JOINT AFFIDAVIT

We, DATU PIO PANGANTAO, SHURA PANGANTAO, RONALD PANGANTAO, MERALGEN

MANAGKIL, EMELDA OSOYOS, AUGUSTINA COMAHIG, DAILA ARNOSA, EVANGELINE TAHUYAN,
LOLITA SANDIMAN, EMELINA DICHOS, and ELENA MANGKIL, all are Filipino and residents of
Barangay San Vicente, Dangkagan, Bukidnon, and UNDER OATH hereby depose and state:
(Kami, DATU PIO PANGANTAO, SHURA PANGANTAO, RONALD PANGANTAO, MERALGEN MANAGKIL, EMELDA
OSOYOS, AUGUSTINA COMAHIG, DAILA ARNOSA, EVANGELINE TAHUYAN, LOLITA SANDIMAN, EMELINA DICHOS,
ug ELENA MANGKIL, ang tanan Pilipino, lumulopyo sa Barangay San Vicente, Dangcagan, Bukidnon, nanumpa dinhi
,magasulti ug moingon:)

1. That, we are all members of the Manobo Pulangihon IP/ICCs of Dangcagan, Bukidnon ;
(Nga, kaming tanan mga membro sa Manobo Pulangihon IP/ICCs sa Dangcagan, Bukidnon;)

2. That, on August 27,2019 at eleven (11am) in the Morning in our Function Hall Lucky 9 Resort at
San Vicente ,Dangcagan Bukidnon Atty John Laro NCIP Provincial Office Legal Officer and
Shirlene Sario NCIP Provincial Officer visited us ;
(Nga, adtong Agosto 27,2019 sa alas Onse (11am)sa buntag sulod sa among Function Hall Lucky 9 Resort sa San
Vicente ,Dangcagan Bukidnon, mibisita kanamo si Atty. John Laro ang Abogado sa NCIP Probinsyal, ug si Ma.
Shirlene Sario ang Probinsyal Officer ;)

3. That, the two (2) NCIP personnel’s main purpose were to tell us about the FPIC of the proposed
HYDRO POWER PLANT (DAM 5) PROJECT;
(Nga, ang dako nga tuyo sa duha ka personahe sa NCIP,mao ang pagsulti kanamo kabahin sa giplanong PROYEKTO
nga HYDRO POWER PLANT (DAM 5);)

4. That, Atty. John Laro had told us angrily with his fist hammered on the table strongly and
intimidating us all, he added my throat was hurt of keep on telling you to make an ordinance but
none of the IPMR had done;)
(Nga, si Atty. John Laro sa masuk-anon nagasulti kanamo uban sa pagmartilyo sa iyang kinumo sa makusog sa
ibabaw sa lamesa ug naghadlok kanamong tanan, ingon pa siya nagsakit na akong tutunlon ug storya ninyo pero
walay mga IPMR nagpasa ug ordinansa
a) In intimidation, he said, that if we opposed the Hydro Power Plant , we violated EVOSS
LAW RA11234 , then a case would be filed against us all;
(Iya kaming gihinadlok , nga kung magbabag kami sa Hydro Power Plant, masupak namo ang balaod nga
EVOSS RA11234, ug makasohan kami;)
b) There was nothing and no ways we could do pursuant of this law but to agree the Hydro
Power Plant, moreover the Land and Natural Resources were part of the imminent Domain
of the state, therefore the Government had the absolute authority of our Ancestral Domain;
(Wala na kami mahimo ane, ug wala nay laing pang pamaagi sumala sa pagpatuman ani nga balaod gawas
sa pagsugot, dugang pa ang yuta ug kina-iyahan kabahin sa pagbulot-an sa estado, busa ang Gobyerno
adunay awtoridad sa among yutang kabilin ;)
c) He warned us all ,that the SALA or Customary Law sanctions would not be applied to a
Non Ips, It could only be applied with the fellow IPs with the same tribe;
(Iya kaming tanan gipahimangno-an, nga ang silot sa SALA o Balaod sa Batasan dili ma-aplikar sa dili tribu,
kini ma-aplikar lamang sa kaubang Tribu nga pareha ug Tribung Grupo;)
d) He told us also that we should not object or to do any acts of objections but to agree with
him because he was a lawyer and what he was telling/talking about was right;
(Iya usab kami nga gisulti-an nga dili gayod kami magsupak o magbuhat sa laraw sa pagsupak gawas sa
pag-uyon kaniya tungod kay siya usa ka abogado ug ang iyang gisulti’o giistorya mao ang sakto;)
e) He told us also that we should make an ordinance because the IPRA 8371 had lack power
and will.
(Iya gidugang pag-ingon nga kinahanglan kami magbuhat sa ordinansa tungod kay ang IPRA 8371 kulangan
sa gahum og pagbout tungod kay ang inyong balaod nay ngipon pero dili kapaak;)

5. That, of what Atty John Laro had said, Shirlene Sario had added ;
(Nga, ug unsa ang gi-istorya ni Atty. John Laro, si Shirlene Sario nagdugang pag-ingon:)
a) The Project site of the Hydropower Plant was owned by the Government, there was no
reason for us to object and oppose but to agree with it;
(Ang lugar diin tukoron ang Hydropower Plant gipanag-iyahan sa Gobyerno, walay rason kanamo nga
magsupak niini gawas lang sa pagsugo. Tungod kay bisan mag unsa pamo wala namoy mahimo;)
b) And we would be given 105 days for the FPIC or else we would violate the law and with
the violations committed a greater tendency we all be put in jail;

 (Ug hatagan lamang kami sa 105 ka mga adlaw para sa FPIC kay ug dili among masupak ang balaod , ug
sa pagsupak maoy hinungdan nga kami mabalhog sa prisohan;)

c) She scolded us all, with emphasis that on August 30, 2019 we should not object and
opposed the project and support the Hydropower Plant by signing the Memorandum of
Agreement.
(Nangasaba siya kanamong tanan,ug iyang gihatagan ug kabug-aton nga sa umaabot Agosto 30,2019 dili
gayod kami magasupak sa proyekto nga Hydropower Plant hinoun suportahan kini pinaagi sa pagpirma sa
Kasabutan;)

6. That , on August 30,2019 at Malaybalay City during the signing of the MOA, the incidents
happened between IPMR Emelina Dechos ,Municipal chieftain Datu Pio Pangantao , and Atty
John Laro ,Shirlene Sario ;
(Nga , adtomg Agosto 30,2019 sa Malaybalay City sa pinirmahay sa Kasabutan, ang nahitabo tali ni IPMR Emelina
Dechos, Municipal Chieftain Datu Pio Pangantao ug Atty. John Laro, ug ni Shirlene Sario;)
a) Atty. John Laro had pointed us and commanded all attendees in double time to sign the
MOA because Twenty Thousand (20,000.00) Pesos cold cash were waiting for those who
signed;
(Gitudlo kami ni Atty John Laro ug gimando-an apil ang tanan nga mga nagtambong nga magdali sa
pagpirma sa Kasabutan tungod kay adunay Viente Mil (20,000.00) Pesos nga ihatag sa magpirma;)
b) We told him, that the Bonus Cash was a small amount and not worth enough against
consciences and the spirit of our ancestors’ sadness, and he reacted , you are lucky as the
Municipal IPMR having a big salary while them (other Ps) had none;
(Amo siyang giingnan nga ka gamay ana nga kantidad, ug dili paigo makabayad sa among mga kunsensya
ug kagoul sa nangamatay namo nga mga katigulangan, ug misanong siya nga maayo man ka dunay dako
nga sweldo apan ang imong mga kauban wala;)
c) From all who attended, Datu Pio and I were the only one who refused to sign the MOA,
that this made Shirlene Sario to outburst her patience and scolded me;
(Sa tanan nga mga nanambong, si Datu Pio lang ug ako (Emelina Dichos) ang wala gayod magpirma sa
maong kasabutan nga maoy hinungdan nga nasuko si Shirlene Sario kanako ug maayo;)
d) I told her that the MOA needed to be reviewed before it should be signed, and she
scolded me more, that according to her, they coordinated at me because I was the IPMR
and I should convene the community and explained this matter as my duty or else I would
be held administratively liable;
(Ako siyang giingnan nga ang Kasabutan kinahanglan nga matun-an ug masusi , sa dili pa kini pirmahan, ug
si Shirlene Sario nangasaba nun ug samot, nga matud pa niya , nga midoul sila nako tungod kay ako ang
Municipal IPMR ug dapat ako gitapok ang kumunidad ug gipasabot kay ako kining katungdanan kay ug dili
manobag ako sa kasong administratibo;)
e) Atty. John Laro threatened me that of what I did , I would face the charges that was in
court already for obstruction of law;
(Si Atty. John Laro naghulga kanako nga sa akong gibuhat sa pag dumili sa pagpirma, ako mag-atubang sa
kaso nga nasang-at na sa korte gumikan sa pagbabag sa Balaod;)
f) I reiteratively, asking the copy of the MOA and told them not to intimidate us and to put
under duress;
(Ako sa masubli nagapangayo sa kopya sa Kasabutan ug nag-ingon kanila nga ayaw kami hadloka, ug
pugsa sa pagpirma;)
g) Shirlene Sario had continued scolding me, and clarified that they were prohibited to give a
copy of the MOA or else they would be under sanctioned.
(Si Shirlene Sario nagpadayon sa pagpangasaba kanako, ug iyang giklaro nga bawal kanila magahatag sa
kopya sa Kasabutan kay ug ila kining buhaton silotan usab sila;)

7. That we affirm and declare that Atty. John Laro and Shirlene Sario had done misdeeds, put us
under duress to sign the MOA , grave misconduct , discrimination, conduct unbecoming of a public
official to us and to our IP/ICC communities ;
(Kami nagpamatoud ug nagdeklarar nga kana si Atty John Laro ug Shirlene Sario nagabuhat sa sayop nga binuhatan,
nagpugos kanamo sa pagpirma nga supak man gayod sa among kabubut-on ,sobrang way batasan, nagdiskriminar ug
nakaminus kanamo, sa wala pagtuman sa iyang katungdanan isip sulogoon sa katawhan nganhe kanamong mga tribu
ug sa among kumunidad;)
8. That we are executing this affidavit to attest the truth of the foregoing facts and for filing
administrative complaints against those persons.
(Nga, kami nagahimo niini nga affidavit aron sa pagpamatoud sa kamatouran ug sa nahaunang mga kamatouran alang
sa pagsang-at sa kasong Administratibo batok aneng mga tawhana;)
