SALE OF LAND

Step 1: Execution of the Deed of Absolute Sale by the vendor in favor of

the vendee.
Step 2: Computation for the Capital Gains Tax and Documentary Stamps
and thereafter, payment of the proper taxes in the Bureau of
Internal Revenue.
Step 3: Submission of the mandatory requirements:
1. TIN of Seller and Buyer
2. Certified True Copy of the Latest Tax Declaration issued by the
Local Assessor’s Office for land and Improvement applicable to
the taxable transaction
3. Owner’s Copy for presentation purposes only together with the
photocopy thereof for authentication or Certified True Copy of
Transfer Certificate Of Title (TCT), Condominium Certificate of
Title (CTC), Original Certificate of Title (OCT)
4. Sworn Declaration of No Improvement by at least one (1) of the
transferees or Certificate of No Improvement issued by the
Assessor’s Office, if applicable.
5. Special Power of Attorney of the processor/authorized
representative must be attached to the docket.
6. Valid IDs (Original for presentation and two photocopies to be
attached to the docket) of the:
1.) Processor/Authorized representative and
2.) Authorizing Seller/Buyer
7. Acknowledgment Receipt
8. Official Receipt/Deposit Slip for this purpose and duly
validated return as proof of payment.
9. P100.00 certification fee and P15.00 Documentary Stamps
issued by the BIR cashier.

NOTE:
1. All documents must be in three (3) copies (1 original and 2
Photocopies
2. Both the Seller and the Buyer have TIN duly checked by the
Registration Section, BIR.
3. Capital Gains Tax Return (1706) and Documentary Stamps
Tax Return (2000-OT) must be filled up completely.
4. All Government Official Receipts issued in relation to the
certified true copies requested must be attached. Three (3)
copies – (1 original and 2 photocopies)
Step 4: Issuance of Certificate Authorizing Registration
Step 5: Payment of the necessary fees in the Registry of Deeds for the
issuance of the Transfer Certificate of Title
Step 5: Presentation of Documentary Requirements:
1. Deed of Absolute Sale
2. BIR CAR/ Tax Clearance Certificate
3. Owners Duplicate Copy of Title
4. Realty Tax Clearance
 5. Tax Declaration (Certified Copy)
6. Transfer Tax Receipt/Clearance
Step 6: Issuance of the Transfer Certificate of Title in the name of the
vendee
Step 7: Presentation of the Old Tax Declaration for its cancellation and
issuance of New Tax Declaration in the name of the vendee
