EXPLANATORY NOTE

Two of the objectives of the State as provided in Republic Act No. 9994, otherwise
known as the “Expanded Senior Citizens Act”, are: “to give full support to the improvement
of the total well-being of the elderly and their full participation in society, considering that
senior citizens are integral part of Philippine society” and “to motivate and encourage the
senior citizens to contribute to nation building”.

The Tagum City Federation of Senior Citizens’ Associations has been in existence for
ten years now. It has widely contributed to the successful implementation of programs for
the senior citizens of Tagum City. It is high time to give due recognition to this organization,
hence, this Ordinance.
CITY ORDINANCE NO. 734, s- 2015

AN ORDINANCE INSTITUTIONALIZING THE TAGUM CITY FEDERATION OF SENIOR


CITIZENS’ ASSOCIATIONS, PROVIDING ITS ORGANIZATION, PARTICIPATION AND
INTEGRATION IN THE PROGRAMS OF THE CITY GOVERNMENT OF TAGUM,
PROVIDING FUNDS THEREFOR AND FOR OTHER PURPOSES.

SECTION 1. TITLE. – This Ordinance shall have a short title known as “TAGUM CITY
FEDERATION OF SENIOR CITIZENS’ ASSOCIATIONS ORDINANCE”.

SECTION 2. PURPOSE AND OBJECTIVES. – The purpose of this Ordinance is to


institutionalize and strengthen the Tagum City Federation of Senior Citizens’ Associations
pursuant to the mandate in Republic Act No. 9994, otherwise known as the Expanded Senior
Citizens Act of 2010, because the senior citizens of this City should remain integrated in
society, participate actively in the formulation and implementation of policies that directly
affect their well-being and share their knowledge and skills with younger generations. They
should be able to seek and develop opportunities for service to the community and to serve
as volunteers in positions appropriate to their interests and capabilities.

With this end in view, this Ordinance shall serve the following objectives:
a. To recognize the rights of senior citizens to take their proper place in
society and make it a concern of the family, community, and
government;
b. To give full support to the improvement of the total well-being of the
elderly and their full participation in society, considering that senior
citizens are integral part of Philippine society;

c. To motivate and encourage the senior citizens to contribute to nation
building; and,
d. To recognize the important role of the private sector in the
improvement of the welfare of senior citizens and to actively seek their
partnership.

In accordance with these objectives, this Ordinance shall:

a. Adopt measures whereby our senior citizens are assisted and


appreciated by the community as a whole;
b. Establish programs beneficial to the senior citizens, their families and
the rest of the community they serve;
c. Establish community-based programs for senior citizens in every
political unit of society; and,
d. Strengthen and support the Senior Citizen’s Association in this City.

SECTION 3. DEFINITION OF TERMS. - For purposes of this Ordinance, these terms


are defined as follows:

a. ACCREDITATION refers to the process of granting authorization, within 60 days from


the organization of the newly elected Sangguniang Panlungsod, to an organization for
the purpose of representation to a local special body. An organization may still be
accredited after the prescribed 60-day period for other purposes, such as
participation in local government programs.
b. BSCA is an acronym that stands for Barangay Senior Citizens’ Association;
c. BSCC is an acronym that stands for Barangay Senior Citizens’ Coordinator;
d. CSO is an acronym that stands for Civil Society Organization which refers to a non-
state and non-profit association that work to improve society and the human
condition;
e. DSWD refers to the Department of Social Welfare and Development;
f. GRASSROOTS PARTICIPATORY BUDGETING PROCESS formerly known as Bottom-
Up-Budgeting Process is a budget and poverty reduction reform agenda that aims to
make the national budget a participatory process;
g. GO is an acronym which stands for Government Organization;
h. HONORARIUM is a reward for services usually rendered on which custom or
propriety forbids a price to be set;
i. LGU refers to the City Government of Tagum;
j. NGO is an acronym that stands for Non-government Organization, a non-stock, non-
profit organization that work with different sectors and communities, promoting their
general welfare and development, provide a wide range of service for people’s
organizations and tend to operate with full time staff;
k. OSCA is an acronym that stands for Office of the Senior Citizens’ Affairs;
l. SENIOR CITIZEN or ELDERLY refers to any resident citizen of the City of Tagum at
least sixty (60) years old;
m. TACIFESCA refers to an acrony m that stands for Tagum City Federation of
Senior Citizens’ Associations;

SECTION 4. BARANGAY SENIOR CITIZENS’ ASSOCIATIONS. The LGU encourages


the organization of one (1) Barangay Senior Citizens’ Association in each of the twenty-three
(23) barangays of Tagum City.

a. FUNCTIONS – The BSCA shall have the following functions:


i. To help in the implementation in their respective barangays the programs
approved by the OSCA, TACIFESCA and/or LGU;
ii. To plan, implement and monitor yearly work programs in pursuance of the
objectives of under existing laws and ordinances pertaining to senior citizens;

iii. To draw up a list of available and required services which are provided to
senior citizens in the barangay by the LGU and DSWD and to disseminate
information thereof to its members;
iv.
To maintain and regularly update on a quarterly basis the list of its members
and submit the same to the TACIFESCA;
v. To serve as a general information and liaison center for senior citizens in their
respective barangay; and,
vi. To monitor compliance of the provisions of existing laws and ordinances
particularly the grant of special discounts and privileges to senior citizens and
to report to the OSCA any individual, establishments, business entity,
institutions or agency found violating any provision of thereof.
b. MEMBERSHIP. – Membership is open only to senior citizens residing in the
respective barangay.
c. DUTIES OF MEMBERS. – Each member shall have the following duties:
i. Promote the objectives and purposes of their respective BSCA and the success
of its economic undertakings, the welfare and health of the members;
ii. Attend in person or through authorized family member representative all
meetings or assemblies that may be called by their officials;
iii. Such other duties as may be provided in their BSCA constitution and by-laws.
d. OFFICERS. – The members of the BSCA shall elect a set of officers in a general
assembly called for that purpose. The officers shall be composed of the President,
Vice President, Secretary, Treasurer, Auditor and such other offices as may be
provided in their respective constitution and by-laws.

e. BSCA PRESIDENT. – The BSCA President shall also be the Barangay Senior Citizens’
Coordinator (BSCC) who shall automatically become a member of the Board of
Directors of TACIFESCA and shall have the following functions:
i. Prepare and submit to its respective Punong Barangay its annual action plans,
accomplishment reports and requests for budgetary assistance from the
barangay;
ii. Conduct a year-end evaluation of its programs and action plan;
iii. Act as representative of the BSCA in all affairs concerning senior citizens;
iv. Disseminate information to its members pertaining to activities, programs,
benefits, incentives, privileges granted to senior citizens, including the
obligations of its members relative thereto;
v. Attend the meetings of the TACIFESCA;
vi. Inform its members about what has been discussed and agreed upon in
TACIFESCA meetings; and,
vii. Such other functions as may be assigned.

f. BSCC. – Each barangay shall have only one (1) BSCC, however, when the need
arises and when the BSCA has more than five hundred (500) registered members,
additional BSCCs may be allowed. The additional BSCC shall be elected by the
officers of the BSCA from among themselves, preferably, but not necessarily, the
Vice President, who shall function under the direction and supervision of the BSCA
President. The additional BSCC must be a member of the BSCA and shall be an ex
officio member of the Board of Directors of TACIFESCA with right to participate in the
discussions but with no right to vote and be voted upon.

SECTION 5. FEDERATION OF BARANGAY SENIOR CITIZENS ASSOCIATIONS. –


The LGU recognizes the organization of the BSCA into one federation known as the Tagum
City Federation of Senior Citizens’ Associations.

a. FUNCTIONS OF TACIFESCA – The TACIFESCA shall have the following functions:

i. To help in the implementation of the programs approved by the BSCA, OSCA,


and LGU;
ii. To draw its own, as well as all BSCA annual plans and requests for budgetary
assistance from the City Government and submit the same to OSCA for
consideration and accommodation;
iii. To draw up a list of available and required services which are provided to
senior citizens in the city by the LGU and DSWD and to disseminate
information thereof to the BSCA;
iv. To collate and update on a quarterly basis the list of members submitted by
each BSCA and submit the same to the OSCA;
v. To serve as a general information and liaison center for the BSCA;
vi. To attend and participate in the meetings of the Provincial and Regional senior
citizens’ associations;
vii. To monitor compliance of the provisions of existing laws and ordinances
particularly the grant of special discounts and privileges to senior citizens and
to report to the OSCA any individual, establishment, business entity,
institution or agency found violating any provision thereof, and,
viii. Such other functions as may be provided in their constitution and by-laws or
as may be required by law or the authorities.
b. COMPOSITION. – Affiliation in TACIFESCA shall be exclusively for BSCAs of Tagum
City upon payment of an affiliation fee, renewable every first working month of the
calendar year beginning January 1, 2008 to December 31, 2008 and every year
thereafter.

c. BOARD OF DIRECTORS AND OFFICERS. – As provided in Section 4, paragraph f of


this Ordinance, all BSCA shall automatically become members of the TACIFESCA
Board of Directors, however, additional BSCCs in barangays with more than 500
registered BSCA members shall be ex officio members only.

The TACIFESCA officers shall be composed of its President, Vice President,


Secretary, Assistant Secretary, Treasurer, Assistant Treasurer, two (2) Public Relations
Officers, two (2) Business Managers, two (2) Sergeant at Arms and such other officers
as may be agreed upon by them.

d. TERM OF OFFICE. – The term of office of the officers shall be two (2) years with re-
election.

e. HONORARIUM. – Each BSCC shall receive a monthly honorarium in the amount of


not less than Two Thousand Pesos (PhP2, 000.00).

SECTION 6. PARTNERSHIP WITH THE LGU. – TACIFESCA shall be partners with the
OSCA and LGU in the development and implementation of programs responsive to the needs
of senior citizens in this City. To this end, the LGU grants the following privileges in favor of
TACIFESCA:

a. ACCREDITATION AS CIVIL SOCIETY ORGANIZATION (CSO) – Existing laws


mandate the grant of special privileges to the elderly, in this regard, TACIFESCA shall
be recognized and accredited as a CSO for purposes of entitlement to budgetary
grants and/or allocations from the LGU or the National Government such as, but not
limited to the grassroots participatory budgeting process (GPBP), upon compliance
with the criteria set forth in existing laws, ordinances or issuances.

b. PARTICIPATION IN SPECIAL BODIES – The LGU recognizes the role of senior


citizens in nation building and as such endorses the representation of TACIFESCA to
advisory boards, sectoral councils, inter-agency committees, technical working
groups, among others, whenever practicable;

c. PARTICIPATION IN CONVENTIONS, SEMINARS AND TRAININGS. – The LGU gives


full support to the improvement of the total well-being of the elderly and their full
participation in society through TACIFESCA, considering that senior citizens are
integral part of Philippine society. In this regard, the LGU supports the participation
of TACIFESCA in conventions, seminars and trainings.

SECTION 7. PARTNERSHIP WITH GOVERNMENT ORGANIZATIONS AND NON-


GOVERNMENT ORGANIZATIONS. – The LGU recognizes the important role of the private
sector in the improvement of the welfare of senior citizens, and their vital role in
complementing the government in the delivery of services to senior citizens, thus, GOs,
NGOs and/or private volunteer organizations, dedicated to the promotion, enhancement and
support of the welfare of senior citizens are hereby encouraged to become partners of
TACIFESCA, OSCA and the LGU in the development and implementation of programs and
projects for the elderly.

SECTION 8. APPROPRIATIONS. - The amount of not less than Six Hundred


Thousand Pesos (P600,000.00) shall be appropriated annually for the honorarium of BSCCs
and for the effective implementation of this Ordinance.

SECTION 9. REPEALING CLAUSE. – City Ordinance No. 83, s-2003, City Ordinance
No. 139, s-2004, City Ordinance No. 452, s-2010, and all other issuances or parts thereof
inconsistent herewith are hereby amended, modified, revised, or repealed accordingly.

SECTION 10. EFFECTIVITY CLAUSE – This Ordinance shall take effect on December
1, 2015.
