JUDICIAL AFFIDAVIT

This judicial Affidavit of LEBRON JAMES, who is the defendant of the

above mentioned case, is executed to serve his direct testimony in
the case.

This judicial affidavit s being offered to prove the following:

A. All the allegations in the complaint including all annexes and

appendices which were already marked es exhibits in the case;

B. All other relevant matters, fact and circumstances relevant and

material to this case.

This judicial affidavit was taken at the office of Atty. ________ at Real
Street Brgy 2, Tacloban City.
Questions were propunded by Atty. _____ and questions are
numbered consecutively and each question is answered by
defendant.

I am Felomina Olariat, of legal age, single. I am the defendant
of the civil case entitled “Unlawful detainer with prayer for the
issuance of writ of preliminary mandatory injunction, civil case
number R-582.”

 Ans. Para mapatud-an na an lot na gintitulohan hin TCT No. (0-
12703) -33 and TD 3301 ky akon
To prove that the lot covered by TD 3301 is owned by herein
named affiant Felomina A. Oliamot.

How did you own said lot?
Ans. An lot na my rehistro na TCT No. (0-12703) -33 and TD
3301 ky an tagiya anay hi mama
The lot covered by TD 3301 and Transfer Certificate of Title No.
(0-12703) -33 was owned by my mother named Josefina Lora.
The said TD and Transfer Certificate of Title is attached in
Annex A and B of our Answer in the case

titulo na TCT No. (0-12703) -33
The lot was originally owned by Jose Lora, the common
ancestor of defendants in this case. Upon his death, the portion
which was allocated to Josefina Lora through parition is
covered by TCT. No. (0-12703) -33
8. Ky nu mo kilala hi Ricardo Lora?
How did you know Ricardo Lora?
Ans.Patod ko hi Ricardo Lora. An nakangaran na defendant ha
kaso na ginfile ha am
Ricardo Lora is my cousin. He is named defendant in case.
9. Ky nu hiya ginkasuhan?
Why is he being sued?
Ans. He is being sued because the complainants thought that
the lot covered by said TD 3301 and Transfer Certificate of Title
No. (0-12703) -33 is owned by them and that Ricardo Lora is
unlawfully in possession of said property.
10. Ky nu hiya naukoy ngada han em tuna
Why is he staying in your property?
Ans. AN ak nanay ginpaukoy la anay hi Arcadio and Narciso
Lora, an kag-anak ni Ricardo Lora. An nabalhin nah an tuna ha
ak ngaran, gnpaukoy ko na la gjp an ira anak hi Ricardo Lora.
My mother let Arcadio and Narciso Lora, the parents of Ricardo
Lora, occupy the said lot. When I inherited the same property, I
let my cousin, Ricardo, occupy said lot temporarily which he
admits.
11. Mayda ka pa ba ginhahangyo ha notary publiko?
Do you have anything to ask before the notary public?

Yes. I would like to file for a counterclaim for filing malicious
suit that caused serious anxiety, wounded feelings and
besmirched reputation to defendant and to set an example to
those who would file same malicouse and baseless suits.
