Building Control Guidance Note 1

These notes are intended to assist in the calculation of the charges payable when a submission is
made under the Building Regulations.

The following tables show charges for particular types of work and are made under the Building
(Local Authority Charges) Regulations 1998.

If you have any difficulties calculating the charges, please contact the Building Control Group on
01702 215345.

VAT - All charges (except a regularisation charge) are subject to VAT at the appropriate rate.

Full Plans Submissions -The fee payable may be split into two parts; ‘the plan charge’ (which
must accompany the deposit of plans) and ‘the inspection charge’. An invoice will be issued for the
inspection charge after the first inspection has been carried out.

Building Notice - The total basic charge must be paid when the notice is submitted to the Council.

Regularisation Application – The charge is 120% of the full basic charge (ex. VAT) and is
payable upon submission of the application.

Exemption from charges – Works to provide access and/or facilities for disabled people to
existing dwellings and buildings to which the public have access are exempt from charges.

The minimum total charge for a room in the roof to a dwelling is £472 + VAT

The minimum total charge for an extension to a dwelling exceeding 60m² is £630 +VAT

Where charges are calculated form this table a builders estimate should accompany the
submission.

Please note that a new charging scheme under the Building (Local Authority Charges) Regulations 2010 will be
introduced between 1st April 2010 and 1st October 2010.

Refunds
Please note that the Regulations make no provision for refunds except where an application is rejected and
returned to an applicant because it is invalid, and also in certain circumstances in relation to fees submitted to the
Secretary of State and the Council in respect of Enforcement Notices Appeals. The Borough Council will, however,
where possible endeavour to arrange a refund where an application is “withdrawn”, prior to it having been formally
registered.

Licensing Act 2003 (statutory fees)


Applications for new premises licences and club premises certificates, variations, and annual fees

The licence fees payable for Premises Licences and Club Premises Certificates are based upon the rateable
value in the local non-domestic rating list for the time being in force. The fees payable are set in Bands,
depending upon the rateable value, in accordance with the table below.

In addition to the main fees payable upon application, an annual charge is also payable on the anniversary of the
date of the original grant. The relevant fee must also be submitted in respect of variation applications.

In the case of applications relating to premises in the course of construction, they are assigned to Band C. In the
case of premises without a rateable value, they are assigned to Band A.

Exemptions
Certain exemptions to fees apply in the case applications for premises, club premises certificates, annual fees for
such premises, and related variation applications.

The exemptions cover Regulated Entertainment only, and relate to:-

a) Educational institutions comprising schools and colleges (in specified circumstances), and
b) Premises which form part of a church hall, chapel hall or other similar building or a village hall, parish hall
or community hall or other similar building.

Southend On-Sea Borough Council
Discretionary Permits – Draft Guidelines
1. The Council has signed up to the Nottingham Declaration and recognises its obligations to review its
policies appropriately and to implement sustainable travel policies. Our aim is to encourage local
organisations to support and promote these through their green travel plans, encouraging their staff to
use greener, healthier, more sustainable modes of transport to and from their place of work. In this
regard, the Council has reviewed its existing policies for discretionary staff car parking permits for any
voluntary, charitable or any other organisation or business. All future applications covering renewals
and/or new discretionary permits will be assessed against the Council’s policy applicable at the time of
the application. Each application will be considered on its own merits.

2. Emergency Parking by medical/nursing staff on emergency medical duty - should a PCN be issued in
such circumstances, the authority may review this if suitable supportive evidence is supplied by the
employer or the practitioner to justify the emergency parking need as part of the representation for an
appeal.

3. Parking on zig-zag lines, single yellow lines or double yellow lines or where it causes obstruction shall
not be allowed (except in justifiable emergencies)

4. 2009/2010- Organisations with existing permits either free or subsidised will be informed that the
allocation of the existing permits is being reviewed and all applicants will need to justify their continued
need and that the existing arrangements will be replaced by an updated policy on 1st April 2010, to
reflect a sustainable approach. Until that time all existing arrangements will be honoured on a pro rata
basis.

5. Proposed New Policy


a. Non Charitable Organisations
Existing non charitable organisations with subsidised or free permits may be given a discount of 25%
for annual discretionary permits based on the appropriate charges for 2010/11. This would be
conditional upon submission of a satisfactory Green Travel Plan demonstrating serious commitment
to reducing permit needs and encouraging other modes of transport. This will be monitored for any
future renewal applications. Such parking will be limited to within the Town Centre to Seaway and
Farringdon multi storey section car parks.

b. Charitable Organisations
A discount of 50% based on the appropriate charges for 2010/11 may be available for annual
discretionary permits to registered local charitable organisations (excluding charity shops) working
locally. This would be conditional upon submission of a satisfactory Green Travel Plan
demonstrating serious commitment to reducing permit needs and encouraging other modes of
transport. This will be monitored for any future renewal applications. Such parking will be limited to
within the Town Centre to Seaway and Farringdon multi storey section car parks.

c. Health Professional and Carers


A Health/Carer permit may be issued to Health Professionals and Carers with a justifiable need for
use of vehicle during the course of their daily duties. Such permits will be valid between 8am to 6pm,
Mondays to Fridays or at weekends where exceptionally justified. These will be issued to the
health/carer business against the make and model of a vehicle and upon sight of business use
insurance cover. This permit will enable parking on and off street in the appropriate charging zones
for the purposes of undertaking caring duties at the resident’s private home. Such permits are not
approved for use at clinics, surgeries, residential care establishments or hospitals. Where issued
these will enable parking off or on street in any controlled street for a maximum of two hours with no
return within 4 hours and the permit and time clock will need to be displayed. The exclusions at 3
above will apply. The cost of such permits will be £80.00 per annum to cover the whole Borough and
£50.00 per annum for Borough excluding central zone A*.
d. Parking in Resident bays.
Visitors permit or a carer permit may be obtained on application by residents which may be used
alternatively by the health /carer workers. All permits will be assessed against standard conditions
for the relevant type of permits.
e. Replacements
A £5.00 administration fee will also be payable for replacement and each and every change to any
permit.

6. There shall be no reserved bays/parking for any organisation/user and the Council cannot guarantee a
space.

7. The Council reserves the right to change its policies and charges as it sees fit without any prior notice.

Zone A)
