicitation was a Competitive Best Value Bid authorized under Section 1528

solicitation were independently reviewed by the members ofthe selection panel

Section 6.0 ofthe Solicitation entitled “Basis of Award.” My review has confirmed
